The agreement on procedure for use of radio-frequency range and ensuring electromagnetic compatibility of the major radio-electronic means for the benefit of safety of the Commonwealth of Independent States

of May 15, 1992

The State Parties of this agreement, hereinafter referred to as "State Parties",

based on article 7 of the Agreement on creation of the Commonwealth of Independent States and being guided by the agreements signed between the State Parties of the Commonwealth on defense questions

considering existing procedure for appointment and use of radio frequencies,

confirming the commitment to the principles and rules of international law in the field of use of radio-frequency range,

in view of need of safety and prevention of the human victims and unjustified material losses when carrying out especially important special works and actions,
agreed as follows:

Article 1

For the purposes of this agreement stated below terms mean:

1. "Radio-frequency range" - range of electromagnetic radiations (fluctuations) used for work of radio-electronic means (RES).

2. "Use of radio-frequency range" - activities of competent authorities for planning, appointment and use of radio frequencies.

3. "Electromagnetic compatibility" - capability of radio-electronic means to function at the same time under operating conditions with required quality and not to create radio interferences to other radio-electronic means.

4. "Ensuring electromagnetic compatibility of radio-electronic means" - set of the organizational and technical events held for the purpose of reduction or exception of hindrances between radio-electronic means.

5. "The major radio-electronic means" - the radio-electronic means relating to management systems by strategic nuclear forces, warnings of missile attack, control of space and control of spacecrafts to special systems of government communication, means of conducting investigation, means of special and civil purpose in wartime, and also the radio-electronic means which are on alert in peace time.

6. "Especially important special works and actions" - the works and actions connected with movements of Heads of States and Governments on the territory of the Commonwealth and also with carrying out testing of new samples of the equipment and arms, starts space and aircraft.

Article 2

The State Parties shall take all measures depending on them for exception of hindrances to work of the major radio-electronic means.

Article 3

The State Parties, considering important role of radio-electronic means in safety of the State Parties of the Commonwealth of Independent States, find it possible to provide to the Council of Ministers of Defense of the State Parties of the Commonwealth of Independent States the right (the paragraph in edition of the Decision on ensuring electromagnetic compatibility of the major radio-electronic means of the State Parties of the Commonwealth of Independent States of December 9, 1994):

carry out coordination of use of radio-frequency range between the Ministries of Defence of the State Parties of the Commonwealth (the paragraph to editions of the Decision on ensuring electromagnetic compatibility of the major radio-electronic means of the State Parties of the Commonwealth of Independent States of December 9, 1994);

perform development and approval of actions for ensuring electromagnetic compatibility of the major radio-electronic means of the State Parties of the Commonwealth (the paragraph in edition of the Decision on ensuring electromagnetic compatibility of the major radio-electronic means of the State Parties of the Commonwealth of Independent States of December 9, 1994);

perform in coordination with competent authorities of the State Parties of the Commonwealth introduction of temporary bans (restrictions) for use of radio-electronic means of military and civil appointment when carrying out especially important special works and actions, and in case of emergency for the purpose of safety of human lives, exception of unjustified material losses, urgent natural disaster response, catastrophic crashes and carrying out wrecking - the decision according to legislations of the State Parties of the Commonwealth and the immediate notification of their competent authorities.

Article 4

The ministries (departments, committees) of the State Parties of the Commonwealth perform accomplishment of actions for ensuring electromagnetic compatibility of the major radio-electronic means, bringing instructions for realization of these actions to contractors regarding them concerning and control accomplishment of the established conditions of use of radio-electronic means by the subordinate organizations.

Article 5

The State Parties in the activities for use of radio-frequency range and ensuring electromagnetic compatibility of the major radio-electronic means for the benefit of safety of the Commonwealth are guided by the agreements signed between the State Parties of the Commonwealth, decisions of Council of heads of states and other authorities of the Commonwealth on defense questions and also the regulations of the former USSR governing the relations in the field of use of the major radio-electronic means if they do not contradict the specified agreements and decisions.

Article 6

The agreement becomes effective from the moment of its signing.

It is made in the city of Tashkent on May 15, 1992 in one authentic copy in Russian. The authentic copy is stored in Archive of the Government of the Republic of Belarus which will send to the states which signed this agreement, its verified copy.
