Usage agreement of airspace

of May 15, 1992

The State Parties of the Commonwealth of Independent States, hereinafter referred to as "State Parties", proceeding from complete and exclusive sovereignty of each State Party over the airspace located over the overland and water territory

in view of importance of questions of use of airspace, management and control of air traffic,

wishing to promote further development and strengthening of cooperation between Contracting States,

agreed as follows:

Article 1

The State Parties shall before creation of the relevant government institutions and adoption of regulations on use of airspace to be guided by requirements of the existing regulating documents for use and control of airspace which do not contradict the legislation of the State Parties.

Article 2

Bodies of the Single system of air traffic control and air defense in the territory of the State Parties are the main bodies for questions of management and control of use of airspace.

Plans of air traffic are approved with the ministries (committees) of defense of the State Parties in the territory of which use of airspace is planned.

Bodies of the Single system of air traffic control and air defense inform the ministries (committees) of defense of the State Parties in the territory of which there was violation on violations of procedure for use of airspace.

Article 3

To assign coordination of actions for approval of procedure for use of airspace and its control to the existing Main center of the Single system of air traffic control and the Central command post of Troops of air defense.

Article 4

The State Parties will perform coordinate activities when carrying out scientific developments, designing, production, acquisition and implementation of technical means and air traffic control systems, navigation, landings and bonds, including by creation of joint programs in the field of enhancement of use of airspace taking into account interests of Armed Forces of the states of the Commonwealth and other users airspace.

Article 5

The State Parties shall conduct on contractual conditions target training and retraining of specialists in the field of use of airspace and air traffic control by the approved techniques and programs.

Granted by them diplomas and certificates, and also other documents certifying the specialty and qualification of specialists including issued before entry into force of this agreement are recognized in the territories of the states of the Commonwealth.

Article 6

The State Parties during transition period till 1994 develop legal acts on use of airspace.

The State Parties recognize necessary by preparation of the legal acts regulating procedure for use of airspace and activities of aircraft to consider interests of Armed Forces of the Commonwealth and other users airspace.

Article 7

The State Parties will represent airspace over the territory for implementation of activities of Armed Forces of the Commonwealth and not to make the actions leading to violation or difficulty of their normal functioning.

Military aircrafts of the State Parties and the Joint Armed Forces of the Commonwealth perform flights in airspace of all states of the Commonwealth according to the special rules established together with the ministries (committees) of defense of the State Parties. Such rules shall not contradict the rules of flights of aircrafts existing in the territory of these states.

Article 8

The agreement becomes effective from the moment of its signing.

It is made in the city of Tashkent on May 15, 1992 in one authentic copy in Russian. The authentic copy is stored in Archive of the Government of the Republic of Belarus which will send to the states which signed this agreement, its verified copy.
