Agreement on procedure for provision of pensions of the military personnel and their families and national insurance of the military personnel of the State Parties of the Commonwealth of Independent States

The State Parties of this agreement, hereinafter referred to as "State Parties",

based on the Agreement between the State Parties of the Commonwealth of Independent States on social and legal guarantees of the military personnel, persons dismissed in military service and members of their families from February 14, 1992 and on Safeguards agreements of the rights of citizens of the State Parties of the Commonwealth of Independent States in the field of provision of pensions of March 13, 1992,

expressing desire to cooperate in the field of social security of the military personnel, persons discharged from military service, and their families, agreed as follows:

Article 1

Provision of pensions and compulsory national insurance of the military personnel of Armed Forces of the State Parties of the Commonwealth and other military forming created by legislature of these states, the Joint Armed Forces of the Commonwealth, Armed Forces and other military forming of the former USSR and also provision of pensions of families of this military personnel are performed on conditions, on regulations and according to the procedure which are established or will be established by the legislation of the State Parties in the territory of which the specified military personnel and their families live, and before adoption of legal acts by these states on the matters - on conditions, on regulations and according to the procedure, the established legislation of the former USSR. At the same time the level of provision of pensions of the military personnel and their families established by the legislation of the State Parties according to the Agreement on social and legal guarantees of the military personnel, persons discharged from military service and members of their families from February 14, 1992, cannot be lower than the level established by earlier legal and other regulations of the former USSR.

Article 2

In length of service for purpose of pensions to the military personnel the service (including on favorable terms) in the Armed Forces and other military forming specified in Article 1 of this agreement, according to the procedure, established by the legislation of the State Parties in the territory of which the military personnel passed services is set off.

The size of cash allowance (earnings) for purpose of pensions to the military personnel and their families is determined according to the procedure, established by the legislation of the State Parties in the territory of which the military personnel or their families lives.

Article 3

Expenses on provision of pensions of the military personnel and their families and compulsory national insurance of the military personnel are performed by the State Parties at the expense of their budgets without mutual calculations between the states.

Article 4

The State Parties undertake the obligation to inform each other on the regulating documents existing in their states accepted on the basis of mutually agreed legal acts for provision of pensions of the military personnel and their families and compulsory national insurance of the military personnel, their subsequent changes and also to perform permanent cooperation in case of clarification of the circumstances important for the timely and correct solution of questions of provision of pensions and compulsory national insurance.

Article 5

The questions connected using this agreement if necessary will be considered by the Council of Ministers of Defense of the State Parties, and also the Ministries of Defence (committees on defense) of the State Parties of the Commonwealth on bilateral and multilateral basis.

Article 6

The agreement becomes effective from the moment of its signing.

It is made in the city of Tashkent on May 15, 1992 in one authentic copy in Russian. The authentic copy is stored in Archive of the Government of the Republic of Belarus which will send to the states which signed this agreement, its verified copy.

Notification of Turkmenistan

It is hereby notified that Turkmenistan joins the Agreement on procedure for provision of pensions of the military personnel and their families and national insurance of the military personnel of the State Parties of the Commonwealth of Independent States signed at meeting of Council of Heads of Government of the State Parties of the Commonwealth of Independent States in Tashkent on May 15, 1992.

It is made in Ashgabat on September 5, 1994.
