Based on the Law of the Republic of Uzbekistan "About the state control of activities of business entities", the Regulations on Republican council on coordination of activities of monitoring bodies approved by the Presidential decree of the Republic of Uzbekistan of November 19, 1998 No. UP-2114, of the legal decision of meeting of Republican council on coordination of activities of monitoring bodies of May 3, 2007 the No. 1 Council decides:

1. Approve Regulations on procedure for the organization of checks of activities of individual entrepreneurs by monitoring bodies according to appendix.

2. From the date of entry into force of the specified Provision to declare invalid Item 2 of the decision of Republican council on coordination of activities of monitoring bodies of May 16, 2002 No. 2/1-G.

3. This resolution becomes effective after 10 days from the moment of state registration in the Ministry of Justice of the Republic of Uzbekistan.

Regulations on procedure for the organization of checks of activities of individual entrepreneurs by monitoring bodies

This Provision according to the laws of the Republic of Uzbekistan "About the state control of activities of business entities", "About guarantees of freedom of business activity", presidential decrees of the Republic of Uzbekistan of November 19, 1998 No. UP-2114 "About Streamlining of the Organization of Checks of Business Entities", of June 14, 2005 No. UP-3619 "About Measures for Further Enhancement of System of Legal Protection of Subjects of Entrepreneurship" and of October 5, 2005 No. UP-3665 "About Measures for Further Reducing and Enhancement of System of Checks of Subjects of Entrepreneurship" regulates procedure for the organization of checks of activities of subjects of entrepreneurship - the physical persons registered in accordance with the established procedure and performing business activity without formation of legal entity (further - individual entrepreneurs).

I. General provisions

1. Republican council on coordination of activities of monitoring bodies (further - Council), the territorial commissions of Council for the Republic of Karakalpakstan, areas and Tashkent (further - the regional commissions), on areas and the cities (further - the district commissions), monitoring bodies and their territorial subdivisions (further - monitoring bodies) under the organization of checks of activities of individual entrepreneurs are guided by acts of the legislation on the state control of activities of business entities, protection of the rights and guarantees of freedom of business activity, and also this Provision.

2. Monitoring bodies perform activities of individual entrepreneurs with the permission of Council, the regional and district commissions, except as specified accomplishment of the control functions specified in appendix No. 1 to this Provision.

3. Checks of activities of individual entrepreneurs are performed in stationary objects (buildings, constructions) in which they make products, goods are implemented, different works are performed and/or services, except for counter checks and checks of the individual entrepreneurs performing the activities out of stationary objects (buildings, constructions) are rendered.

4. Subject of check of activities of individual entrepreneurs are questions:

a) observance of the tax legislation and legislation on foreign economic activity;

b) observance of rules of trade and rendering services, including application of cash registers and settlement terminals, availability of the certificate of conformity on the implementable goods which are subject to obligatory certification, the corresponding brands on measuring devices;

c) compliances with law on accounting and maintaining cash transactions;

d) availability on products of prints of the State assay brand, including assay brand of the Republic of Uzbekistan;

e) observance of requirements of regulating documents for standardization, metrology and certification;

e) compliances with law about sanitary inspection, veterinary supervision, measures of fire safety and requirements of energy and ecological supervision.

5. Subject of check of activities of individual entrepreneurs licensees is also observance of licensed requirements and conditions by them.

6. Checks of activities of individual entrepreneurs are performed by exclusively following monitoring bodies within their competence:

bodies of the State Tax Service - on the questions provided by subitems "a", "b" and "v" of item 4 of this provision;

The state assay chamber of the Agency on precious metals under the Central bank of the Republic of Uzbekistan - on the questions provided in the subitem "g" of item 4 of this provision;

state supervision bodies in the field of standardization, metrology and certification - on the questions provided in the subitem "d" of item 4 of this provision;

bodies of the state sanitary, veterinary, fire, energy inspection and bodies of the State committee of the Republic of Uzbekistan for conservation within their competence - on the questions provided in the subitem "e" of item 4 of this provision;
