of March 18, 2004 No. 1629-IV

About the Nation-wide program of adaptation of the legislation of Ukraine to the European Union law

(as amended on 02-10-2018)

The Verkhovna Rada of Ukraine decides:

1. Approve the Nation-wide program of adaptation of the legislation of Ukraine to the European Union law it (is applied).

2. To the Cabinet of Ministers of Ukraine:

1) to bring the regulatory legal acts into accord with this Law;

2) according to the competence to provide adoption of the regulatory legal acts provided by this Law;

3) to provide reduction by the ministries, other central executive bodies of their regulatory legal acts in compliance with this Law;

4) for the corresponding year to provide funds for financing of the Nation-wide program of adaptation of the legislation of Ukraine to the European Union law in drafts of the laws on the Government budget of Ukraine.

3. This Law becomes effective from the date of its publication.

Nation-wide program of adaptation of the legislation of Ukraine to the European Union law

Section I. General provisions

The nation-wide program of adaptation of the legislation of Ukraine to the European Union law (further - the Program) determines the mechanism of achievement of compliance by Ukraine to the third Copenhagen and Madrid criteria of acquisition of membership in the European Union. This mechanism includes the adaptation of the legislation, formation of the corresponding institutions and other additional measures necessary for effective right education and law enforcement.

The purpose of adaptation of the legislation of Ukraine to the European Union law is achievement of compliance of system of law of Ukraine of acquis communautaire taking into account the criteria pushed by the European Union (EU) to the states, intended to enter it.

Adaptation of the legislation of Ukraine to the legislation of the EU is priority compound integration of Ukraine of process into the European Union that in turn is the priority direction of the Ukrainian foreign policy.

Integral part of this Program is the List of acts of the legislation of Ukraine and acquis of the European Union in priority spheres of adaptation.

Section II. Determination of terms

Acquis communautaire (acquis) - system of law of the European Union, which includes the acts of the European Union law (but is not limited to them) accepted within the European community, General foreign policy and security policy and the Cooperation in the sphere of justice and internal affairs;

adaptation of the legislation - process of reduction of the laws of Ukraine and other regulatory legal acts in compliance with acquis communautaire.

Agreement on merge of 1965;

acts of accession of new state members;

secondary legislation:

directive;

regulations;

decision;

recommendation or conclusion;

source of law in the form of the international agreement;

joint strategy in the sphere of general foreign policy and security policy as it is determined by article 13 of the Agreement on the European Union;

collateral actions within general foreign policy and security policy;

common position in the sphere of general foreign policy and security policy;

the framework decision on harmonization of the legislation in the context of regulations of the Agreement on the European Union on cooperation of law enforcement and judicial authorities on criminal cases (article 34 of the Agreement on the European Union);

common position in the context of regulations of the Agreement on the European Union on cooperation of law enforcement and judicial authorities on criminal cases (article 34 of the Agreement on the European Union);

the decision in the context of regulations of the Agreement on the European Union on cooperation of law enforcement and judicial authorities on criminal cases (article 34 of the Agreement on the European Union);

the general provision or the principle in the sphere of general foreign policy and security policy.

Section III. State policy of Ukraine on adaptation of the legislation

State policy of Ukraine on adaptation of the legislation is created as component of legal reform in Ukraine and aimed at providing single approaches to normoproyektirovaniye, obligatory accounting of requirements of the European Union law in case of normoproyektirovaniye, training of qualified specialists, creation of proper conditions for institutional, scientific and educational, normoproyektny, technical, financial provision of process of adaptation of the legislation of Ukraine.

In Ukraine the basic political and legal and organizational principles of adaptation of the legislation are created.

In particular, the Partnership and Cooperation Agreement between Ukraine and the European communities and their state members of June 14, 1994 (further - Union of Right Forces) determines priority spheres of adaptation of the legislation.

General strategy concerning Ukraine approved by the European Council at the Helsinki summit on December 11, 1999 the European Union supported process of economic transformations in Ukraine and gradual approach of the legislation of Ukraine to the European Union law in certain priority spheres.

The strategy of integration of Ukraine into the European Union approved by the Presidential decree of Ukraine of June 11, 1998 No. 615, determines basic provisions of foreign policy strategy for integration of Ukraine into the European legal space, the purpose and stages of adaptation of the legislation.
