Chapter 1. General provisions

Article 1. Legislation on republican and local meetings

The legislation on republican and local meetings consists of the Constitution of the Republic of Belarus, this Law and other acts of the legislation.

Article 2. Coverage of this Law

This Law governs the public relations connected with preparation and holding republican and local meetings in the Republic of Belarus.

The procedure for preparation and holding republican and local meetings established by this Law does not extend on:

the meetings of groups of employees of the organizations, persons in the place of study or service, members (participants) of political parties, labor unions, religious and other organizations held in rooms according to the legislation, charters of the specified organizations (regulations on them);

meetings of founders (constituent assemblies) held according to the legislation for creation (organization) of public associations, consumer cooperatives and other organizations;

the meetings held according to the legislation on mass actions;

the meetings organized according to the Electoral code of the Republic of Belarus, legal acts for the status of the deputy of the House of Representatives, the member of council of the Republic of National assembly of the Republic of Belarus, the deputy of local council of deputies.

Article 3. Purpose of convocation of republican and local meetings

Republican and local meetings as the main form of direct participation of citizens of the Republic of Belarus (further, unless otherwise specified, - citizens) in administration of society and state are convened for discussion of questions of the state and public life of republican or local value.

Article 4. Principles of holding republican and local meetings

Participation of citizens in republican and local meetings is free and voluntary.

Citizens participate in republican and local meetings on an equal basis: each citizen has one voice.

Republican and local meetings are held openly and publicly.

Persons recognized by court incapacitated, the persons which are containing according to the court verdict in places of detention, being by a court decision in medical and labor dispensaries, and also persons concerning whom according to the procedure, established by the criminal procedure legislation, the measure of restraint in the form of detention, house arrest is applied cannot participate in republican and local meetings.

Article 5. Competence of republican and local meetings

The republican meeting is competent if at least two thirds of members of republican meeting participate in it.

The local meeting is competent if at least 25 percent of the citizens having the right to participate in this local meeting participate in it or at least two thirds of representatives to participate in local meeting of representatives.

Article 6. General power of republican and local meetings

Members of republican and local meetings have the right to discuss questions of the state and public life of republican or local value, to make on them offers and to make decisions.

Members of republican and local meetings in case of decision making are guided by the Constitution of the Republic of Belarus, this Law and other acts of the legislation.

Republican and local meetings have the right to address with offers the President of the Republic of Belarus, Vsebelorussky people's assembly, in National assembly of the Republic of Belarus, Council of Ministers of the Republic of Belarus, other state bodies and other organizations, other officials. Appeals of republican and local meetings are considered according to the procedure, established by the legislation on addresses of citizens and legal entities.

Article 7. Financing of preparation and holding republican and local meetings

The procedure for financing of preparation and holding republican meetings is established by the President of the Republic of Belarus.

Financing of preparation and holding local meetings is performed by their initiators.

Direct or indirect participation of foreign states on behalf of their state bodies or diplomatic representations, interstate educations, foreign and international legal entities (the organizations, not being legal entities), the citizens of the Republic of Belarus who are constantly living outside the Republic of Belarus or being outside the Republic of Belarus more than 183 days within 12 months preceding month of provision of foreign free aid, the foreign citizens and stateless persons which do not have permissions to permanent residence in the Republic of Belarus, and also foreign anonymous donors in financing and other financial support by preparation and holding local meetings is forbidden.

Article 8. Obligations of members of the republican and local meetings and persons invited to republican or local meetings

When holding republican and local meetings their participants and persons invited to republican or local meetings shall observe public order and fulfill all legal requirements of persons responsible for preparation and holding republican or local meetings (in case initiator of local meeting are citizens, – members of initiative group).

During republican and local meetings it is forbidden to their participants, persons invited to republican or local meetings:

create hindrances for smooth functioning of the organizations;

have in case of itself cold, fire, gas or other weapon, explosives and ammunition, objects which striking action is based on use of combustible substances, their simulators and models, other objects which can be used as weapon, the poisonous, poisoning, caustically smelling, flammable substances, flammable and pyrotechnic substances or products, except matches and pocket lighters, other substances, objects, products, including self-made production which use can lead to smoke, ignition, and also alcoholic, low alcohol beverages and (or) beer;

perform propaganda for war or extremist activities, including with use of posters, banners or other means;

be effective with the methods creating threat of public safety, life and to health of members of republican or local meeting or other persons;

use the flags, pennants which are not registered in accordance with the established procedure, and also emblems, symbols, posters and banners which content is directed to damnification to public order, the rights and legitimate interests of members of republican or local meeting or other persons;

make the actions breaking established procedure of preparation and holding republican or local meeting and also to instigate to such actions by any methods;
