Chapter 1. General provisions

Article 1. The main terms applied in this Law and their determinations

For the purposes of this Law the following main terms and their determinations are applied:

bus station – the property complex including the waiting room (capacity at least 75 places for sitting of passengers), baggage storages, cash desks of sale of travel documents, object of public catering, service spaces, toilet and other sanitary utility spaces, the platform for landing and disembarkation of passengers, site for the parking of vehicles which is located on stopping points of routes of suburban, long-distance intraregional, long-distance interregional or international motor transportations of passengers;

autocash desk – the property complex including the waiting room (with a capacity up to 25 places for sitting of passengers), cash desks of sale of travel documents, the toilet and other sanitary utility spaces which is located on stopping points of routes of suburban, long-distance intraregional, long-distance interregional or international motor transportations of passengers;

motor transportation – motor transportation of passengers and baggage (further if this Law does not determine other, – motor transportation of passengers) or loads;

motor transportation for own needs – motor transportation which has auxiliary character in relation to core activities of the legal entity or individual entrepreneur and is carried out by them for movement of the workers or loads belonging to them on the property right or on other legal causes, and also for movement which came to specified persons (host party) of partners the vehicles belonging to them on the property right or on other legal causes provided that workers of these of the legal entity or the individual entrepreneur or the individual entrepreneur manage vehicles. The partner is understood as legal entity or physical person (his representatives) with which the host party signs the civil agreement, except for agreements of motor transportation of the passenger or the charter agreement for motor transportation of passengers or which arrived by the invitation of the host party for participation in negotiations and other actions;

automobile carrier – the legal entity or the individual entrepreneur having the right to accomplishment of motor transportations according to the legislation and who are carrying out such transportations;

road transport – mode of transport on which transportations are carried out with use of cars and road trains (further – vehicles), and also communications;

the car taxi – the vehicle used for motor transportations of passengers and conforming to the requirements established by Rules of motor transportations of passengers;

bus station – the property complex including the waiting room (with a capacity up to 75 places for sitting of passengers), baggage storages, cash desks of sale of travel documents, object of public catering, service spaces, toilet and other sanitary utility spaces, the platform for landing and disembarkation of passengers, site for the parking of vehicles which is located on stopping points of routes of suburban, long-distance intraregional, long-distance interregional or international motor transportations of passengers;

baggage – the property of the passenger which is not prohibited on the properties, outline dimensions and weight to motor transportation of passengers in luggage section of the vehicle and accepted for such shipment which is carried out along with the passenger under responsibility of automobile carrier;

the ticket – the travel document on paper;

the owner of the passenger terminal – the legal entity or the individual entrepreneur owning the passenger terminal on the property right or on other legal cause, providing its functioning and rendering services to passengers and automobile carriers on the passenger terminal;

intra republican motor transportations – the motor transportations which are carried out on the territory of the Republic of Belarus, except for the international motor transportations;

accomplishment of motor transportations – the set of actions for motor transportations including movement of the vehicle on the highways, streets of settlements which are not carried in accordance with the established procedure to highways, stop, the parking in loading points (unloading) of load, landing places and disembarkation of passengers on initial and final stopping points of route during customs control, and other transactions connected with motor transportations;

load – accepted (accepted) for motor transportation material values (further – load of commodity nature) and (or) the accepted (accepted) for motor transportation objects and materials which are not material values (further – load of non-commodity nature);

the consignor – legal entity or physical person on behalf of which shipment is drawn up;

the consignee – the legal entity or physical person authorized on receipt of load based on the agreement or on other legal cause;

cargo accompanying documents – documents which according to the legislation, international treaties of the Republic of Belarus, and also the international legal acts constituting the right of the Eurasian Economic Union shall accompany load in case of its motor transportation;

the dispatcher of motor transportations of passengers in the irregular message – the legal entity rendering services in the organization and production control of accomplishment of motor transportations of passengers in the irregular message (except for motor transportations of passengers cars taxi) in certain territory, including acceptance and transfer of orders for accomplishment of motor transportations of passengers in the irregular message, the reference, consulting and other accompanying services, including with use of means of telecommunication and the global computer Internet;

the taxi dispatcher – the legal entity rendering services in the organization and production control of accomplishment of motor transportations of passengers cars taxi including acceptance and transfer of orders for accomplishment of motor transportations of passengers cars taxi, the reference, consulting and other accompanying services, including with use of means of telecommunication and the global computer Internet, in particular by means of electronic information system;

control office – the property complex including cash desk of sale of travel documents, site for the parking of vehicles, office and sanitary utility spaces, which is located on stopping points of routes of city and suburban motor transportations of passengers;

communications – the roads, terminals and other constructions used in case of accomplishment of motor transportations and also the constructions intended for content and servicing of vehicles;

the international motor transportations – the motor transportations which are carried out out of limits (beyond limits) the territories of the Republic of Belarus, because of its limits, and also the transit motor transportations which are carried out through the territory of the Republic of Belarus between two Items of crossing of Frontier of the Republic of Belarus in the places established by the legislation;

the operator of motor transportations of passengers – the legal entity providing the organization of motor transportations of passengers in the regular message in certain territory;

the operator of taxi – the legal entity providing the organization of motor transportations of passengers with cars taxi in certain territory;

the organization of motor transportations – set of organizational actions and technological transactions for ensuring accomplishment of motor transportations;

the passenger – physical person, not privy to vehicle control and transported in it based on the agreement of motor transportation of the passenger or the charter agreement for motor transportation of passengers. Passengers are not in case of execution of the service duties employees of control and auditing services on road transport, service employees of state bodies (organizations) performing control activities under the organization and accomplishment of motor transportations and also in case of accomplishment (rendering) of works (services) connected with such transportations;

the taxi terminal – the property complex including the covered area for the parking of cars taxi, site for landing and disembarkation of passengers and other property intended for rendering services to passengers of cars taxi and to the automobile carriers which are carrying out motor transportations of passengers cars taxi;

the physical person – the citizen of the Republic of Belarus, the foreign citizen or the stateless person, including the individual entrepreneur;

electronic information system – the information system registered in the procedure established by Council of Ministers of the Republic of Belarus in the State register of information systems by means of which the taxi dispatcher or automobile carrier provide the organization and production control of accomplishment of motor transportations of passengers with cars taxi with use of means of telecommunication and the global computer Internet and by means of which payment by passengers of the executed motor transportations of passengers by cars taxi according to the legislation can be performed;
