About approval of the Provision and Structure of the Ministry of Internal Affairs of the Azerbaijan Republic

For the purpose of enhancement of the normative legal basis of activities of the Ministry of Internal Affairs of the Azerbaijan Republic I decide:

1. Approve the Provision and Structure of the Ministry of Internal Affairs of the Azerbaijan Republic it (is applied).

2. This Decree becomes effective from the date of signing.

Regulations on the Ministry of Internal Affairs of the Azerbaijan Republic

1. General provisions

1.1. The Ministry of Internal Affairs of the Azerbaijan Republic (further - the Ministry) is the central executive body performing the powers established by the laws of the Azerbaijan Republic in the sphere of ensuring public order and public safety, prevention and disclosure of crimes in the Azerbaijan Republic.

1.2. The ministry is guided in the activities by the Constitution of the Azerbaijan Republic, the laws of the Azerbaijan Republic, decrees and orders of the President of the Azerbaijan Republic, resolutions of the Cabinet of Ministers of the Azerbaijan Republic, international treaties which participant is the Azerbaijan Republic, this the Provision, and also regulatory legal acts of the Ministry.

1.3. 2. Functions of the Ministry of Internal Affairs

2.1. The ministry builds the work on the basis of the principles of respect of rights and freedoms of man and citizen, legality, humanity, and also one-man management and within the powers established by the legislation of the Azerbaijan Republic performs the following functions:

2.1.1. organization of work on ensuring public order and public safety;

2.1.2. organization of work on prevention of crimes and other offenses, disclosure of crimes and organization of the investigation;

2.1.3. organization of work on traffic safety;

2.1.4. it is cancelled;

2.1.5. organization of activities of internal troops.

3. Obligations of the Ministry of Internal Affairs

3.1. In stipulated by the legislation procedure and cases for the Azerbaijan Republic the Ministry carries out the following tasks:

3.1.1. determines the main activities of law-enforcement bodies for the purpose of ensuring public order and public safety, provides implementation of preventive actions in the sphere of prevention and disclosure of crimes;

3.1.2. analyzes crime condition, prepares operational and long-term forecasts of criminogenic situation and on this basis makes in relevant organs of the government offers on ensuring public safety, increase in efficiency of fight against crime and to other questions relating to its powers, takes part in preparation and implementation in this sphere of state programs;

3.1.3. in the procedure established by the legislation of the Azerbaijan Republic and cases will organize implementation of operational search activities, inquiry and pretrial investigation on the cases relating to powers of law-enforcement bodies, and also criminalistic and other researches;

3.1.5. will organize maintaining single statistics of crimes and statistics in system of the Ministry, carries out development and enhancement of the automated system in processing and transfer of these data, provides document storage in archive;

3.1.6. will organize and performs search of the persons disappearing from bodies of inquiry, investigation and court, and evading from punishment and also probation of supervision, work on identification of missing persons, corpses which personality it is impossible to identify, and also search of stolen property;

3.1.7. will organize preparation of organizational and methodical means on conducting inquiry and the investigation in law-enforcement bodies, other instructions for system of the Ministry;

3.1.8. in stipulated by the legislation procedure and cases for the Azerbaijan Republic will organize work on execution of decisions of doznavatelny, investigating bodies, courts, executive and probation of structures of the Ministry of Justice of the Azerbaijan Republic;

3.1.9. will organize hearing of cases about the administrative offenses referred by the legislation of the Azerbaijan Republic to powers of law-enforcement bodies and also issue of special permissions (licenses);

3.1.10. will organize business management, the law-enforcement bodies relating to powers, - the cases connected with issue to citizens of passports and identity certificates, work on registration on the residence and the place of stay, and the centralized accounting system connected with the matters takes part in the solution of questions of acceptance in nationality, recoveries in nationality and the nationality terminations;

3.1.11. performs in interaction with competent state bodies of action for prevention of illegal migration;
