About approval of Rules of rendering telematic communication services

According to the Federal Law "About Communication" and the Law of the Russian Federation "About consumer protection" the Government of the Russian Federation decides:

1. Approve the enclosed Rules of rendering telematic communication services and enact them since January 1, 2008.

2. Subitems "an" - "in" item 4 of the Section XVI of lists of licensed conditions of implementation of activities in the field of rendering the corresponding communication services approved by the order of the Government of the Russian Federation of February 18, 2005 N87 "About Approval of the List of Names of the Communication Services Entered to Licenses and Lists of Licensed Conditions" (The Russian Federation Code, 2005, N 9, Art. 719; 2006, N 2, the Art. 202) to state in the following edition:

"a) network access of communication of the licensee;

b) access to information systems of information and telecommunications networks, including to the Internet;

c) acceptance and transfer of telematic electronic messages.".

Rules of rendering telematic communication services

I. General provisions

1. These rules govern the relations between the subscriber or the user, on the one hand, and the telecom operator rendering telematic communication services (further - the telecom operator), on the other hand, when rendering telematic communication services.

2. The concepts used in these rules mean the following:

"subscriber" - the user telematic communication services with whom the paid contract on rendering telematic communication services with selection of unique code of identification is signed (further - the agreement);

"subscriber line" - the communication line connecting the customer (terminal) premise equipment to hub site of data communication network;

"drop-side interface" - technical technological parameters of the physical chains connecting means of communication of the telecom operator to the customer (terminal) premise equipment and also the formalized rule set of their interaction;

"exchange service station" - set technical and the software applied by the subscriber and (or) the user when using of telematic communication services to transfer, acceptance and display of electronic messages and (or) forming, storage and the information processing containing in information system;

"malicious software" - the software which is purposefully leading to violation of legitimate rights of the subscriber and (or) user, including to collection, processing or transfer from the exchange service station of information without the consent of the subscriber and (or) the user or to deterioration in parameters of functioning of the exchange service station or communication network;

"payment card" - the means allowing the subscriber and (or) the user to use telematic communication services, having identified the subscriber and (or) the user for the telecom operator as payers;

"the user telematic communication services" - the person ordering and (or) using telematic communication services;

"information system" - set of information containing in databases and information technologies and technical means providing its processing;

"information and telecommunications network" - the technological system intended for transfer on information communication lines, access to which is provided with use of computer aids;

"provision of access to information systems of information and telecommunications network" - possibility of acceptance and transfer of telematic electronic messages (exchange of telematic electronic messages) between the exchange service station and information system of information and telecommunications network;

"provision of network access of data transmission" - set of actions of the telecom operator for forming of subscriber line, connection with its help of the customer (terminal) premise equipment to hub site of data communication network or on possibility of connection to data communication network of the customer (terminal) premise equipment with use of telephone connection or connection on other data communication network for the purpose of possibility of rendering to the subscriber and (or) user of telematic communication services;

"exchange protocol" - the formalized set of requirements to structure of the telematic electronic message and to algorithm of exchange of telematic electronic messages;

"the network address" - number from resource of numbering of data communication network which is unambiguously determining the exchange service station or means of communication incoming information system when rendering telematic communication services;

"spam" - the telematic electronic message intended to the indefinite group of people, delivered to the subscriber and (or) the user without their prior consent and which is not allowing to determine the sender of this message including in view of specifying in it nonexistent or counterfeited source address;

"tariff plan" - set of price conditions under which the telecom operator suggests to use one or several telematic communication services;
