About ecological network
This law is partial transposition of provisions of the Directive 92/43/EEC of Council on protection of natural habitats, and also the wild flora and fauna published in the Official magazine of the European Union No. 206 of July 22, 1992.
The Parliament adopts this organic law.
The purpose of this law is forming of the legal basis of creation and development of national ecological network as component of Pan-European ecological network and local ecological networks, establishment of control mode and protection national and local ecological networks, and also powers and obligations of bodies of public management in the field.
In this law the following basic concepts are used:
ecological corridor - linear or linearly - intermittent element which provides functional and physical communication between elements of ecological network, and also their integrity on a large scale;
elements of ecological network - the territories of ecological network having additional functional purpose for preserving biological and landscape diversity: kernel zones, buffer zones, ecological corridors, zones of ecological restoration;
the card of ecological network - space model which determines arrangement of functional elements of ecological network;
natural heritage - set of physiographic, vegetable, animal and biocenotic components and structures of the environment which ecological, economic, scientific, biogenic, improving, landscape and rekreativny importance and value play important role in question of preserving vegetable and animal biological diversity, functional integrity of ecosystems, the preserving gene pool of plant and animal life, and also for satisfaction connected with life, welfare, culture and civilization of requirements present and future generations;
the project of creation or ecological restoration of element of ecological network - the technical documentation containing information on arrangement and purpose of element of ecological network, the detailed description of measures for its creation or restoration;
local ecological network - the ecological network created at the local level (the area, the geographical zone, etc.) included in national ecological network not completely, and only its separate elements in case of compliance to the criteria established for national ecological network based on which functionality of some elements of local ecological network can change;
national ecological network - the ecological network created at the national level, combining physically and functionally the territories of habitats, landscapes and their elements representing special value from the point of view of the scientific and esthetic value and preserving biological diversity, maintenance of geosystem balance;
Pan-European ecological network - the ecological network created at the European level from national ecological networks of the European countries, combining physically and functionally the territories representing natural and semi-natural elements of landscape which need preserving and management for providing favorable condition of ecosystems, habitats, types and landscapes of the European value;
Emerald network - the ecological network consisting of zones of special nature protection value, being integral part of national ecological network, representing distribution of the approved all-European ecological network of zones of special nature protection value "NATURA 2000" on the countries which are not members of the European Union;
the habitat - certain geographical territory with accurately outlined area;
the habitat of national value - the habitat significantly promoting in biogeographical area to which it belongs to maintenance or recovery of the favorable security status for one of types of the environment of dwelling or one of the types provided in appendix 3 to the Law on flora No. 239/2007, and also capable is essential to assist coordination in Emerald network (NATURA 2000) and/or significantly promoting preserving biological diversity in the respective area;
zone of ecological restoration - the territory which is subject of ecological and/or geomorphological reconstruction (afforestation, recovery of vegetable cover, recultivation) as future element of ecological network;
kernel zone - the territory having special value for
preserving habitats, types and landscapes;
the buffer zone - the territory which performs function of protection of zone of kernel or has special value for maintenance of geosystem balance; depending on functionality the buffer zone can be protective or geosystem;
zone of special nature protection value - object of the all-European value in which application of necessary security measures for maintenance or recovery of the favorable security status for the environment of dwelling and/or populations of types for which this object is intended is provided.
(1) the National ecological network is created for the purpose of preserving natural genetic variety of all types of the live organisms included in ecosystems and natural complexes and also for providing favorable vital conditions and long-term development of the adjacent territories.
(2) Functions of national ecological network:
a) recovery and preserving landscapes and ecosystems;
b) preserving biological and genetic diversity;
c) reduction of erosive processes of the soil;
d) preserving, protection, recovery and expansion of vegetable cover;
e) improvement of fodder base of animals;
f) increase in rekreativny value of the territories;
g) preserving and recovery of water objects, improvement of their quality;
h) stabilization of natural processes on the sites adjacent to ecological network.
(3) the Emerald network is created for the purpose of the protection of zones of special nature protection value caused by availability of types of the habitat and types of special nature protection value.
(1) the Legal basis of creation and development national and local ecological networks is constituted the Constitution of the Republic of Moldova, the international agreements, one of the parties of which is the Republic of Moldova, this law, and also others legislative and regulations in the field.
(2) If the international treaty, one of the parties of which is the Republic of Moldova, contains the regulations other than the provided by the national legal system in the field of creation and development national and local ecological networks provisions of the international treaty are applied.
