About theaters and theatrical case
This Law governs the public relations in the field of theatrical case arising in connection with creation, public performance and public display of theatrical performances determines legal status of theaters, forms of their state support, procedure for their creation and activities and is directed to forming and satisfaction of creative requirements and interests of citizens, their esthetic education, preserving, development and enrichment of spiritual potential of the Ukrainian people.
In this Law the stated below terms are used in the following value:
theater - culture institution (the company, organization or the organization) or collective which activities are directed to creation, public performance and public display of works of theater;
theatrical case - complex of the actions directed to creation, public performance and public display of works of theater, their distribution and preserving, providing conditions for development of theatrical creativity, professional education, science, theatrical journalism, publishing activities on history, the theory and practice of theater, the related museum and archive activity;
theater - art form which feature is art display of life by means of scenic action of actors before the audience;
theatrical activities - the activities in the field of theaters and theatrical case connected with creation, public performance, public display, distribution and preserving works of theater, providing conditions for development of theatrical creativity, preparation of professional personnel, promotion of the best samples of theater;
subjects of theatrical activities - legal entities or physical persons, being participants of legal relationship in the field of theatrical activities;
theatrical performance - the work of theater created on the basis of the dramaturgic, musical and dramaturgic or literary work, having single intention and the specific name;
representation - public performance of theatrical performance;
the director (the production director, the art director, the set dresser, the costume designer, the artist all over the world, the ballet master-director, the conductor-director, the chorus master-director, others) - the physical person performing theatrical performance or its separate part on the basis of the independent art decision;
the theatrical producer - the legal entity or physical person providing financing, the organization of creation, public performance and (or) public display of theatrical performance, tour actions;
the repertoire of theater - set of works of theater which are performed publicly in theater during the certain period.
The legislation of Ukraine on theaters and theatrical case is based on the Constitution of Ukraine and consists of this Law, other regulatory legal acts adopted according to it.
The personal non-property and property rights of authors and their legal successors connected with creation and use of literary works and arts (copyright), the rights of contractors, producers of soundtracks and the organizations of broadcasting (related rights) it is regulated by the Law of Ukraine "About copyright and the related rights" and others normative and legal the act.
If the international treaty which consent to be bound is this the Verkhovna Rada of Ukraine establishes other rules, than stipulated by the legislation Ukraine about theaters and theatrical case, then rules of the international treaty are applied.
