expressing determination to abstain from introduction of restrictions in mutual trade;
recognizing that the purpose of the Parties is further forming of custom union according to the Agreement on the Customs union between the Russian Federation and the Republic of Belarus of January 6, 1995 which will become important milestone of interstate economic integration;
stating the ample potential opportunities given by practical application of the Protocol on introduction of free trade regime without withdrawals and restrictions between the Russian Federation and the Republic of Belarus of January 6, 1995
agreed as follows:
The purposes of this agreement are assistance to expansion of commercial intercourses, to harmonious development of the economic relations between the Parties and economic activity, increase in level of living and employment of the population, performance improvement of work and strengthening of financial stability, and also providing equal conditions for the competition in trade between both countries.
Creation of the most favorable conditions for activities of business entities of both countries shall be the priority direction of further work on improvement of conditions of mutual trade. For this purpose the Parties will study efficiency of their activities in the conditions of the operating systems of economic regulation, including tariff and non-tariff, and will take adequate measures taking into account structural features of economies of the Russian Federation and the Republic of Belarus, being guided by the principles of implementation of market economic transformations in both states.
The parties shall perform on the basis of the single principles joint actions for the state support of business activity and creation in the territory of gosudarstvuchastnik of this agreement of conditions for effective functioning of institutes of market infrastructure.
The parties confirm the principle of application of single rates of customs payments in trade with the third countries, and also quantitative restrictions according to the Protocol on introduction of the mode to free trade without withdrawals and restrictions between the Russian Federation and the Republic of Belarus of January 6, 1995, except for those cases which are provided by the current agreement between the Russian Federation and the Republic of Belarus.
The parties not impose the taxes, charges and other payments similar to customs duties in mutual trade.
Practical application of free trade regime without withdrawals and restrictions between the Russian Federation and the Republic of Belarus according to provisions of the Agreement on the Customs union between the Russian Federation and the Republic of Belarus of January 6, 1995 gives ample opportunities for further development of commercial intercourses between business entities of the Russian Federation and the Republic of Belarus.
The parties will create necessary and equal conditions for development of fair competition of business entities.
The parties will coordinate collateral actions in the field of the prevention, restriction and suppression of monopolistic activities and unfair competition, will approve criteria of determination of the companies of monopolists and will take measures for harmonization of other elements of the legislation in the field of the competition.
The parties will not provide export and other subsidies to the companies which are in the territories of their countries if as a result of provision of such subsidies conditions of fair competition in mutual trade are violated.
When implementing actions within forming of custom union between the Russian Federation and the Republic of Belarus the parties recognize that each of them independently performs accession to the World Trade Organization (WTO).
The parties will hold regular consultations and to communicate on the questions which are of mutual interest in the course of accession to the WTO.
Mutual trade of both countries in goods and services, the prices for which are regulated by the state, is performed with use of the mechanism of the regulation applied to the domestic market, at the same time the Parties will not apply in mutual trade of measure of price regulation, applied concerning the third countries.
The parties will study overall performance of business entities of the states in the conditions of the operating systems of the taxation and will take adequate measures on exceptions of double taxation of the income and property, including by the conclusion of the relevant interstate agreement.
The parties agree that observance of liberty principle of transit is the most important condition of goal achievement of this agreement and essential elements of process of connection of economic complexes of the Parties to system of the international labor division and cooperation.
Transit transportations will not be exposed to unreasonable delays or restrictions.
The parties will promote development of production cooperation and sci-tech cooperation at the interstate, cross-industry, interregional level and at the level of business entities, including by provision of different forms of the state support.
The parties will take necessary measures for deepening and synchronization of market transformations on the basis of regular consultations, exchange of information and experience in the field of carrying out economic reforms.
