About approval of the Instruction for monitoring quality of oil and oil products at the companies and the organizations of Ukraine

Based on the Law of Ukraine "About metrology and metrological activities" and for the purpose of establishment of single procedure for the organization and implementation of the works connected with monitoring quality of commodity oil and oil products during acceptance, storage, transportation and leave we order:

1. Approve the Instruction for monitoring quality of oil and oil products at the companies and the organizations of Ukraine (further the Instruction) it (is applied).

2. Determine that the Instruction extends to subjects of business activity irrespective of patterns of ownership.

3. Take into account that action of the Instruction does not extend to monitoring product quality during production and interstate transportations, in particular - supply of the imported oil.

4. To department concerning oil, gas and oil-processing industry (to Kosyanchuk L. V.) provide submission of the order on state registration in the Ministry of Justice of Ukraine.

5. To impose control over the implementation of this order on the First Deputy Minister Chupruna V.P.

The instruction for monitoring quality of oil and oil products at the companies and the organizations of Ukraine

1 General provisions

The instruction establishes single procedure for the organization and the work connected with monitoring quality of commodity oil (daleeneft) and oil products during their acceptance, storage, transportation and leave.

Action of the Instruction for monitoring quality of oil and oil products at the companies and the organizations of Ukraine (further the Instruction) extends to all groups, classes, types and types of oil and types, brands and types of oil products.

The instruction does not extend to monitoring quality of oil during its acceptance in system of bulk distribution lines, further transportation on trunk oil pipeline system, delivery from trunk oil pipeline system to consumers and overloads on other modes of transport, and also on monitoring quality during production of oil products.

Requirements of this Instruction are obligatory for all companies, organizations and the organizations irrespective of patterns of ownership, physical persons - subjects of business activity (further - the companies) who are engaged at least in one of such types of activity as storage, transportation and leave of oil and oil products, and also executive bodies.

Procedure for creation of lists of means of the measuring equipment which are in operation and are subject to checking, N 262, is approved by Gospotrebstandart's order of Ukraine of 15.09.2005 registered by the Ministry of Justice of Ukraine of 04.10.2005 for N1139/11419.

3 Terms and determinations

The terms below in this Instruction have the following determination.

Accreditation - the procedure during which the national authority on accreditation documentary certifies competence of the legal entity or relevant organ on assessment of conformity to carry out certain work types (testing, calibration, certification, control).

Accredited laboratory - the laboratory accredited on the right of accomplishment of the corresponding work on testing of oil and/or oil products in the certain (declared) area according to requirements of regulating documents of oil and oil products and methods of their testing.

Certification - the documentary certificate body for certification of competence and the right of the applicant to perform calibration of means of the measuring equipment and/or measurement.

Certification of technique of accomplishment of measurements - the procedure of establishment of compliance of technique of research to metrological demands which to it are made.

The certified measuring laboratory - measuring laboratory which has the right to implementation of measurements of physical quantities, determination of the chemical composition, physical and chemical, physicomechanical and other properties and indicators of oil and/or oil products.

The certified laboratory - measuring laboratory which has the right to carrying out the corresponding metrological work; criteria of certification - set of requirements to which there shall correspond applicant to receive certification.

Arbitral test - part of cumulative test which is stored on case of arbitration tests.

Arbitration tests or measurements (further - arbitration tests) - testing (measurement) for the purpose of determination of compliance of oil quality figures and/or oil products to requirements of regulating documents which are performed by neutral laboratory in case of contradictions in case of quality evaluation of oil or oil products.

Measuring laboratory - the company, organization, the organization or their separate division which performs measurement of physical quantities, determination of the chemical composition, physical and chemical, physicomechanical and other properties and indicators of oil and/or oil products, except for the measurements connected with assessment of conformity of oil products, with documentary registration of their results.

Test laboratory - the laboratory performing technical operations which consist in determination of one or several characteristics of oil and oil products according to the established procedure.

Recovery (correction) of quality of oil product - finishing indicator (pour) qualities of oil product to requirements of the regulating document.

Ground test - the test of oil or oil product which is selected from reservoir bottom (the tank, the tank of liquid cargo carrier) figurative metal sampler. Ground test does not concern to structure of cumulative test, and is tested separately.

Express method - the test method standardized (certified) or not standardized which gives the chance for shorter time to determine oil quality figures and/or oil products.

Express testing - testing of oil products which are performed with use of express methods.

Ensuring preserving quality - complex of the actions providing quality of oil and/or oil products which meets the requirements of regulating documents, in the course of acceptance, storage, transportation and leave.

Means of the measuring equipment - the Technical tool which is used during measurements and has the normalized metrological characteristics.

Ring routes - the vehicles intended for repeated transportation of one type of oil product without special preparation of tanks.

Control test - the part of cumulative test used for carrying out testing.

