About participation of Ukraine in the international peace support operations and safety

Understanding the responsibility in maintenance of international peace and safety, considering obligations of Ukraine as state member of the United Nations (further - the UN) to give help of the UN in the actions which are carried out according to the Charter of the UN, and also the obligation as state member of Organization for Security and Cooperation in Europe (further-) it is constructive to OSCE to cooperate in use of all range of opportunities of OSCE for the prevention of the conflicts and for their decision adhering to the main directions of state policy concerning participation of Ukraine in enhancement and development all-European and the international systems of collective security, and also within constructive partnership with the North Atlantic Treaty Organization (further - NATO) and other international organizations in the field of safety, Ukraine considers participation in the international peacekeeping transactions as important component of the foreign policy.

This Law determines legal, organizational and financial basis of participation of Ukraine in the international peacekeeping transactions, and also procedure for the direction by Ukraine of military and civil personnel, the organization of its preparation and providing.

Article 1. Determination of terms

In this Law terms are used in the following value:

international peace support operation and safety - the international actions or actions performed according to decisions of the UN Security Council according to Articles of organization of the United Nations, OSCE, other international organizations which bear responsibility in the field of maintenance of international peace and safety, according to provisions of Chapter VIII of the Charter of the UN, and equally in action and event of the multinational forces created with the consent of the UN Security Council which are held under general control of the UN Security Council for the purpose of:

the international peace support operations and safety - the international actions or actions directed to accomplishment of peacekeeping or humanitarian tasks which are performed according to decisions of the UN Security Council according to Articles of organization of the United Nations, OSCE, other international organizations which bear responsibility in the field of maintenance of international peace and safety, according to provisions of Chapter VIII of the Charter of the UN, and also actions and events of multinational forces, multinational military forming of high readiness which are held under general control of the UN Security Council on purpose;

settlements or creations of conditions for settlement of the interstate, and also internal conflicts with the consent of parties of the conflict or with use of enforcement powers according to the decision of the UN Security Council that can include, in particular, observation and control of observance of Cease-Fire Agreements and other hostile actions, separation of conflicting parties, disarmament and disbandment of their divisions, accomplishment of engineering and other works;

humanitarian assistance to the population injured with the interstate or internal conflicts;

fight against the international terrorism and piracy;

evacuations of the population from conflict zone;

mitigations of consequences of emergency situations of natural and technogenic nature;

accomplishment of police functions on safety and respect for human rights;

assistance in overcoming effects of the conflicts;

elimination of threat to peace, violations of the world or act of aggression and restoration of peace;

the national contingent - the military divisions equipped with the corresponding arms and military equipment, means of support and communication, directed by Ukraine for participation in international peace support operation and safety, including military divisions of the Armed Forces of Ukraine, other military forming which are part of the joint military divisions created together with other states for participation in international peace support operation and safety (joint battalions, etc.);

national personnel - certain military personnel of the Armed Forces of Ukraine, other military forming, police officers, faces of the commanding and ordinary structure of state bodies which can be equipped with fire (shooting) weapon and ammunition to it according to offers of the international organizations in the field of safety and also employees of the Armed Forces of Ukraine, other military forming, state bodies and organizations of Ukraine directed by Ukraine for participation in the international peace support operations and safety also are not part of the national contingent;

material resources and services - material resources and the services provided by Ukraine for use in international peace support operation and safety including as a part of multinational military forming of high readiness the military and special equipment, separate types of arms, means of communication, vehicles with crews, food, medicines, etc.

multinational military forming of high readiness - military forming with high degree of readiness which consists of forces and means of armed forces of state members and/or the states - partners of relevant international organization and is created in pursuance of decisions of the UN Security Council, North Atlantic Council of NATO, Council of the European Union, other international organizations, and also within international treaties of Ukraine for the purpose of attraction to task performance to destination;

operational watch - stay of certain forces and means of the Armed Forces of Ukraine in the corresponding ready state to task performance to destination

Article 2. Conditions of participation of Ukraine in international peace support operation and safety

Ukraine only on the conditions specified takes part in the decision of the President of Ukraine which is approved by the Verkhovna Rada of Ukraine in the cases provided by the Constitution and the laws of Ukraine, and according to the procedure established by this Law in international peace support operation and safety:

United Nations Organizations which decision on carrying out is made by the UN Security Council;

Organization For Security and Cooperation in Europe or other international organizations which bear responsibility in the field of maintenance of international peace and safety according to provisions of Chapter VIII of the Charter of the UN;

the multinational forces created with the consent of the UN Security Council which actions and actions are performed under general control of the UN Security Council.

multinational military forming of high readiness.

Participation of Ukraine in international peace support operation and safety is performed by provision of the national contingent, national personnel, and also material resources and services in the order of relevant organs which are determined by the decision on carrying out such transaction.
