Agreement between the State Social Security Fund of the Azerbaijan Republic and Pension fund of Ukraine on mutual transfer and pension payment

of March 24, 1997

According to Article part three 6, articles 7 and 8 of the Agreement between the Government of the Azerbaijan Republic and the Government of Ukraine about cooperation in the field of provision of pensions of July 27, 1995 (further - the Agreement) the State Social Security Fund of the Azerbaijan Republic and the Pension fund of Ukraine (further - the Parties) agreed as follows:

General provisions

Article 1

According to part three of article 6 of the Agreement in case of resettlement of the pensioner from the territory of one state on the territory of another if pension is not granted on the bases, stipulated by the legislation the state in which there is new place of residence of the pensioner, the state on which territory the pensioner moved continues to pay pension payment.

Transfer of pensions is made by the State Social Security Fund of the Azerbaijan Republic and the Pension fund of Ukraine.

Article 2

According to article 7 of the Agreement of disability pension and in case of loss of the supporter owing to labor mutilation are appointed and paid according to the legislation of the state of the Party in the territory of which the labor injuries, at the expense of its means were sustained.

Disability pensions and in case of loss of the supporter owing to occupational disease are appointed and paid according to the legislation of the state of the Party in which the labor activity which led to this disease, and at the expense of its means was performed.

Transfer of pensions is made by the State Social Security Fund of the Azerbaijan Republic and the Pension fund of Ukraine.

Article 3

The transfer of pensions provided by the Agreement is performed only on condition of resettlement of the pensioner from the territory of one state on the territory of another for permanent residence.

Article 4

Mutual transfer of pensions is made by the Parties in US dollars after converting of the pension amount determined in national currency in US dollars.

Article 5

Payment of the help on burial and the pensioner of pension amount half-received in connection with death is carried out by the legislation at the expense of means of the Party appointing and making pension payment.

Article 6

Transfer of pensions according to this agreement is made quarterly no later than the 10th day of the third month of quarter for which payment is carried out.

Article 7

Transfer of pensions according to this agreement is made since month to which pension was paid in the previous place of residence, but no more than in six months prior to month of the request for receipt of pension.

Procedure for transfer of pensions

Article 8

The statement for transfer of pension and the document confirming the place of permanent residence of the pensioner move in the State Social Security Fund of the Azerbaijan Republic if the pensioner constantly lived in the territory of the Azerbaijan Republic, or in the Pension fund of Ukraine if he constantly lived in the territory of Ukraine.

The party which received the application within 3 days reports to other Party data on the pensioner whose pension is subject to transfer:

o surname, name and middle name;

o home address;

o type of pension which is subject to transfer into the new place of residence.

After one of the Parties receives these data from other Party and recognizes the right to transfer of pension abroad, prepares the sheet on pension payment.

Article 9

The sheet on pension payment is constituted on sample which is applied to this agreement.

The Party which finances pension payment sends two copies of the sheet to pension payment to the Party which will perform their payment.

The party which performed pension payment returns one copy of the sheet to the Party which financed payment, with marks about pension payment and with indication of the reasons of their nonpayment.

Article 10

Sending to sheets, the Party which finances pension payment, transfers to the bank account the Parties which will perform pension payment, the amounts of the means noted in the sheet.

Unpaid within 30 days after receipt of payment of pension amount the Party which performed payment returns on the bank account to the Party which financed payment.

The expenses connected with transfer of pensions

Article 11

The citizens having the right to pensions according to this agreement do not incur the expenses connected with transfer of pensions.

The banking expenses connected with money transfer into accounts of each of Agreement parties and return of the amounts of unpaid pensions bear the State Social Security Fund of the Azerbaijan Republic and the Pension fund of Ukraine.

Expenses on fee on delivery and pension payment are born by Side of the state in the territory of which receivers of pensions live.

Article 12

The party which finances pension payment according to this agreement bears responsibility for full and timely translation of pensions.

The party which performs pension payment bears responsibility for timely and correct pension payment.

Cooperation of the Parties

Article 13

The state Social Security Fund of the Azerbaijan Republic and the Pension fund of Ukraine perform cooperation with the provision purpose to applicants of the help in receipt of pensions.

Article 14

The state Social Security Fund of the Azerbaijan Republic and the Pension fund of Ukraine free of charge provide each other necessary information and give help connected with transfer of pensions.

The state Social Security Fund of the Azerbaijan Republic and the Pension fund of Ukraine report each other about changes in the legislation of the states and departmental regulations which concern implementation of provisions of this agreement.

Exchange of information, following from implementation of this agreement, is performed in Russian.

Article 15

The state Social Security Fund of the Azerbaijan Republic and the Pension fund of Ukraine assign at each other and within this agreement free of charge exercise medical and administrative control of the citizens having the right to provision of pensions.

Article 16

The disputes connected with transfer of pensions according to this agreement are solved the Parties by negotiations.