Monitoring tests - estimation of compliance of quality of oil and/or oil products to requirements of the regulating document for the established list of indicators of quality for the purpose of confirmation of possibility of their application for the intended purpose or establishments of the beginning of change of quality.

Laboratory tests (measurement, the analysis) - determination of the actual measure values of quality of oil and/or the oil products established by regulating documents with use of the standardized test methods (measurements) or the certified techniques of testing (measurements).

Oil product brands - oil product which name, symbol, structure and properties are regulated by standards and specifications.

Metrological certification of means to measuring tekhnikiissledovania of means of the measuring equipment for the purpose of determination of their metrological characteristics and establishment of their validity to application.

Mobile (portable) laboratory - the laboratory completed with the necessary equipment, devices and devices for determination of quality of oil products by express methods of carrying out testing which give opportunity quickly to determine indicators of quality of oil products.

The quality certificate - the document which contains data for identification and the actual measure values of quality of oil and/or oil products received as a result of laboratory tests and their compliance to requirements of regulating documents.

Acceptance tests - estimation of compliance of quality of oil and/or oil products according to the established list of indicators to the data provided in the quality certificate of the consignor (during acceptance) or in the magazine of registration of results of testing (during leave).

Checking of means of the measuring equipment - establishment of the validity of means of the measuring equipment to which the state metrological supervision, to application based on results of control of their metrological characteristics extends.

The certificate on recognition of compliance - the document certifying recognition of foreign documents on confirmation of conformity of products to the requirements established by the legislation of Ukraine [The law of Ukraine "About confirmation of conformity"].

The standardized test method - test method on which there is regulating document developed and approved in accordance with the established procedure.

Cumulative test - the test constituted from several pointed tests which are selected in the appropriate order and mixed in the ratio specified in DSTU 4488.

Oil product type - set of oil products of identical functional purpose.

Commodity oil - the oil prepared for delivery to the consumer according to requirements of the existing regulating documents.

Pointed test - the test which is selected in one step. It characterizes quality of oil and/or oil product at the certain set level in the reservoir or the vehicle, and also quality of oil product in one tare place (flank, can, large bottle).

Tradable test - the test which is selected in the course of movement of oil or oil products on the pipeline.

The initiator of testing - physical person or legal entity, including authorized bodies of the government which initiates arbitration tests of oil or oil products.

4 Types of laboratory tests and procedure for collecting of tests

4.1 Testing of oil and/or oil products depending on appointment, share on:

- acceptance;

- control;

- complete (in volume of requirements of the regulating document);

- arbitral;

- others (express testing, certified).

4.1.1 Acceptance tests are performed:

- during acceptance delivery of oil or oil products from vehicles (before draining);

- during leave of oil and/or oil products before departure of vehicles.

The list of indicators of quality specified in appendix 1, is obligatory, but does not exclude possibility of carrying out testing of oil and oil products on other indicators of quality which are specified in regulating documents.

4.1.2 Monitoring tests of oil and/or oil products are carried out:

- after draining from vehicles;

- during intake of oil on the oil pipeline, and oil products on the main oil pipeline in reservoirs of the companies;

- after pumping of oil products on the oil pipeline within warehouse;

- in case of long-term storage (six months and more) gasoline - once in six months suffices, other oil products (except the oil products which arrived in the soldered container and other leak-proof package) - once a year suffices;

- in the tests which are selected from vehicles - no later than 24 hours after collecting of tests from vehicles.

4.1.3 Complete testing of oil or oil products (in the scope of the Technical Requirements of the regulating document) are performed:

- during intake of oil on the oil processing companies;

- during oil products output from production;

- in case of long-term storage (one year and more) gasoline (except gasoline of automobile smesevy) and fuels for aviation engines, aviation oil and on synthetic basis, lubricant and refrigerating liquids - once a year suffices, other oil products (except the oil products which arrived in the soldered container and other leak-proof package) - once in two years suffices;

- if numbers of vehicles and/or numbers locking plombirovalnogo (ykh) structures (stvo) do not match numbers specified in transport documents freight - until draining of oil or oil products;

- if on the vehicle is absent (yut) or it is damaged locking plombirovalnoye (ye) the device (va) (if sealing is obligatory or actually performed that is confirmed by transport documents on freight) - until draining of oil or oil products;

- if oil and/or oil product arrived in the defective, untight tank (container) or with the damaged original packing;

- if oil and/or oil product arrived without quality certificate of the supplier or the quality certificate is completed by the consignor not on all indicators of the regulating document - until draining of oil or oil products;

- if on passport details of quality of the consignor discrepancy of quality of oil and/or oil product to requirements of the regulating document is established;

- for tare oil products after completion of warranty period of storage there are at least two times a year, since date of the expiration of warranty period of storage;

- after recovery of quality of oil product.
