About approval of the Procedure for purpose of pensions at the expense of means of the companies and the organizations to separate employee categories by results of certification of workplaces under the terms of work

According to Item 2-2 of the Section XV "Final provisions" of the Law of Ukraine "About obligatory national pension insurance" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for purpose of pensions at the expense of means of the companies and the organizations to separate employee categories by results of certification of workplaces under the terms of work which is applied.

2. This resolution becomes effective from the date of publication.

Procedure for purpose of pensions at the expense of means of the companies and the organizations to separate employee categories by results of certification of workplaces under the terms of work

1. This Procedure determines the mechanism of purpose of pensions to separate employee categories which by results of certification of workplaces work (worked) in conditions which grant the right to award of pension on age on favorable terms (further - preferential pension).

2. Preferential pensions can be granted at the expense of means of the companies and the organizations (except financed or subsidized from the budget) according to the Law of Ukraine "About obligatory national pension insurance" to workers who work (worked) at productions, works, by professions and at the positions which are not provided by the lists of productions, works, professions, positions and indicators in which employment grants pension entitlement on age on favorable terms approved by the resolution of the Cabinet of Ministers of Ukraine of June 24, 2016 No. 461 (The Official Bulletin of Ukraine, 2016, No. 60, the Art. 2044):

1) to men - in case of length of service at least 30 years, from them at least 12 years 6 months of the length of service granting the right to award of pension on favorable terms at that company, in that organization at the expense of which pension is granted.

In the absence of the length of service established by paragraph one of this subitem during the period till April 1, 2024 the old-age pension on favorable terms is granted in the presence of length of service:

from April 1, 2015 to March 31, 2016 - at least 25 years 6 months;

from April 1, 2016 to March 31, 2017 - at least 26 years;

from April 1, 2017 to March 31, 2018 - at least 26 years 6 months;

from April 1, 2018 to March 31, 2019 - at least 27 years;

from April 1, 2019 to March 31, 2020 - at least 27 years 6 months;

from April 1, 2020 to March 31, 2021 - at least 28 years;

from April 1, 2021 to March 31, 2022 - at least 28 years 6 months;

from April 1, 2022 to March 31, 2023 - at least 29 years;

from April 1, 2023 to March 31, 2024 - at least 29 years 6 months;

2) to women - in case of length of service at least 25 years, from them at least 10 years of the length of service granting the right to award of pension on favorable terms at that company, in that organization at the expense of which pension is granted.

In the absence of the length of service established by paragraph one of this subitem during the period till April 1, 2024 the old-age pension on favorable terms is granted in the presence of length of service:

from April 1, 2015 to March 31, 2016 - at least 20 years 6 months;

from April 1, 2016 to March 31, 2017 - at least 21 years;

from April 1, 2017 to March 31, 2018 - at least 21 years 6 months;

from April 1, 2018 to March 31, 2019 - at least 22 years;

from April 1, 2019 to March 31, 2020 - at least 22 years 6 months;

from April 1, 2020 to March 31, 2021 - at least 23 years;

from April 1, 2021 to March 31, 2022 - at least 23 years 6 months;

from April 1, 2022 to March 31, 2023 - at least 24 years;

from April 1, 2023 to March 31, 2024 - at least 24 years 6 months.

3. In the presence of at least a half of the length of service granting the right to purpose of preferential pension, the retirement age decreases according to the procedure, provided by paragraphs the twenty fourth - the twenty seventh Item 2 parts two of article 114 of the Law of Ukraine "About obligatory national pension insurance".

The transfer mechanism in length of service which grants the right to purpose of preferential pension, other periods which according to the legislation are enlisted in length of service which grants the right to award of pension on age on favorable terms is determined in the collective agreement (agreement).

4. Preferential pension is granted in case of achievement of the age provided by paragraph one of Item 2-2 of the Section XV "Final provisions" of the Law of Ukraine "About obligatory national pension insurance".

5. Certification of workplaces under the terms of work is carried out according to the Procedure for carrying out certification of workplaces under the terms of work approved by the resolution of the Cabinet of Ministers of Ukraine of August 1, 1992 No. 442 (the joint venture of Ukraine, 1992, No. 9, the Art. 211).

6. The decision on purpose of preferential pension is made by board of the Pension fund of Ukraine in the area, the city and the area in the city (further body which grants pension) in the location of the company, organization based on documents which go according to the procedure, established by board of the Pension fund of Ukraine in coordination with Minsotspolitiki, and the guaranty letter of the company or the organization about money transfer into the account of noted management for covering of the expenses connected with pension payment.

7. Payment of preferential pension is performed after receipt in full of means from the company, the organization in body which grants pension, in the terms provided by the Law of Ukraine "About obligatory national pension insurance".

Money transfer by the company, organization is performed by day of achievement by the person of retirement age, stipulated in Article 26 noted the Law.

8. Funds for payment of preferential pension and the expenses connected with delivery of pensions are listed by the company, the organization according to the procedure and the terms determined by board of the Pension fund of Ukraine.

Matters of argument concerning money transfer for payment and delivery of preferential pension are solved according to the legislation.
