About approval of Rules of acceptance of regulatory legal acts of safety and labor protection by the relevant authorized bodies

1. Approve the enclosed Rules of acceptance of regulatory legal acts of safety and labor protection by the relevant authorized bodies.
2. Declare invalid the order of the Government of the Republic of Kazakhstan of November 11, 2004 No. 1182 "About approval of Rules of development and approval of regulatory legal acts by state bodies on safety and labor protection and Rules of development and approval of industry standard rates by state bodies on safety and labor protection" (SAPP of the Republic of Kazakhstan, 2004, No. 44, the Art. 560).
3. This resolution becomes effective after ten calendar days after the first official publication.

1. These rules are developed according to the subitem 13) of Article 15 of the Labor code of the Republic of Kazakhstan of May 15, 2007.
2. Rules determine procedure for acceptance of regulatory legal acts in the field of safety and labor protection by the relevant authorized bodies.
3. Regulatory legal acts in the field of safety and labor protection shall meet the following requirements:
1) to establish priority of life and health of workers in relation to results of productive activity;
2) to provide the rights of workers to the working conditions conforming to safety requirements and labor protections;
3) to contain rules, procedures and criteria directed to preserving life and health of workers in the course of their labor activity;
4) to establish single requirements in the field of safety and labor protection;
To differentiate 5) according to the labor law of the Republic of Kazakhstan in the field of safety and labor protection of the right and obligation between workers, officials and the head of the organization;
6) to provide coordinated actions in the field of safety and labor protection between authorized state body on work, local body for inspection of work, representatives of employers and workers;
7) to correspond to legislative and other higher regulatory legal acts in the field of safety and labor protection, including to the international treaties ratified by the Republic of Kazakhstan.
4. Regulatory legal acts in the field of safety and labor protection establish the organizational, technical, technological, sanitary and epidemiologic, medical and other regulations, rules, procedures and criteria directed to preserving life and health of workers in the course of their labor activity.
5. Regulatory legal acts in the field of safety and labor protection shall contain:
1) general requirements of labor safety;
2) safety requirements of work before work;
3) safety requirements of work in operating time;
4) safety requirements of work in emergencies;
5) safety requirements of work upon termination of work;
6) requirements to production (technological) processes;
7) requirements to production rooms;
8) requirements to production sites (for the processes which are carried out out of production rooms);
9) requirements to initial materials, procurements and semifinished products;
10) requirements to production equipment;
11) requirements to placement of production equipment and organization of workplaces;
12) requirements to methods of storage and transportation of initial materials, procurements, semifinished products, finished goods and production wastes;
13) work-rest schedule working at factory;
14) requirements to professional selection and examination of workers on safety issues and labor protections;
15) requirements for providing working at factory special clothes, special footwear and other means of individual and (or) collective protection;
16) requirements to application of remedies;
17) requirements for providing workers with sanitary and household rooms.
6. The regulatory legal act in the field of safety and labor protection may contain additional requirements.
7. Project development of regulatory legal acts in the field of safety and labor protection is performed by the relevant authorized state bodies according to their competence.
8. The relevant authorized state body developing the project of regulatory legal act in the field of safety and labor protection creates the working group on preparation of the project or charges its preparation to one of the divisions which performs functions of working group.
Working group depending on appointment representatives of the interested state bodies, public organizations, scientific institutions can be included.
The state body can charge preparation of the project of regulatory legal act to state bodies and the organizations subordinated to it or to order its preparation on contractual basis, including on tender, specialists, scientific institutions, certain scientists or their collectives.
9. Regulatory legal acts in the field of safety and labor protection affirm the relevant authorized state bodies in coordination with authorized state body on work and other interested state bodies.
Regulatory legal acts are developed and accepted taking into account requirements of the Law of the Republic of Kazakhstan "About regulatory legal acts".
10. Regulatory legal acts in the field of safety and labor protection are subject to state registration in the Ministry of Justice of the Republic of Kazakhstan and become effective from the date of official publication.
