LAW OF THE REPUBLIC OF BELARUS

About especially protected natural territories

(as amended on 09-01-2018)

This Law determines the legal basis of functioning and protection of especially protected natural territories, and also their announcements, transformation and the termination of functioning and is directed to preserving natural ecological systems, biological and landscape diversity.

Chapter 1. General provisions

Article 1. The terms applied in this Law and their determinations

In this Law the following terms and their determinations are applied:

the wildlife area - especially protected natural territory announced for the purpose of recovery, preserving and (or) reproduction of natural complexes and objects, natural resources of one or several types with restriction of use of other natural resources;

the reserve - especially protected natural territory announced for the purpose of preserving reference and other valuable natural complexes and objects, studying of animal and flora, natural ecological systems and landscapes, creation of conditions for providing the natural course of natural processes;

land users - persons having in property, the life inherited tenancy, permanent or temporary use, lease, the sublease the parcels of land located in borders of especially protected natural territories and (or) their conservation zones, in borders of the territories reserved for the announcement by their especially protected natural territories;

national park - especially protected natural territory announced for the purpose of recovery and (or) preserving unique, reference and other valuable natural complexes and objects, their use in the course of nature protection, scientific, educational, tourist, recreational and improving activities;

especially protected natural territories – part of the territory of the Republic of Belarus with the unique, reference or other valuable natural complexes and (or) objects having special ecological, scientific and (or) esthetic value concerning which the specific mode of protection and use is set;

protection of especially protected natural territories - the activities directed to preserving and recovery of natural complexes and objects, their rational use and reproduction, prevention of pollution, degradation, damage, depletion, destruction, destruction and other harmful effects of economic and other activity on natural complexes and objects and liquidation of its effects, ensuring compliance with the set mode of protection and use of these territories;

nature sanctuary – especially protected natural territory announced for the purpose of preserving unique, reference and other valuable natural complexes and (or) objects for the benefit of the present and future generations;

system of especially protected natural territories - set of reserves, national parks, and also wildlife areas and nature sanctuaries of republican and local value;

management of especially protected natural territories - the activities connected with planning and holding nature protection and other actions, accounting of the natural complexes and objects located in especially protected natural territories, ensuring compliance with the set mode of protection and use of these territories including by holding field actions for the purpose of operational identification and suppression of violations of the law in the field of protection and use of objects of animal and flora in case of monitoring procedure behind protection and use of the wild animals belonging to subjects to hunting and fishery, wood and shrubby vegetation and other wild-growing plants, forest fund, lands under wild-growing wood and shrubby vegetation (plantings) and also behind ensuring with the fish-breeding organizations safety of the fish containing in ponds of these organizations.

Article 2. The legislation of the Republic of Belarus on especially protected natural territories

The legislation of the Republic of Belarus on especially protected natural territories is based on the Constitution of the Republic of Belarus and consists of this Law and other regulatory legal acts of the Republic of Belarus governing the relations in the field of functioning and protection of especially protected natural territories and also their announcement, transformation and the termination of functioning.

The legal regime of the natural complexes and (or) objects located in especially protected natural territories is determined by the legislation of the Republic of Belarus on protection and use of lands, on protection and use of waters, on protection and use of fauna, on protection and use of flora, on protection and use of subsoil, on use, protection, protection and reproduction of the woods if other is not stipulated by the legislation the Republic of Belarus about especially protected natural territories.

Article 2-1. International agreements of the Republic of Belarus

If the international treaty of the Republic of Belarus establishes other rules, than those which are provided by this Law then are applied rules of the international treaty.

Article 3. Categories and types of especially protected natural territories

Categories and types of especially protected natural territories are determined depending on features of natural complexes and (or) objects, subjects to special protection, the set mode of protection and use, and also level of public administration by their functioning.

The following categories of especially protected natural territories are established:

reserve;

national park;

wildlife area;

nature sanctuary.

Reserves and national parks are especially protected natural territories of republican value.

Wildlife areas and nature sanctuaries can be especially protected natural territories of republican or local value.

Especially protected natural territories of republican and local value can be recognized as especially protected natural territories of the international value.

Wildlife areas and nature sanctuaries are subdivided into types according to articles 30 and 36 of this Law.

Article 4.

It is excluded

 

Article 4-1. The earth of especially protected natural territories

The earth of especially protected natural territories consist of lands of nature protection purpose and (or) lands of other categories, except for the lands specified in part two of this Article.

The structure of lands of especially protected natural territories forming their territories does not join the lands located in borders of especially protected natural territories which special purpose does not answer the nature protection purposes. Such lands are specified in decisions on the announcement, transformation of especially protected natural territories.
