About approval of Rules of physical protection of nuclear materials, nuclear installations and Items of storage of nuclear materials
The government of the Russian Federation decides:
1. Approve the enclosed Rules of physical protection of nuclear materials, nuclear installations and Items of storage of nuclear materials.
2. To the federal executive bodies and the organizations performing activities for production, use, storage, utilization, transportation or transportation of nuclear materials or products on their basis and also for designing, construction, operation and conclusion from operation of nuclear installations and Items of storage of nuclear materials, for the purpose of ensuring physical protection of nuclear materials, nuclear installations and Items of storage of nuclear materials till January 1, 2008 to bring the regulatory legal acts into accord with the Rules approved by this resolution.
3. Recognize invalid:
the order of the Government of the Russian Federation of March 7, 1997 No. 264 "About approval of Rules of physical protection of nuclear materials, nuclear installations and Items of storage of nuclear materials" (The Russian Federation Code, 1997, No. 11, the Art. 1317);
Item of 10 changes and additions made to decisions of the Government of the Russian Federation concerning safety of traffic, approved by the order of the Government of the Russian Federation of July 31, 1998 No. 866 (The Russian Federation Code, 1998, No. 32, the Art. 3910);
Item of 11 changes and additions which are made to orders of the Government of the Russian Federation concerning rail transport, approved by the order of the Government of the Russian Federation of August 8, 2003 No. 476 (The Russian Federation Code, 2003, N 33, the Art. 3270).

1. The these rules developed in accordance with the legislation of the Russian Federation in the field of safety when implementing activities in the field of use of atomic energy and taking into account the international obligations of the Russian Federation and recommendations of IAEA about physical protection of nuclear materials and nuclear installations establish requirements for the organization and ensuring physical protection of nuclear materials, nuclear installations and Items of storage of nuclear materials (further - physical protection) in the territory of the Russian Federation, obligatory for accomplishment by all legal entities performing activities for production, use, storage, utilization, transportation (transportation) of nuclear materials, designing, construction, commissioning, operation and conclusion from operation of nuclear installations and Items of storage of nuclear materials irrespective of form of business, the federal executive bodies and State Atomic Energy Corporation "Rosatom" exercising control and coordination in the specified field of activity or providing such activities, and also exercising supervision of these activities.
Requirements for physical protection of radioactive waste, radiation sources, radioactive materials and Items of their storage are determined by other regulations which are not contradicting these rules.
Requirements for ensuring physical protection of nuclear materials, nuclear installations and Items of storage of nuclear materials on the nuclear objects subordinated to the Ministry of Defence of the Russian Federation, and also on safety (protection) of the nuclear weapon which is in operation are established according to all-army regulations of the Armed Forces of the Russian Federation and regulatory legal acts of the Ministry of Defence of the Russian Federation.
2. In these rules the following concepts are used:
"the analysis of vulnerability" - the process of identification of weak spots organized by management of nuclear object, determinations of threats, probable methods of their implementation and models of violators;
"the external violator" - the violator from among persons who do not have access rights in the protected zones;
"external threat" - the threat proceeding from the external violator;
"the internal violator" - the violator from among persons having right of access without maintenance in the protected zones;
"zone of interior" - the zone located in the protected zone, access to which is limited and controlled, surrounded with the physical barriers residing under protection and observation;
"internal threat" - the threat proceeding from the internal violator;
"diversion" - deliberate action concerning the nuclear materials, nuclear installations, Items of storage or vehicles transporting nuclear materials or nuclear installations, capable to lead to emergency and to create health hazard or lives of people as a result of impact of radiation or to lead to radioactive environmental pollution;
"admission" - the right of citizens to access to the data which are the state secret, or the permission to carrying out which is drawn up in accordance with the established procedure on nuclear object of works with use of such data drawn up in accordance with the established procedure;
"access" - pass (journey) to the protected zones, buildings, constructions, rooms (can be authorized and unauthorized);
"the protected zone" - the territory of nuclear object, access to which is limited and controlled, surrounded with the physical barriers residing under protection and observation;
"zone of limited access" - the zone which is not containing the nuclear materials I-III of categories and weak spots of nuclear installations, access to which is limited and controlled;
"check-point (post)" - specially equipped place for control and management of pass of people and journey of vehicles according to the procedure, established by access control;
"model of violators" - set of data on number, equipment, readiness, awareness and tactics of actions of violators, their motivation and the purposes pursued by them which are used in case of development of requirements to system of physical protection and assessment of its efficiency;
"violator" - the person who made or trying to make unauthorized action, and also person rendering him assistance in it;
"neutralization of the violator" - use of system of physical protection in relation to the violator therefore he loses opportunity to continue unauthorized actions;
"unauthorized action" - making or attempt of making of diversion, plunder of nuclear materials, nuclear installations, unauthorized access, bringing (transportation) of the prohibited objects, inactivation or violation of functioning of technical means of physical protection;
"especially important zone" - the zone located in the zone of interior, access to which is limited and controlled, surrounded with the physical barriers residing under protection and observation;
"the protected zone" - the protected, internal or especially important zone;
"assessment of the situation" - determination of the reasons of giving of alarm signal the sensor;
"transportation of nuclear material" - the movement of nuclear material by vehicles of carrier, the sender or receiver from the point of departure (the railway station, port, the airport) to destination (the railway station, port, the airport) performed on the basis of the transportation agreement signed in accordance with the legislation of the Russian Federation;
"perimeter of the protected zone" - the border of the protected zone equipped with technical means of physical protection and check-points (posts);
"personnel of physical protection" - persons, including from structure of forces of protection to which job responsibilities accomplishment of functions on implementation of physical protection on nuclear object and in transit or transportation of nuclear materials, nuclear installations belongs (except for the military personnel of the Armed Forces of the Russian Federation);
