Chapter I. General provisions

Article 1. Subject of regulation and purpose of this Federal Law

This Federal Law according to the conventional principles and rules of international law governs the relations in system of compulsory social insurance, determines legal status of subjects of compulsory social insurance, the basis of origin and procedure of their rights and obligations, responsibility of subjects of compulsory social insurance, and also establishes bases of state regulation of compulsory social insurance.

Compulsory social insurance - part of the state system of social protection of the population which specifics is the insurance of the working citizens upon possible change of financial and (or) social position performed according to the Federal Law, including owing to circumstances.

Compulsory social insurance represents system of the legal, economic and organizational measures created by the state directed to compensation or minimization of consequences of change of financial and (or) social position of the working citizens, and in cases, stipulated by the legislation the Russian Federation, other categories of citizens owing to achievement of retirement age, approach of disability, loss of the supporter, disease, injury, labor accident or occupational disease, pregnancy and childbirth, the birth of child(children), child care aged up to one and a half years and other events established by the legislation of the Russian Federation on compulsory social insurance.

Operation of this Federal Law extends also to persons who are independently providing themselves with work and to other categories of citizens if the legislation of the Russian Federation provides payment by them or for them insurance premiums for compulsory social insurance (further also - insurance premiums).

The procedure for compulsory social insurance of unemployed citizens is determined by the Federal Laws on specific types of compulsory social insurance.

Operation of this Federal Law does not extend to the compulsory national insurance regulated by the special legislation of the Russian Federation.

Article 2. Legislation of the Russian Federation on compulsory social insurance

The legislation of the Russian Federation on compulsory social insurance consists of this Federal Law, other Federal Laws and other regulatory legal acts of the Russian Federation, and also the laws and regulatory legal acts of subjects of the Russian Federation accepted according to them.

Article 3. The basic concepts and terms used in this Federal Law

For the purposes of this Federal Law the following concepts and terms are used:

insurance premium - obligatory payment on compulsory social insurance;

rate of insurance premium - the rate of insurance premium established on specific type of compulsory social insurance from accrued benefits and other remunerations for benefit of insured persons;

social insurance risk - expected event in case of which approach compulsory social insurance is performed;

insured event - accomplished fact with which approach there is obligation of the insurer, and in some cases, established by the Federal Laws, - as well the insurer to perform providing on compulsory social insurance;

providing on compulsory social insurance (further - insurance coverage) - execution by the insurer, and in some cases, established by the Federal Laws, - as well the insurer of the obligations to insured person in case of loss occurrence by means of the insurance payments or other types of providing established by the Federal Laws on specific types of compulsory social insurance;

insurance years of service - the total duration of time of payment of insurance premiums;

means of compulsory social insurance - money and property which are in operational management of the insurer of specific types of compulsory social insurance.

Article 4. Basic principles of implementation of compulsory social insurance

The basic principles of implementation of compulsory social insurance are:

the stability of financial system of compulsory social insurance provided on the basis of equivalence of insurance coverage to means of compulsory social insurance;

general binding character of social insurance, availability to insured persons of realization of the social guarantees;
