About approval of the Regulations on the "Information about Persons Which Crossed Frontier of Ukraine" database

1. Approve Regulations on the "Information about Persons Which Crossed Frontier of Ukraine" database (further - the Provision) which are applied.

2. In accordance with the established procedure to submit to management of communication and informatization of Department of protection of frontier together with legal support division of International legal department this order on state registration to the Ministry of Justice of Ukraine.

3. To department of protection of frontier of Administration of the State Border Service of Ukraine:

provide establishment of software and hardware complexes of automation of border control (further - PTK agrarian and industrial complex) "Metal-1/P" of the integrated information and telecommunication Metal system (further - IITS "Metal") the State Border Service of Ukraine at all check points (control Items) (further - check points);

carry out work on connection of these complexes to telecommunication system of the State Border Service of Ukraine for ensuring continuous information collection to the "Information about Persons Which Crossed Frontier of Ukraine" database (further - the Database of persons) the central storage of data of the central subsystem of IITS "Metal" from PTK agrarian and industrial complex "Metal-1/P" established at check points;

provide forming and functioning of the Database of persons as IITS "Metal" this the central subsystem constituting the central storage, and also storage of information with observance of access mode;

according to the Rules of ensuring information protection in information, telecommunication and informatsionnotelekommunikatsionny systems approved by the resolution of the Cabinet of Ministers of Ukraine of 29.03.2006 of N 373, to organize accomplishment of actions for creation and implementation in IITS "Metal" of end-to-end system of information protection.

4. To provide to chiefs of bodies of protection of frontier of the State Border Service of Ukraine when implementing border control introduction of authentic information about persons who cross frontier of Ukraine, in the Database of persons from documents on the right of departure from Ukraine and entry into Ukraine, the passport of the citizen of Ukraine and other sources of documentary information.

5. To provide to the rector of National academy of the State Border Service of Ukraine of B. Khmelnytsky, the chief of Training center on training of junior specialists of the State Border Service of Ukraine studying of requirements of this order during training of the corresponding categories of the military personnel.

6. To impose control over the implementation of this order on the First Deputy Chairman of the State Border Service of Ukraine - the director of the department of protection of frontier.

7. The order inform staff of the State Border Service of Ukraine in part which concerns it.

Regulations on the "Information about Persons Which Crossed Frontier of Ukraine" database

1. This Provision is developed according to the Laws of Ukraine "About the State Border Service of Ukraine" and "About information", other legal acts in the field of informatization and establishes general requirements to collection, use and storage of information on persons which crossed frontier of Ukraine.

2. Terms are used in this Provision in values in which they are used in the Laws of Ukraine "About information", "About information protection in informatsionnotelekommunikatsionny systems", "About telecommunications", "About the National program of informatization".

3. The "Information about Persons Which Crossed Frontier of Ukraine" database (further - the Database of persons), the automated databank of information about the citizens of Ukraine, foreigners and persons without citizenship registered at check points through frontier and according to documents of citizens of Ukraine on the right of departure from Ukraine and entry into Ukraine, including the passport of the citizen of Ukraine, and passport documents of foreigners and stateless persons.

4. The database of persons is created for the benefit of investigation, counterprospecting ensuring protection of frontier of Ukraine, operational and detective activities, participation in fight against organized crime and counteraction of illegal migration, for ensuring accomplishment of orders of law enforcement and prospecting agencies by it and for provision three days before the election day in district electoral commissions of information about persons which are registered within the corresponding administrative and territorial unit, actually crossed frontier and at the time of provision of data there are no data on their return on the territory of Ukraine, and in other cases provided by the laws of Ukraine.

5. The database of persons is component of the central storage of data (further - TsSD) the central subsystem of the integrated information and telecommunication Metal system of the State Border Service of Ukraine (further - the Metal system) and the integrated interdepartmental informatsionnotelekommunikatsionny system concerning control of persons, vehicles and loads which cross frontier (further - the Lasso system).

6. The structure and operating procedure of the Metal system and the Lasso system are determined by regulations on these systems which are developed and affirm Administration of State frontier service of Ukraine.

7. Forming of the Database of persons provides possibility of information integration into similar databases of other law enforcement agencies, and also the central executive bodies, subjects of the Lasso system according to the current legislation.
