About protection of ozone layer

This Law determines the legal basis of protection of ozone layer and is directed to prevention of destruction of ozone layer and its recovery for the purpose of protection of life and health of the person, the environment against the adverse effects caused by destruction of ozone layer as a result of impact of ozone-depleting substances and also to accomplishment of obligations according to international treaties of the Republic of Belarus in the field of protection of ozone layer.
For the purposes of this Law the following main terms and their determinations are used:
recovery of ozone-depleting substances – filtering, drying, distillation, chemical processing of ozone-depleting substances for the purpose of bringing their characteristics to compliance to requirements of technical regulatory legal acts, technical regulations of the Customs union and Eurasian Economic Union, obligatory for observance;
use of ozone-depleting substances – use of ozone-depleting substances in technical devices of vehicles, refrigeration equipment, air conditioning systems, systems, devices, fire extinguishing means, other equipment and technical devices, for operation, maintenance which repair according to technical characteristics ozone-depleting substances, and also as the frothers cleaning solvents, sterilizers are necessary for laboratory researches, disinfecting and cleaning of quarantinable objects, including quarantine products;
monitoring of ozone layer – system of observations of condition of ozone layer, assessment and the forecast of changes of condition of ozone layer under the influence of natural and anthropogenous factors;
neutralization of ozone-depleting substances – destruction of ozone-depleting substances by means of their transformation or decomposition on the components which are not making harmful effects on the environment including ozone layer;
the treatment of ozone-depleting substances – collection, storage, use, recirculation (recycling), recovery, neutralization, utilization, import, export of ozone-depleting substances and transactions with them, and also import, export of products containing ozone-depleting substances, and transactions with it;
amount of consumption of ozone-depleting substances – total quantity of the ozone-depleting substances imported into the Republic of Belarus for permanent placement in its territory less the ozone-depleting substances exported from the Republic of Belarus for permanent placement beyond its limits for certain period;
ozone-safe substances – chemicals, and also the mixes of chemicals which are not ozone-depleting substances and not making harmful effects on ozone layer;
ozone-safe technologies – technologies which use allows to exclude use of ozone-depleting substances and does not make harmful effects on ozone layer, and also reduces adverse effects of climate change;
ozone layer – the layer of atmospheric ozone located in stratosphere which absorbs solar biologically dangerous ultra-violet radiation;
ozone-depleting substances – chemicals, and also the mixes of chemicals having capability to react with ozone molecules in stratosphere and to destroy ozone layer, specified in appendix A, In, With, E to the Montreal protocol on the substances destroying ozone layer of September 16, 1987 (further – the Montreal protocol);
protection of ozone layer – system of measures for prevention of destruction of ozone layer and to its recovery for the purpose of protection of life and health of the person, the environment against the adverse effects caused by destruction of ozone layer as a result of impact of ozone-depleting substances, to accomplishment of regulations of the Vienna convention on protection of ozone layer of March 22, 1985 (further – the Vienna convention), the Montreal protocol and other acts of the legislation on protection of ozone layer;
recirculation (recycling) of ozone-depleting substances – primary purification of ozone-depleting substances for the purpose of their reuse performed in the venues of maintenance, repair of the equipment and technical devices containing ozone-depleting substances;
utilization of ozone-depleting substances – use of ozone-depleting substances as raw materials for production of other chemicals which are not ozone-depleting substances.
The relations in the field of protection of ozone layer are governed by this Law, the Vienna convention, the Montreal protocol, other acts of the legislation.
The relations arising in the course of the address with the waste containing the ozone-depleting substances which are not settled by this Law are regulated by the legislation on the address with waste.
The relations connected with protection of atmospheric air, arising in case of the treatment of ozone-depleting substances, not settled by this Law are regulated by the legislation on protection of atmospheric air.
The relations connected with import and (or) export of ozone-depleting substances and products containing them are regulated by this Law and other acts of the legislation on protection of ozone layer, the legislation on foreign economic activity, the legislation on customs regulation, the international treaties of the Republic of Belarus, international legal acts constituting the right of the Eurasian Economic Union.
If the international treaty of the Republic of Belarus establishes other rules, than those which contain in this Law then are applied rules of the international treaty.
The basic principles of protection of ozone layer are:
state regulation in the field of protection of ozone layer;
prevention of harmful effects on ozone layer, damnifications of life and to health of the person, environment;
reducing amounts of consumption of ozone-depleting substances and reducing (termination) their use according to international treaties of the Republic of Belarus;
implementation of ozone-safe technologies, and also processes of recirculation (recycling), recovery, neutralization and utilization of ozone-depleting substances;
permanent carrying out monitoring of ozone layer;
ensuring access according to legal acts to ecological information in the field of protection of ozone layer, including data on condition of ozone layer, impacts on it and measures for its protection;
responsibility for violation of the legislation on protection of ozone layer.
State regulation in the field of protection of ozone layer is performed the President of the Republic of Belarus, by Council of Ministers of the Republic of Belarus, the Ministry of Natural Resources and Environmental Protection, local councils of deputies, executive and administrative organs, other state bodies within their powers provided by this Law and other acts of the legislation.
