About prohibition on carrying out continuous cabins in the mountain fir and beechen woods of the Carpathian region

This Law establishes prohibition on carrying out continuous cabins in mountain fir and beechen forest stands, continuous cabins of the main use and any other continuous cabins in the mountain woods, in the woods in avalanche and mudflow pools and in bank protection sites of the wood in the Carpathian region of Ukraine, except development of continuous windbreaks and windbreaks, and also entirely struck with wreckers and diseases of plantings.

Section I. General provisions

Article 1. Determination of terms

In this Law terms are used in such value:

bank protection sites - wood strips along coast of the rivers, around lakes, water storage basins, other water objects;

selective cabins - cabins in case of which part of trees is periodically cut down (in case of this method of cabins the site constantly remains covered with forest vegetation);

the mountain woods of the Carpathian region - the woods of the Transcarpathian, Lviv, Ivano-Frankivsk and Chernivtsi regions located within the mountain system;

gentle slopes - slopes the steepness to 11 degrees;

gradual (regular gradual, group and gradual) cabins - cabins in case of which cutting down of forest stand for several acceptances is supposed;

cabins of forming and improvement of the woods - the forestry and landscape actions directed to increase in stability and productivity of forest stands, their improvement and strengthening of protective, sanitary and hygienic, improving and other functions by carrying out cabins;

flat slopes - slopes the steepness of 11-20 degrees;

steep slopes - slopes the steepness of 21-30 degrees by the southern and 21-35 degrees on northern slopes;

continuous cabins - cabins in case of which cutting down of forest stand at one time, except the last action of the gradual cabin is supposed;

fir and beechen forest stands - the beechen woods with impurity only firs as a part of at least 25 percent.

Section II. Restrictions of some systems and types of cabins and control of observance of prohibition of cabins

Article 2. Introduction of prohibition on any continuous cabins of the main use and continuous cabins of forming and improvement of the woods

For the purpose of preserving useful properties of the woods and ensuring prevention of manifestations of pernicious effects of the natural phenomena in the Carpathian region the prohibition on carrying out continuous cabins of the main use and continuous cabins of forming and improvement of the woods, except development of continuous windbreaks and windbreaks, and also entirely struck with wreckers and diseases of plantings is established:

in the mountain woods, the located higher than 1100 meters above sea level;

in the woods in avalanche pools (wood strips on its upper bound depending on length of woodless slope);

in the woods in mudflow pools (all woods in zones of forming of mudflows which are established by national hydrometeorological service);

in bank protection sites of the wood.

Article 3. Restrictions of separate systems and types of cabins of mountain fir and beechen forest stands on steep slopes

On steep slopes in the mountain fir-tree and beechen woods of the Carpathian region only selective cabins of the main use and selective cabins of forming and improvement of the woods are permitted.

Article 4. Restriction of cabins on gentle and sloping slopes 

On gentle and sloping slopes in mountain fir and beechen forest stands only gradual and selective cabins are carried out.

Article 5.

Article 5 is excluded according to the Law of Ukraine of 30.10.2019 No. 249-IX.

Article 6. Restriction of separate types and systems of cabins in strips of withdrawal of channels, hydraulic engineering and other constructions of intereconomic value

On sites with artificially created afforestations and the natural woods in strips of withdrawal of channels, hydraulic engineering constructions and other constructions of intereconomic value only selective cabins of leaving and sanitary cabins which are carried out according to recommendations of bodies of forestry are allowed.

The users operating such channels and constructions in coordination with bodies of the state forest protection without fail perform afforestation, leaving and forest conservation in strips of withdrawal of channels, hydraulic engineering constructions and other constructions of intereconomic value.

Article 7. Ecological and production requirements on placement of cutting areas

For the purpose of non-admission of development of erosive processes, preserving and reproduction of forest fund, creating favorable conditions for forest management carrying out cabins is performed only on condition of observance of ecological and production requirements.

Placement of cutting areas of strip cabins is allowed only in length across, and on the crossed relief - in parallel to waterways. Along slope the cutting area can be placed only in exceptional cases in coordination with the central executive body realizing state policy in the field of protection of the surrounding environment in the absence of danger of emergence of erosive processes and use of suspended mechanisms for hauling.

Placement of cutting areas shall be made taking into account arrangement of the existing ways of transportation and relief and hydrological conditions of the territory. Along slope the cutting area is placed on condition of lack of danger of emergence of erosive processes and use at the same time of rope lesotransportny installations and systems of air transportation of wood.

Article 8. Control of observance of prohibition on cabins

The central executive body realizing state policy on implementation of the state supervision (control) in the field of protection of the surrounding environment, rational use, reconstruction and protection of natural resources, the central executive body realizing state policy in the field of forest and hunting economy provide constant control behind fulfillment of requirements of ecologically safe and balanced forest management, observance of the moratorium and restriction of cabins according to the requirements provided by articles 2-6 of this Law.

Section III. Implementation of environmentally safe technologies. Expansion of network of the reserved territories

Article 9. Environmentally safe requirements for procurement and export of wood

Procurement and export of wood in the mountain woods of the Carpathian region are carried out mainly with use of environmentally safe systems of the machines and mechanisms and animal traction providing admissible impact on the environment, and also with preserving the existing narrow-gage forest railroads and optimization of network of forest highways.

Expand till 2030 network of forest highways with hard surface in the region woods to 10 kilometers on 1000 hectares.
