About protection of ozone layer

It is accepted by the House of Representatives on October 2, 2001

Approved by Council of the Republic on October 25, 2001

This Law establishes the legal basis of protection of ozone layer, the mode of the treatment of ozone-depleting substances and is directed to protection of life and health of the person, the environment against the adverse effects caused by destruction of ozone layer.

Article 1. The main terms used in this Law and their determinations

For the purposes of this Law the following main terms and their determinations are used:

recovery of ozone-depleting substances - processing of the recuperated ozone-depleting substances, including filtering, drying, distillation, chemical processing, for the purpose of recovery of their consumer properties to compliance to requirements of technical regulatory legal acts, technical regulations of the Customs union and Eurasian Economic Union, obligatory for observance;

hydrofluorocarbons - ozone-depleting substances, the fluorinated derivatives of saturated acyclic hydrocarbons which list is determined by Council of Ministers of the Republic of Belarus, and also their mix, the address of which is subject to regulation according to the Montreal protocol on the substances destroying ozone layer of September 16, 1987 (further - the Montreal protocol);

use of ozone-depleting substances - use of ozone-depleting substances in case of maintenance, repair of the equipment and technical devices for which according to technical characteristics ozone-depleting substances, and also as the frothers cleaning solvents, sterilizers are necessary for laboratory researches, disinfecting and cleaning of quarantinable objects, including quarantine products, fire extinguishing;

monitoring of ozone layer - system of observations of condition of ozone layer, assessment and the forecast of changes of condition of ozone layer under the influence of natural and anthropogenous factors;

neutralization of ozone-depleting substances - destruction of ozone-depleting substances (including the burning which is not connected with their use) by means of their transformation or decomposition on components which do not make harmful effects on ozone layer;

the treatment of ozone-depleting substances - use, transportation, storage, recuperation, recovery, recirculation (recycling), neutralization, import to the Republic of Belarus and (or) export from the Republic of Belarus of ozone-depleting substances, transactions with them;

ozone-safe technologies - technologies which use allows to exclude use of ozone-depleting substances and not to make harmful effects on ozone layer, and also reduces adverse effects of climate change;

ozone layer - part of stratosphere with the greatest content of ozone which absorbs solar ultra-violet radiation;

ozone-depleting substances - the chemicals halogenated (brominated, fluorinated, chlorinated) derivatives of hydrocarbons which list is determined by Council of Ministers of the Republic of Belarus, and also their mix, the address of which is subject to regulation according to the Montreal protocol;

protection of ozone layer - system of the measures directed to preserving and recovery of ozone layer, including reducing (termination) consumption and use of ozone-depleting substances, and also to fulfillment of requirements of the acts of the legislation on protection of ozone layer, the international treaties of the Republic of Belarus and international legal acts constituting the right of the Eurasian Economic Union, governing the relations in the field of protection of ozone layer, technical regulations of the Customs union and the Eurasian Economic Union for the purpose of protection of life and health of the person, the environment against the adverse effects caused by destruction of ozone layer;

potential of global warming of ozone-depleting substances - the coefficient determining extent of impact of ozone-depleting substances on global warming, established by the Montreal protocol;

consumption of ozone-depleting substances - amount of the ozone-depleting substances imported into the Republic of Belarus less amount of the ozone-depleting substances exported from the Republic of Belarus within calendar year;

recuperation of ozone-depleting substances - extraction, collection and storage of the ozone-depleting substances containing in the equipment, technical devices, reservoirs;

recirculation (recycling) of ozone-depleting substances - reuse of the recuperated ozone-depleting substances after their recovery.

Article 2. Legal regulation of the relations in the field of protection of ozone layer

The relations in the field of protection of ozone layer are governed by the legislation on protection of ozone layer, the Vienna convention on protection of ozone layer of March 22, 1985, the Montreal protocol, other international treaties of the Republic of Belarus and international legal acts constituting the right of the Eurasian Economic Union, technical regulations of the Customs union and Eurasian Economic Union.

The legislation on protection of ozone layer is based on the Constitution of the Republic of Belarus and consists of this Law and other acts of the legislation.

The relations arising in the course of the address with the waste containing the ozone-depleting substances which are not settled by this Law are regulated by the legislation on the address with waste.

The relations connected with protection of atmospheric air, arising in case of the treatment of ozone-depleting substances, not settled by this Law are regulated by the legislation on protection of atmospheric air.

The relations connected with import and (or) export of ozone-depleting substances and products containing them are regulated by this Law and other acts of the legislation on protection of ozone layer, the legislation on foreign economic activity, the legislation on customs regulation, the international treaties of the Republic of Belarus, international legal acts constituting the right of the Eurasian Economic Union.

If the international treaty of the Republic of Belarus establishes other rules, than those which contain in this Law then are applied rules of the international treaty.

Article 3. Basic principles of protection of ozone layer

The basic principles of protection of ozone layer are:

state regulation in the field of protection of ozone layer;

prevention of harmful effects on ozone layer, damnifications of life and to health of the person, environment;

reducing (termination) consumption and use of ozone-depleting substances;

implementation of ozone-safe technologies, and also processes of recuperation, recovery, recirculation (recycling) and neutralization of ozone-depleting substances;

permanent carrying out monitoring of ozone layer;

ensuring access according to legal acts to ecological information in the field of protection of ozone layer, including data on condition of ozone layer, impacts on it and measures for its protection;

responsibility for violation of the legislation on protection of ozone layer.
