About bodies and services for children and special facilities for children

Proceeding from the Constitution of Ukraine and the Convention of the UN on the child's rights this Law determines the legal basis of activities of bodies and services for children and special facilities for children to which implementation of social protection and prevention of offenses among the persons which did not reach eighteen-year age is assigned.

Section I. General provisions

Article 1. Bodies and services for children, the special facilities and organizations performing social protection of children, protection of the rights of the child and prevention of offenses

Implementation of activities for social protection of children, protection of the rights of the child and prevention of offenses is assigned within certain competence on:

the central executive bodies providing forming also realize state policy in the field of social policy, social protection of the population, concerning family and children, improvement and rest of children, prevention and counteraction to domestic violence;

the central executive body providing forming also realizes state policy in the field of adoption and protection of the rights of the child;

executive body of the Autonomous Republic of Crimea in the field of family and children, service for children of the regional, Kiev and Sevastopol city public administrations, district, district public administrations, city, settlement, village councils in the cities of Kiev and Sevastopol;

guardianship and custody bodies regarding implementation of powers and actions in the field of protection of the rights of the child;

governing bodies in the field of education, educational institutions, organizations and the organizations of education system;

bodies of health care, organization and healthcare institution;

social security authorities of the population, organization and organization of social protection;

territorial authorities of the central executive body realizing state policy in the field of social protection of the population concerning provision of social services, social family support, improvement and rest of children;

authorized divisions of bodies of National police of Ukraine;

receivers distributors for children of bodies of National police of Ukraine;

courts;

prosecutor's office;

centers for provision of free secondary legal assistance;

authorized bodies concerning probation;

special educational facilities of the Public criminal and executive service of Ukraine;

shelters for children;

centers of social psychological recovery of children;

centers of social support of children and families;

centers of medico-social resettlement of children of healthcare institutions;

Schools of social resettlement and professional schools of social resettlement of governing bodies in the field of education;

social and rehabilitation centers (children's towns);

centers of social services.

In ensuring social protection of children, protection of the rights of the child participate in limits of the competence other executive bodies, local government bodies, the companies, organizations and the organizations irrespective of pattern of ownership, citizens of Ukraine.

Social protection of children and protection of the rights of the child in this Law is understood as package of measures, decisions and actions of the subjects specified in parts one and the second this Article, for providing the child with social, educational, medical, legal and other services, ensuring the best interests of the child, observance of the rights of the child determined by the Constitution of Ukraine, the Convention of the UN on the rights of the child and the legislation of Ukraine.

Article 2. The basic principles of activities of bodies and services for children, the special facilities and organizations performing social protection of children, protection of the rights of the child

Activities of bodies and services for children, the special facilities and organizations performing social protection of children, protection of the rights of the child are performed on the principles:

legality;

applications mainly the methods of education and belief providing application of enforcement powers only after exhaustion of all other corrective actions on behavior of children;

publicity, that is systematic informing on the state of affairs on protection of the rights of the child, work of the central executive body providing forming also realizes state policy in the field of adoption and protection of the rights of the child, executive body of the Autonomous Republic of Crimea in the field of family and children, services for children, special facilities, organizations of social protection for children and the organizations performing protection of the rights of the child in open state statistical information, mass media;

preserving confidentiality of information on children who made offenses and to whom measures of individual prevention were applied;

inadmissibility of humiliation of honor and advantage of children, them abuse.
