Article 1. Determination of terms

In this Law terms are used in the following value:

the producer of disks for laser systems of reading, matrixes - the subject of managing fully or partially performing production of disks for laser systems of reading, matrixes;

production of disks - the activities connected using engineering procedure on conversion of raw materials in optical data carriers in the form of disk for laser systems of reading, matrixes during which along with production of disk record on it of information which is object of copyright and/or the related rights or without record, and also realization of disks or self-produced matrixes is performed;

disk for laser systems of reading - any optical disk for laser systems of reading with record or with possibility of record on it of information displaying objects of copyright or the related rights or without record of such information;

the paragraph the fifth is excluded according to the Law of Ukraine of 02.03.2015 No. 222-VIII;

the paragraph of the sixth is excluded according to the Law of Ukraine of 02.03.2015 No. 222-VIII;

the export certificate (import) - properly drawn up right to export (import) of the equipment and raw materials for production of disks for laser systems of reading and matrixes which is issued for implementation of the external economic transaction by specific business entity during fixed term;

raw materials - the optical polycarbonate used in production of disks for laser systems of reading and matrixes

the paragraph the ninth is excluded according to the Law of Ukraine of 02.03.2015 No. 222-VIII;

the paragraph the tenth is excluded according to the Law of Ukraine of 02.03.2015 No. 222-VIII;

matrix - the material carrier in the form of stamp or other similar or equivalent device which contains information in digital form and is used for direct transferring of this information on disk for laser systems of reading in case of its production;

illicit trafficking in disks for laser systems of reading, matrixes, the equipment and raw materials for their production - production, export, import, storage, realization, movement of the territories of Ukraine of disks for the laser systems of reading, matrixes, the equipment and raw materials for their production which are not conforming to requirements of this Law;

special identification code - code which determines the producer of these disks and is appropriated by the central executive body which provides forming and realizes state policy in the field of intellectual property.

Article 2. Coverage of this Law and the legislation on production, export, import of disks for laser systems of reading, matrixes

Operation of this Law extends to the subjects of managing performing production, export, import of disks for laser systems of reading, matrixes and also export, import of the equipment and the raw materials for their production specified in article 5 of this Law.

The relations in the field of production, export, import of disks for laser systems of reading, matrixes, export, import of the equipment and raw materials for their production are regulated by the Constitution of Ukraine, the laws of Ukraine "About copyright and the related rights", this Law, other laws of Ukraine in the part which is not contradicting this Law and also international treaties of Ukraine which became effective in the procedure established by the law. If regulations of this Law contradict rules of the international treaty of Ukraine which consent to be bound is this the Verkhovna Rada of Ukraine, rules of the international treaty are applied.

Operation of this Law does not extend to the disks for laser systems of reading which are not objects of export/import, which:

are imported or exported, sent in international post and express departures by physical persons in the quantity which is not exceeding twenty copies;

are imported or exported, sent in international post and express departures by legal entities for ensuring economic activity without the right or not for the purpose of further sale or distribution;

are imported or exported with technical documentation as a part of the equipment.

Article 3. Regulation of production of disks for laser systems of reading, matrixes

1. It is excluded according to the Law of Ukraine of 02.03.2015 No. 222-VIII.

2. The central executive body which provides forming and realizes state policy in the field of intellectual property assigns for the applicant (producer) special identification code.

3. The producer of disks provides to the central executive body which provides forming and realizes state policy in the field of intellectual property, documentary confirmed data about:

own or leased production equipment (name and number of lines);

own or leased production and storage facilities.

4. It is excluded according to the Law of Ukraine of 02.03.2015 No. 222-VIII.

Article 4. Requirements to activities for production of disks for laser systems of reading, matrixes

1. The producer of disks for laser systems of reading, matrixes shall:

a) make disks only on the certified equipment;

b) put down on each made disk for laser systems of reading with data recording - special identification code according to this Law; and on each made disk for laser systems of reading without data recording - code of compression mold with which it was made;

c) to technologically provide drawing on disks for laser systems of reading of special identification code;

d) it is excluded;

e) make the disks for laser systems of reading containing objects of copyright and/or the related rights only in the presence of permission of persons who belong copyright or the related rights;

e) record production volumes of disks for laser systems of reading, matrixes, and also acquisition, storage, use of raw materials for their production;
