AGREEMENT

of May 15, 1992

About procedure for content and use of objects of space infrastructure for the benefit of accomplishment of space programs

The State Parties of this agreement, being guided by provisions of Agreements on joint activities for research and use of space of December 30, 1991 on Strategic Forces of December 30, 1991, and about the status of Strategic Forces from 14 February of 1992,

recognizing need of preserving and development of single space infrastructure for effective research and use of space for the benefit of the national economy, science, international cooperation,

considering that space infrastructure was created by the combined efforts of the State Parties of the Commonwealth, and proceeding from the legal acts adopted by the State Parties of the Commonwealth

agreed as follows:

Article 1

Objects of space infrastructure (the Baikonur and Plesetsk spaceports, technical, starting, landing complexes, areas of fall of the separated fragments of launch vehicles, control centers of flight of space objects, the Center of training of astronauts, the command and measuring complexes, collection points and information processing, arsenals and other objects) located in the territories of the Azerbaijan Republic, the Republic of Belarus, the Republic of Kazakhstan, the Russian Federation, Turkmenistan, the Republic of Uzbekistan and Ukraine are property of these states.

Right to use immovable, uses and ownerships of personal estate of these objects is transferred based on special agreements to Strategic Forces (Management of the Chief of Space Means (MCSM)) of the Commonwealth of Independent States or other concerned parties.

Coordination of use of space infrastructure for accomplishment of interstate and independent programs of research and use of space is performed by Interstate council on space.

Article 2

Financing of maintenance costs and operation of objects of space infrastructure, including expenses on the social sphere of this infrastructure, it is performed at the expense of pro rata contributions of gosudarstvuchastnik of this agreement and means of Strategic Forces (UNKS) of the Commonwealth of Independent States, and also non-budgetary sources of financing.

Offers on amounts and the directions of financing for the specified purposes prepare by Strategic Forces (UNKS) of the Commonwealth of Independent States and after approval regarding the social sphere of regional authorities of the respective State Parties of this agreement are represented to Interstate council on space.

Interstate council on space considers these offers, determines the sizes of pro rata contributions taking into account the rent for land use based on legislations of each state and represents to Council of Heads of Government of the Commonwealth of Independent States of the offer on content and use of objects of space infrastructure.

Article 3

Content and operation of technological objects, and also objects of the social sphere of space infrastructure Strategic Forces (UNKS) of the Commonwealth of Independent States at the expense of means and according to the approved directions of financing perform, stipulated in Article 2 this agreements.

Changes of the amounts of financing of objects of the social sphere are approved with regional authorities of the respective State Parties of this agreement.

Article 4

Notifications about missiles launches of space appointment with use of objects and constructions of space infrastructure perform Strategic Forces (UNKS) of the Commonwealth of Independent States according to the procedure, approved between Strategic Forces (UNKS) of the Commonwealth of Independent States and the governments of the State Parties of this agreement.

Article 5

Compensation of the damage connected with violations of normal functioning of objects and constructions of space infrastructure and accomplishment of space programs is performed by responsible for damage to affected party in the sizes established by the special commission created on multilateral basis by the State Parties of this agreement under the auspices of Interstate council on space and which is guided regarding space activities by provisions of the Convention on the international damage liability, caused by space objects, of March 29, 1972.

Article 6

The State Parties of this agreement shall transfer and exchange the necessary information connected with all directions of space activities and which is of mutual interest in agreed volume and not to allow its leakage.

Article 7

This agreement becomes effective from the moment of its signing.

It is made on May 15, 1992 in one authentic copy in Russian.

The authentic copy is stored in Archive of the Government of the Republic of Belarus which will send to the states which signed this agreement, its verified copy.
