About the status of the deputy of the House of Representatives, the member of council of the Republic of National assembly of the Republic of Belarus

This Law determines the rights and obligations of the deputy of the House of Representatives, the member of council of the Republic of National assembly of the Republic of Belarus (further respectively - the deputy of the House of Representatives, the member of council of the Republic), establishes the basic legal and social guarantees of implementation of the powers by them.

Chapter 1. General provisions

Article 1. Deputy of the House of Representatives, member of council of the Republic

The deputy of the House of Representatives is the representative who is freely elected by the people, the representative to perform legislature in the House of Representatives, to represent the voters in state bodies, to perform other powers provided by the Constitution of the Republic of Belarus and this Law.

The citizen of the Republic of Belarus who reached 21 years can be the deputy of the House of Representatives.

The member of council of the Republic is person given in the procedure established by the law authority on implementation of legislature in Council of the Republic and also other powers provided by the Constitution of the Republic of Belarus and this Law.

The citizen of the Republic of Belarus who reached 30 years and lived in the territory of the respective area in the city of Minsk can be at least five years the member of council of the Republic.

The member of council of the Republic for life from its consent is the President of the Republic of Belarus who stopped execution of the powers in connection with the expiration of his continuance in office or ahead of schedule in case of his resignation (further – the member of council of the Republic performing the powers for life).

The same person cannot be the member of two chambers of Parliament at the same time. The deputy of the House of Representatives cannot be the member of the government, the deputy of local council of deputies. The member of council of the Republic cannot be at the same time member of the government. Combination of obligations of the deputy of the House of Representatives, the member of council of the Republic with simultaneous holding the post of the President of the Republic of Belarus or the judge is not allowed.

Article 2. Participation of the deputy of the House of Representatives in implementation of the government

Implementation of National assembly of the Republic of Belarus by the House of Representatives (further – the House of Representatives) the government within the powers is based on active and equal participation in its work of each deputy.

The deputy of the House of Representatives takes part in consideration of the questions carried by the Constitution of the Republic of Belarus to competence of the House of Representatives.

The most important activity of the deputy of the House of Representatives is participation in legislative process.

The deputy of the House of Representatives during the implementing of the deputy activities and accomplishment of the election programmes according to the Constitution of the Republic of Belarus and the legislation has the right to express freely the opinion and to vote, being guided by interests of the people, the beliefs and considering economic and social opportunities of the state.

Article 3. Participation of the member of council of the Republic in implementation of the government

Implementation of the Republic of National assembly of the Republic of Belarus by Council (further - Council of the Republic) the government within the powers is based on active and equal participation in work of each his member.

The member of council of the Republic participates in consideration of the questions carried by the Constitution of the Republic of Belarus to competence of Council of the Republic.

Article 4. Legislation on the status of the deputy of the House of Representatives, member of council of the Republic

The status of the deputy of the House of Representatives, the member of council of the Republic is determined by the Constitution of the Republic of Belarus and this Law. Single questions of their activities can be regulated by other acts of the legislation, regulations of the House of Representatives and Council of the Republic.

Article 5. Term of office of the deputy of the House of Representatives, member of council of the Republic

Term of office of the deputy of the House of Representatives, the member of council of the Republic – five years if other is not provided by the Constitution of the Republic of Belarus.

Completion date of powers begins the deputy of the House of Representatives, the member of council of the Republic from the date of the first meeting newly elected the Houses of Representatives, Council of the Republic and comes to an end in the opening day of the first meeting of the House of Representatives, Council of the Republic of new convocation, except as specified, provided by this Law.

Implementation of powers of the member of council of the Republic performing the powers for life begins from the date of receipt in Council of the Republic of its written application about the decision to perform powers of the member of council of the Republic.

The deputy of the House of Representatives, the member of council of the Republic are considered performing the powers on professional basis during convocation provided that they no later than three months from the date of the first meeting of newly elected relevant chamber of National assembly of the Republic of Belarus passed to professional work into Parliament and performed it before the termination of the term of the powers established by part two of this Article.

The term of office of the deputy of the House of Representatives, the member of council of the Republic can be prolonged according to part one of article 93 of the Constitution of the Republic of Belarus only in case of war.

Article 6. Conditions of implementation by the deputy of the House of Representatives, member of council of the Republic of the powers

The deputy of the House of Representatives performs the powers in Parliament on professional basis.

The member of council of the Republic performs the powers in Parliament on professional basis or without separation from labor (office) activity. It is exempted from execution of labor (office) obligations in the place of the main work (service) for the period of implementation of the powers by it.
