About the narcological help

The law of the Republic of Tajikistan on the narcological help is aimed at providing the citizens having narcological diseases of the medical and public assistance, prevention and the prevention of narcological diseases.

Chapter I. General provisions

Article 1. Tasks of this Law

Tasks of this Law are protection of the rights and legitimate interests of persons having narcological diseases, establishment of the bases and procedure for rendering the narcological help, and also protection of the rights of the health and other workers giving narcological help.

Article 2. Basic concepts

In this Law the following basic concepts are used:

- narcology - the industry of medical science studying origin conditions, mechanisms of forming of dependence on psychoactive agents, their toxic effects for the purpose of development of adequate methods of diagnostics, treatment and prevention of the diseases caused by them;

- narcological service - network of the specialized, out-patient and stationary divisions in system of medical attendance of the population performing treatment-and-prophylactic, public and legal assistance sick with drug addiction, toxicomania and alcoholism;

- the narcological help - complex of the actions including prevention, dispensary observation, diagnosis of narcological diseases, treatment, leaving, medical and social resettlement of narcological patients;

- narcological organizations - narcological hospitals or the centers, narcological dispensaries, rehabilitation departments or the centers for rendering medico-social resettlement by the narcological patient, offices of the narcologist of the city and district centers of health where specialized medical care is provided to persons having narcological diseases in close cooperation with services of primary health care;

- narcological diseases - the violations of mental and somatic health caused by not medical consumption of psychoactive agents (narcotic, toxic substances and alcoholic) which consequence are forming psychological and dependences on psychoactive agents, social degradation;

- alcoholism - the narcological disease which is characterized by long consumption of alcohol and proceeding with the phenomena of psychological and biological dependence on alcohol, changes of tolerance to it, emergence and development of mental and somatic alcoholic degradation;

- drugs - substances of synthetic or natural origin, their medicines, and also the plants classified as those in the corresponding international conventions and the National list;

- drug addiction - the disease caused by chronic intoxication of organism owing to abuse of drugs which are carried to those in the corresponding international conventions and the National list, and which is characterized by mental and physical dependence on them;

- toxicomania - the disease caused by chronic intoxication of organism owing to abuse of the medicines and other substances which are not relating to drugs and characterized by mental and physical dependence on them.

Article 3. Legislation of the Republic of Tajikistan on the narcological help

The legislation of the Republic of Tajikistan on the narcological help is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by the Republic of Tajikistan.

Article 4. Coverage of this Law

Operation of this Law extends to citizens of the Republic of Tajikistan when rendering the narcological help and is applied to all organizations and persons giving narcological help in the territory of the Republic of Tajikistan.

The foreign citizens and stateless persons which are in the territory of the Republic of Tajikistan when rendering the narcological help to them have all rights established by this Law on an equal basis with citizens of the Republic of Tajikistan.

Article 5. Principles of rendering the narcological help

The narcological help is performed on the basis of the principles of mercy and humanity, proceeds from the right of each person to dispose of the health, and also fundamental obligation of the doctor to give to the patient help, following in the activities to the medical path of duty and professional ethics.

Narcological help to patients is given at their request or from their consent, and to the minors - at request or with the consent of their parents or legal representatives except as specified, stipulated by the legislation the Republic of Tajikistan.

Article 6. The types of the narcological help and social protection guaranteed by the state

The state guarantees the following types of the narcological help and social protection:

- emergency narcological aid;

- anonymous narcological help in specialized narcological agencies;

- consulting and diagnostic, treatment-and-prophylactic help and medical rehabilitation in extra hospital and stationary conditions;

- all types of narcological examination, determination of temporary disability;

- consultations according to legal issues and other types of legal aid;

- the social device of disabled people and aged, having narcological diseases.

Article 7. The rights of persons having narcological diseases

Persons having narcological diseases have all rights and freedoms of citizens of the Republic of Tajikistan provided by the Constitution of the Republic of Tajikistan including:

- the valid and humane relation excluding humiliation of human dignity;

- confidentiality of information on nature of the narcological diseases and the applied treatment methods which are available for them if it does not cause damage to their health;

- application of the means and methods of treatment, except as specified, forbidden by the legislation of the Republic of Tajikistan;

- performing treatment in out-patient and stationary conditions;

- content in stationary medical narcological institution during the term necessary for inspection and treatment;

- rendering the medical help in the conditions conforming to sanitary and hygienic requirements;

- the invitation upon the demand of patients of any specialist of the narcologist, the psychiatrist for work in the medical commission on the questions regulated by this Law;

- receipt of the public assistance from the state;

- submission of claims and statements in state bodies, court, organizations and the organizations;

- the help of the lawyer, legal representative, and also the other person according to the procedure, established by the legislation of the Republic of Tajikistan;
