The government of the Russian Federation and the Government of the Kyrgyz Republic which are hereinafter referred to as with the Parties
considering historically developed scientific and technical bonds between the Russian Federation and the Kyrgyz Republic.
wishing to develop and strengthen cooperation between two countries in science and technology and by that to make contribution to economic and social development of both countries,
being guided by the Agreement on creation of general scientific and technological space of the State Parties of the CIS of November 3, 1995,
agreed as follows:
The parties will help sci-tech cooperation on the basis of the principles of equality and mutual advantage, creating for this purpose necessary organizational, legal and financial and economic conditions.
The cooperation within this agreement will be based on observance of the national legal system of each of the countries and the agreements signed between the Parties.
Can be initiators of carrying out joint scientific and technical operations the ministries and departments, the scientific organizations, the companies of different patterns of ownership, higher educational institutions, the scientific both countries.
Content of cooperation, its economic and organizational conditions will be approved by directly cooperating organizations of the Russian Federation and the Kyrgyz Republic on the basis of free standing agreements, agreements and contracts.
The cooperation will be performed in the following forms: carrying out mutual consultations concerning forming and realization of scientific and technical policy in both countries;
implementation of joint research programs and projects;
creation of the joint research organizations, forming of joint temporary research teams, and also the innovative companies providing development of the new equipment and technologies;
carrying out joint scientific operations in research establishments, industrial enterprises, higher educational institutions, technoparks of both countries; joint field surveys and expeditions;
mutual participation of scientists and specialists of each of the countries in the scientific and technical developments which are carried out in the countries;
holding joint seminars, scientific conferences, working meetings and exhibitions.
The cooperation can be performed also in other forms determined by approval between the Parties.
The parties will promote ensuring access of the scientific both countries to the unique and latest experimental equipment, and also cooperation in case of its development, production and acquisition.
The parties will promote creating favorable conditions of stay in the territories of both countries of scientists and specialists in case of accomplishment of joint surveys and developments, exchange of scientific devices, the equipment and scientific and technical documentation.
The parties will develop cooperation in the field of scientific and technical information, to promote exchange of scientific and technical and popular scientific literature.
For realization of cooperation the organizations, organizations, scientists, specialists and experts from the third countries and the international organizations can be invited.
When carrying out joint surveys and developments which results can make fully or partially the state secrets or with use of the data constituting the state secrets of one of the Parties, the Parties are guided by regulations of the multilateral agreement on mutual ensuring safety of interstate secrets from January 22, 1993.
For the purpose of coordination of joint surveys and developments, and also ensuring effective implementation of this agreement of the Party will create the Joint Russian-Kyrgyz commission on sci-tech cooperation (further hereinafter is referred to as - the Commission) headed by heads of the Ministry of Science and Technology of the Russian Federation and Committee on science and new technologies of the Ministry of Education, science and culture of the Kyrgyz Republic.
Within the Commission consultations concerning the state scientific and technical policy of both countries and its economic legal regulation will be held, and also approval of the priority directions of bilateral sci-tech cooperation will be performed.
The commission can use different organizational forms of sci-tech cooperation for the purpose of operational and effective implementation of the current work.
Commission sessions will be held at least once a year serially in the Russian Federation and in the Kyrgyz Republic.
The Commission will develop for the organization of the activities and will approve the relevant provision.
When implementing cooperation on the basis of this agreement of the Party provide protection of the rights to objects of industrial and intellectual property.
Questions of use of results of scientific research and other information obtained when implementing scientific research within joint programs and projects, and also the questions connected with patenting, copyright and other rights to objects of industrial and intellectual property according to the legislation existing in both countries will be approved in each case by the conclusion of the supplementary agreements provided in Article 3 of this agreement.
This agreement does not affect the rights and obligations of the Parties following from other international treaties signed by them.
This agreement becomes effective from the date of its signing and will be effective within five years after which every time will be prolonged for the next five-year term automatically provided that any of the Parties not later than six months before the expiration of the next period will not notify in writing other Party on the intention to terminate this agreement.
Cancellation of this agreement will not affect implementation of the projects realized according to it.
It is made in Bishkek on October 10, 1997 in duplicate, everyone in the Russian and Kyrgyz languages, and both texts are equally authoritative.
