About mass actions

This Law establishes procedure for the organization and holding meetings, meetings, street processions, demonstrations, picketing and other mass actions and is directed to creation of conditions for realization of constitutional rights and freedoms of citizens, ensuring public safety and procedure when holding these actions on streets, squares and in other public places.

Freedom of the mass actions which are not breaking law and order and the rights of other citizens of the Republic of Belarus is guaranteed by the state.

Chapter 1. General provisions

Article 1. Legislation on mass actions

The legislation on mass actions consists of the Constitution of the Republic of Belarus, this Law and other acts of the legislation.

Article 2. The basic concepts applied in this Law and their determinations

For the purposes of this Law the following basic concepts are applied:

mass action - meeting, meeting, street procession, demonstration, picketing and other mass action;

other mass action - the sports and mass, cultural and spectacular, other spectacular or cultural action, religious action held in the places which are specially not intended for this purpose under the open sky or indoors;

meeting - joint presence of citizens in in advance determined place under the open sky or indoors at the scheduled time, gathered for collective discussion and the solution of the questions infringing on their interests;

meeting - mass presence of the citizens in certain place under the open sky who gathered for public discussion and expression of the relation to actions (failure to act) of persons and the organizations, to events of social and political life and also for the solution of the questions infringing on their interests;

street procession - organized grass-roots movement of group of citizens on pedestrian or carriageway (road), the boulevard, the prospectus, the area for the purpose of drawing attention to any problems or public expression of the social and political moods or protest;

demonstration - organized grass-roots movement of group of citizens on pedestrian or carriageway (road), the boulevard, the prospectus, the area, including with use of vehicles and other vehicles, for the purpose of drawing attention to any problems or public expression of the social and political moods or protest with use of posters, banners and other means;

picketing - public expression by the citizen or group of citizens of social and political, group, private and other interests or protest (without procession), including by hunger strike, on any problems with use or without use of posters, banners and other means. The joint mass presence of citizens in in advance determined public place (including under the open sky) at the scheduled time for making of in advance determined act organized (including through the global computer Internet or other information networks) for public expression of the social and political interests or protest is equated to picketing;

the essential harm done to the rights and legitimate interests of citizens, the organizations to the either the state or public concerns - failure of mass action, the temporary termination of organization activity or violation of movement of vehicles, death of people, causing heavy bodily harm to one or several victims;

damage in large size - damage on the amount exceeding the size of basic size established on the date of making of offense in ten thousand and more time.

Article 3. Coverage of this Law

Operation of this Law extends to citizens of the Republic of Belarus, foreign citizens and stateless persons within their rights and freedoms, stipulated by the legislation.

The procedure for the organization and holding mass actions established by this Law does not extend on:

the meetings of groups of workers, political parties, labor unions, religious and other organizations held in rooms according to the legislation, charters of the specified organizations (regulations on them);

the meetings held according to the legislation on republican and local meetings;

picketing for petition of voters on promotion of candidates for president of the Republic of Belarus, in deputies, carried out in the places which are not forbidden for this purpose by local executive and administrative organs;

the meetings, meetings and picketing organized by candidates for president of the Republic of Belarus in deputies, their authorized representatives according to the procedure, the stipulated in Article 45-1 Electoral code of the Republic of Belarus.

The procedure for the organization and holding mass actions established by this Law, except for Article parts four 4, of part one, paragraphs of the fifth or eighth, tenth and eleventh of part two, paragraphs of the fourth or eighth, eleventh and twelfth of part three, parts of the fourth or sixth Article 11, of the paragraph of the fourth of part one and part two of article 12 of this Law does not extend to the mass events held according to the decision of state bodies.

Chapter 2. Procedure for the organization and holding mass actions

Article 4. Organizers of mass action

As organizers of meeting, meeting, street procession, demonstration, picketing in which participation to 1000 people is supposed and other mass action irrespective of the number of expected participants the citizens of the Republic of Belarus who are constantly living on its territories which reached eighteen-year age and having the voting rights, specified in this quality in the statement for holding mass action and assumed obligation in writing on its organization and carrying out according to this Law and also the political parties, labor unions and other organizations of the Republic of Belarus registered in accordance with the established procedure, except for the organizations of the Republic of Belarus which activities are suspended according to legal acts can act.

Only political parties, labor unions and other organizations of the Republic of Belarus can act as organizers of meeting, meeting, street procession, demonstration, picketing in which participation over 1000 people is supposed.
