The government of the Russian Federation and the Government of the Republic of Belarus which are hereinafter referred to as the Party
proceeding from opportunities of economic, scientific and technical and production capacities of the Russian Federation and the Republic of Belarus,
being convinced that wide use of highly effective modern means and systems of informatization and computer facilities is important factor of further development of market economy of both countries,
aiming to make the contribution to strengthening and deepening economic, industrial and sci-tech cooperation in the field of informatization and computer facilities on equal and mutually advantageous basis and by that to expand and diversify cooperation between both countries,
agreed as follows:
The parties will promote development economic, industrial and sci-tech cooperation in the field of informatization and computer facilities, and also contacts between the interested organizations, associations, the companies and firms of both countries according to their national legal system.
The parties will develop cooperation in the field of informatization and computer facilities in the following main directions:
- standard projects of informatization in all spheres of life activity of society;
- information technologies;
- software and hardware complexes and modern computer aids;
- networks and telecommunication means;
- standardization and certification of program and technical means;
- protection of domestic manufacturers of technical and intellectual means of informatization in the conditions of the market relations;
- legal support of informatization;
- development of the industry of informatization, marketing;
- joint projects implementation of informatization in different spheres of life activity of society.
The specified main directions will be concretized further by executive programs and to be implemented on contractual basis between the interested organizations, associations, the companies and firms of both countries.
The parties will develop cooperation in the following forms:
- exchange of technical documentation and scientific and technical information, including documents on forming and realization of state policy in the field of informatization and computer facilities;
- collaborative planning and realization of research and development works, including forces of joint collectives with possible mutual provision of devices and the equipment;
- development and realization of practical measures, the funds allocated for expansion of mutual purchases and systems of informatization and computer facilities;
- assistance to creation of the joint organizations, associations, the companies and firms providing the fastest development of new information technologies;
- exchange of scientists and specialists;
- organization of joint conferences, exhibitions, symposiums and working meetings;
- other mutually advantageous forms of cooperation.
Recognizing value which financing for projects implementation of cooperation has, the Parties will promote finding solutions on mutually advantageous conditions. At the same time the Parties will consider both national, and possible international sources of financing.
The parties will provide to the organizations, associations, the companies and firms participating in cooperation, optimum conditions in case of accomplishment of joint research and development works, mutual purchases of means and systems of informatization and computer facilities and exchange of scientific and technical documentation according to this agreement.
Any information, materials, program and technical means received by one Party from other Party cannot be transferred to somebody without prior written consent of the Party from which they were received.
The parties will provide proper effective protection and equitable distribution of intellectual property rights to results of the joint operations which are carried out within cooperation on the basis of this agreement according to their national legal system, and also provisions of international agreements which participants they are.
Similar protection of intellectual property rights will be provided with the Parties in relation to the scientific and technical information provided by one Party to other Party during the joint operations which are carried out within this agreement.
The parties establish the joint Russian-Belarusian Working group which aims to consider accomplishment of this agreement and its conditions, to resolve matters of argument, to develop and submit for consideration of the Government of the Russian Federation and the Government of the Republic of Belarus of the offer on development of mutually beneficial cooperation, to organize development and implementation of executive programs for the main directions of cooperation, stipulated in Article 2 this agreements.
The Russian and Belarusian parts of working group are headed by agents of the parties who are cochairmen of the Working group. The structure of the Russian and Belarusian parts affirms according to the procedure, established by each of the Parties.
The working group will gather two times a year serially in the Russian Federation and the Republic of Belarus, and also can be called if necessary on emergency meeting at the request of one of the Parties. The cochairman from the Party in the territory of which there takes place its meeting presides over meeting of the Working group.
The decisions made by the Working group are reflected in the protocols or other negotiation documents signed by the cochairmen of the Working group from each of the Parties or authorized on it by other agents of the parties.
The parties agreed that organizational support of activities of the Working group will be performed respectively by the Coordination center of the Intergovernmental commission on cooperation in the field of computer facilities, the educated Agreement on cooperation in the field of development, production and application of computer aids of December 23, 1969 and Fund of informatization of the Republic of Belarus.
The parties incur expenses on development and implementation of executive programs, stipulated in Article 2 this agreements. The share of their expenses is determined according to established procedure of each of the Parties.
The expenses connected with the organization and holding meetings and meetings of the Working group are born by the Party in the territory of which these meetings and meetings are held.
Costs for traveling expenses of members of the Worker of gruppyuchastnik of meetings and meetings are born by each of the Parties by the part of the Working group according to the current legislation.
