About rules of ethical behavior of government employees

(as amended on 30-12-2022)

This Law establishes rules and the principles of ethical behavior of government employees and legal mechanisms connected with their observance.

Chapter 1. General provisions

Article 1. Law coverage

1.1. These rules extend to all persons having the status of the government employee.

1.2. Each government employee shall, being guided by rule of law, human rights, democratic principles and rules highly - ethical behavior, to observe provisions of this Law.

Article 2. Law purposes

2.0. The purposes of this Law are:

2.0.1. increase in the authority of state bodies and public service, increase in trust of citizens to state bodies and government employees;

2.0.2. increase in efficiency and transparency of activities of state bodies and government employees;

2.0.3. prevention of corruption in state bodies and collisions of interests in activities of government employees;

2.0.4. ensuring compliance by government employees with rules of ethical behavior;

2.0.5. informing citizens on the behavior expected from government employees;

2.0.6. expansion of opportunities of citizens to influence assessment of activities of state bodies and government employees.

Article 3. Legal regulation of office behavior

3.1. Office behavior of the government employee are activities for implementation provided to it by the legislation of the rights and accomplishment of obligations. The office behavior of the government employee shall be based on the rules and the principles of ethical behavior established by this Law.

3.2. The office behavior of the government employee is regulated by this Law and other regulatory legal acts.

3.3. Norma, specifying the rules of ethical behavior established by this Law guarantees on their observance can be established by other regulatory legal acts of state bodies. The specified regulatory legal acts shall not contradict provisions of this Law.

Chapter 2. Rules of ethical behavior

Article 4. Fair behavior

4.1. Government employees shall fulfill effectively the office duty for interests of the personality, society and state.

4.2. The government employee shall be in any situation example of conscientiousness for each person.

Article 5. Increase in professionalism and personal liability

5.1. The government employee shall perform the activities within the powers established by the legislation of the Azerbaijan Republic and at the professional level.

5.2. The ethical behavior and professional activity the government employee shall raise and strengthen trust of physical persons and legal entities to state bodies.

Article 6. Loyalty

6.1. In the cases which are not relating to service duties, the government employee shall evade from critical public statements, performances on occasion of activities of state bodies, their heads (except for their illegal activities) and to give public assessment to their activities. This rule does not extend to the performances connected with scientific and pedagogical activities of the government employee, or its scientific works.

6.2. The government employee shall not allow the actions incompatible with fulfillment of duties, connected with public service, and discrediting his name, and also able to lower the authority of state body.

6.3. The government employee shall follow the rules established by state body in connection with open performances.

6.4. The state body shall observe restrictions, stipulated by the legislation about public service.

Article 7. Public trust

7.1. The government employee shall strengthen authority of the Azerbaijan Republic, state body and public service, ennoble the name and honor.

7.2. The government employee shall eliminate consequences of violation of rules of ethical behavior by him, including take measures for recovery of public trust.

7.3. The government employee shall render assistance to the subjects of media who are interested in activities of state bodies and their officials in obtaining in the procedure established by the law and cases of authentic (exact) data.

Article 8. Respect of the rights, freedoms, legitimate interests, honor, advantage and business authority of persons. Respect of the business authority of legal entities

8.1. Activities of government employees shall serve providing, protection and protection of the rights, freedoms and legitimate interests of persons.

8.2. The government employee shall not allow decisions and actions (or failure to act) which violate the rights, freedoms, legitimate interests of persons and can soil their goodwill.

8.3. Except for stipulated by the legislation cases the government employee shall keep confidentiality known to him in connection with accomplishment of service duties of data on private life, honor and advantage of physical persons, and also government employees;

8.4. The government employee shall be respectful to the business authority of legal entities and not allow actions (or failure to act) which can soil their business authority.

Article 9. Cultural behavior

The government employee shall be polite, benevolent, attentive and patient in the relations with all persons, including with the direct and higher heads or persons who are under their supervision.

Article 10. Accomplishment of orders, orders or orders

10.1. The government employee shall carry out the written orders accepted him by the direct or higher head within the powers, orders or oral instructions given by them which correspond to the law.

10.2. If the government employee is sure that the order this by his direct or higher head, the order or the order contradicts the law or other regulatory legal act, it shall provide written reasons for it to the direct or higher head. He shall demand from the direct head of the written confirmation of this order, the order or the order. Article 11. Impartiality

11.1. The government employee shall be impartial in case of accomplishment of service duties or decision making and at the same time not to allow benefit of any person or group of persons depending on their race, nationality, religion, language, floor, social accessory, property and official position, beliefs, belonging to public or any other associations or to create conditions for receipt of similar benefit.

11.2. In case of accomplishment of service duties the government employee shall show political apathy.
