About single state system of registration and accounting of offenses

This Law is directed to fixing of the legal basis of functioning of single state system of registration and accounting of offenses.
In this Law the following main terms and their determinations are used:
single state system of registration and accounting of offenses - order of registration of offenses the criminal prosecution authorities, bodies conducting administrative process and courts, and also accounting treatment for offenses and provision of data on offenses by law-enforcement bodies;
single national bank of data on offenses - the information system including set of data on offenses;
offenses - crimes and administrative offenses;
provision of data on offenses - the actions directed to acquaintance with the data which are stored in single national bank of data on offenses, certain person or the group of people or on confirmation of lack of such data;
registration of offenses - assignment by criminal prosecution authorities, the bodies conducting administrative process both courts to offenses of registration numbers and fixing of data on offenses;
accounting of offenses - introduction by law-enforcement bodies of data on the offenses registered by the criminal prosecution authorities, bodies conducting administrative process and courts into single national bank of data on offenses.
The main objectives of single state system of registration and accounting of offenses are collection, systematization, storage, use and protection of data on offenses, their provision to state bodies and other organizations of the Republic of Belarus, state bodies and other organizations of foreign states, the international organizations, and also lawyers, notaries and other physical persons.
The relations connected with functioning of single state system of registration and accounting of offenses are regulated by the legislation on single state system of registration and accounting of offenses, and also international treaties of the Republic of Belarus.
The legislation on single state system of registration and accounting of offenses is based on the Constitution of the Republic of Belarus and consists of this Law and other acts of the legislation.
The questions of functioning of single state system of registration and accounting of offenses which are not settled by this Law and other legal acts are regulated according to the procedure, established by Council of Ministers of the Republic of Belarus.
If the international treaty of the Republic of Belarus establishes other rules, than those which are provided by this Law then are applied rules of the international treaty.
The single state system of registration and accounting of offenses is based on the principles:
respect and observance of the rights, freedoms and legitimate interests of physical persons, including individual entrepreneurs, rights and legitimate interests of legal entities;
legality;
objectivity, completeness and accuracy of the information;
availability and openness of information in the limits established by this Law and other legal acts;
obligation and uniformity of registration and accounting of offenses.
