About approval of the Procedure for appointment, transfer and carrying out insurance payments

For the purpose of enhancement of procedure for appointment, transfer and carrying out insurance payments and implementation by working bodies of executive directorate of Social Insurance Fund from labor accidents and occupational diseases of Ukraine of insurance payments to insured persons (members of their families) in case of approach of labor accident and/or occupational disease, being guided by Articles 17, of 21, 34 Laws of Ukraine "About obligatory national social insurance from labor accident and occupational disease which entailed disability", the Board of Social Insurance Fund from labor accidents and occupational diseases of Ukraine DECIDES:

1. Approve the Procedure for appointment, transfers and carrying out insurance payments it (is applied).

2. Consider the voided Procedure for appointment and implementation of insurance payments to insured persons (members of their families) approved by the resolution of board of Social Insurance Fund from labor accidents and occupational diseases of Ukraine of 22.12.2005 No. 83 (with the changes made by resolutions of board of Fund of 06.03.2006 No. 9, of 28.02.2007 No. 10).

3. Executive directorate of Social Insurance Fund from labor accidents and occupational diseases of Ukraine to bring this resolution to managements of executive directorate of Fund in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol.

4. From labor accidents and occupational diseases of Ukraine to provide to executive directorate of Social Insurance Fund state registration of this resolution in the procedure established by the legislation.

Procedure for appointment, transfer and carrying out insurance payments

1. General provisions

1.1. Action of this Procedure extends to the victims and persons having the right to it and also to persons whose right to receipt of indemnification was established according to the legislation of the USSR or the legislation of Ukraine on indemnification caused to workers owing to injuring on production or the occupational disease connected with accomplishment of labor obligations by them earlier.

1.2. In case of loss occurrence of management of executive directorate of Social Insurance Fund from labor accidents and occupational diseases of Ukraine (further - Fund) in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol, departments of executive directorate of Fund in areas and the cities of regional value (further - working bodies of executive directorate of Fund) shall compensate timely and in full the harm done to the worker owing to undermining his health or in case of his death, paying to it or persons having the right to it:

1) benefit in connection with temporary disability before recovery of working capacity or establishment of disability;

2) one-time help in case of steady loss of professional working capacity or death of the victim;

3) the monthly insurance payment in case of partial or total loss of working capacity compensating the corresponding part of the lost victim's earnings (further - monthly insurance payment);

4) insurance payment to the victim in the amount of its average monthly earnings in case of its temporary transfer on easier below-paid work;

5) insurance payment to the victim during its employment rehabilitation;

6) monthly insurance payment to persons having the right to it in case of the death of the victim;

7) cost recovery of the funeral services connected with burial of the dead.

To persons who in the procedure established by the law voluntarily were insured against accident (further - voluntarily insured persons), in case of loss occurrence insurance payments are appointed by working bodies of executive directorate of Fund.

Means for implementation of payment of the help by the insurer in connection with temporary disability of the victim, surcharge to average earnings which the victim had before damage of health in case of its temporary transfer for easier work, and also are allocated with Fund based on the statement calculation in form according to appendix for burial and funeral services connected with it.

Information entered by the insurer in the statement calculation is confirmed by signatures of the head and chief accountant which are responsible for its reliability.
