Chapter I. General provisions

Article 1. Subject of the law and field of application

(1) the Subject of this law is ensuring protection of passengers, aeronautical personnel, air vehicles, the airports, physical persons from acts of illegal intervention by application of the identified regulations, rules, procedures and measures.

(2) This law is applied to all physical persons and legal entities performing activities in the field of civil aviation to the civil air vehicles which are in the territory of the Republic of Moldova and also to the air vehicles registered in the Republic of Moldova where they were.

Article 2. Basic concepts

For the purpose of this law the following basic concepts are used:

acts of illegal intervention - action or attempt of making of the actions creating safety hazard of civil aviation namely:

a) illegal capture of the air vehicle in flight;

b) illegal capture of the air vehicle on the earth;

c) taking of hostages onboard the air vehicle or at the airport;

d) violent penetration aboard the air vehicle, in the airport or in arrangement of aeronautical means or service of civil aviation;

e) placement onboard the air vehicle or at the airport of weapon, dangerous objects or substances intended for criminal objectives;

f) the message of the false information creating safety hazard of the air vehicle in flight or on the earth, passengers, crew members, aeronautical personnel or physical persons at the airport or in arrangement of any aeronautical means or service of civil aviation;

catering - food, drinks, other goods and the equipment, held for use onboard the air vehicle;

the prohibited subject - subject which can be used for making of the act of illegal intervention and which according to the existing regulations is prohibited to bringing in the protected zones of limited access of the airports and to transportation onboard air vehicles;

the central body for aviation safety - the authorized state body responsible for development and ensuring accomplishment of national regulations for aviation safety;

cabin baggage - the baggage intended for transportation in passenger cab of the air vehicle;

mishandled baggage - baggage, by mistake or by carelessness separated passengers or crew;

accompanied baggage - the baggage allowed to transportation in luggage section of the air vehicle provided that its owner is onboard this air vehicle;

unaccompanied baggage - baggage which is transported as load on the same air vehicle on which there is its owner, or on other air vehicle;

examination - control procedure with use of special technical means or manually air vehicles, passengers, members of crews and other persons, baggage, loads and stores for the purpose of detection of weapon, explosive substances, other dangerous objects and devices which can be used for making of acts of illegal intervention;

diversion - the intentional action or failure to act directed to the destruction or damage of air vehicles, buildings, constructions, communicating device or other property of aviation agents threatening activities of civil aviation;

the equipment for safety control - special fittings, held for use independently or as constituent of any system for ensuring protection against acts of illegal intervention;

the overview of security status - assessment of functioning of aviation agents for the purpose of determination of their vulnerability from the point of view of acts of illegal intervention and development of the recommendations about protection corresponding to threat level;

inspection check of security status - consideration of the operating measures and procedures of aviation safety of the aviation agents and state bodies participating in ensuring aviation security for the purpose of determination of efficiency rate of implementation of this law;

the omission - the certificate or other document issued to the individuals working at the airport or persons for whom for certain motives the authorized admission to the controlled area, including documents on the vehicles issued for the same purposes is necessary;
