About the National Security and Defense Council of Ukraine

Section I. General provisions

Article 1. National Security and Defense Council of Ukraine

The National Security and Defense Council of Ukraine according to the Constitution of Ukraine is coordinating body on national security issues and defenses in case of the President of Ukraine.

Article 2. Legal basis of activities of the National Security and Defense Council of Ukraine

The National Security and Defense Council of Ukraine is guided in the activities by the Constitution and the laws of Ukraine, international treaties which consent to be bound is provided by the Verkhovna Rada of Ukraine, acts of the President of Ukraine.

The procedure for functioning of the National Security and Defense Council of Ukraine is established by this Law.

Section II. Functions and competence of the National Security and Defense Council of Ukraine

Article 3. Functions of the National Security and Defense Council of Ukraine

Functions of the National Security and Defense Council of Ukraine are:

1) introduction of offers to the President of Ukraine on realization of fundamentals of domestic and foreign policy in the field of homeland security and defense;

2) coordination and control of activities of executive bodies in the field of homeland security and defense in peace time;

3) coordination and control of activities of executive bodies in the field of homeland security and defense in the conditions of warlike or emergency state and in case of the crisis situations menacing to homeland security of Ukraine.

Article 4. Competence of the National Security and Defense Council of Ukraine

According to the functions determined by the Constitution of Ukraine, this Law and other laws, the National Security and Defense Council of Ukraine:

Develops 1) and considers at the meetings questions which according to the Constitution and the laws of Ukraine, the Strategy of homeland security of Ukraine, the Military doctrine of Ukraine belong to the sphere of homeland security and defense, and submits proposals to the President of Ukraine, makes the decision relatively:

to determination of strategic national interests of Ukraine, conceptual approaches and the directions of ensuring national security and defense in political, economic, social, military, scientific and technological, ecological, information and other spheres;

to drafts of state programs, doctrines, the laws of Ukraine, presidential decrees of Ukraine, directives of the Supreme Commander of the Armed Forces of Ukraine, international treaties, other regulations and documents on national security issues and defenses;

to enhancement of system of ensuring national security and the organization of defense, education, reorganization and liquidation of executive bodies in this sphere;

to the bill of Ukraine on the Government budget of Ukraine and offers to the Budget declaration on Articles connected with ensuring national security and defense of Ukraine;

to material, financial, personnel, organizational and other security of accomplishment of measures for national security issues and defenses;

to measures of political, economic, social, military, scientific and technological, ecological, information and other nature according to the scale of potential and real hazards to national interests of Ukraine;

to the orders connected with studying of specific questions and implementation of the corresponding researches in the field of homeland security and defense, to executive bodies and scientific institutions of Ukraine;

to involvement of the regulatory, inspection and supervisory authorities functioning in system of the executive authority, for control of timeliness and workmanship accepted by the National Security and Defense Council of Ukraine of the decisions enacted by presidential decrees of Ukraine;

to providing and control of receipt and processing of necessary information, its preserving, confidentiality and use for the benefit of homeland security of Ukraine, to the analysis on its basis of condition and tendencies of succession of events occurring in Ukraine and in the world, to determination of potential and real hazards to national interests of Ukraine;

to questions of the announcement of state of war, general or partial mobilization, introduction of warlike or emergency state in Ukraine or its certain areas, announcements in case of need certain areas of Ukraine zones of emergency ecological situation;

urgent measures for the solution of the crisis situations menacing to homeland security of Ukraine;

need of compulsory acquisition or withdrawal of personal estate which is used or it can be used for ensuring activities of the companies of defense industry complex of Ukraine and concerning which there is risk of interruption of its functioning in connection with stay of such property in the territory of administrative and territorial unit of Ukraine concerning which there is threat of its temporary occupation and which border no more than 30 kilometers from the area of conducting military (fighting) operations or from temporarily occupied territory are located at distance;

2) is coordinated by accomplishment of the decisions accepted by the National Security and Defense Council of Ukraine enacted by presidential decrees of Ukraine and exercises the current control of activities of executive bodies in the field of homeland security and defense, submits to the President of Ukraine the corresponding conclusions and proposals;

Involves 3) in information analysis of officials and specialists of executive bodies, public institutions, scientific institutions, companies and organizations of all patterns of ownership;

4) initiates development of regulations and documents on national security issues and defenses, generalizes practice of their application and results of checks of their execution;

Coordinates 5) and controls transfer central and local executive bodies, and also national economy for work in the conditions of warlike or emergency state;

Coordinates 6) and controls activities of local government bodies within the conferred powers in case of introduction of warlike or emergency state;

Coordinates 7) and controls activities of executive bodies for reflection of the armed aggression, the organizations of protection of the population and to ensuring its life activity, protection of life, health, constitutional rights, freedoms and legitimate interests of citizens, maintenance of public order in the conditions of warlike and emergency state and in case of the crisis situations menacing to homeland security of Ukraine;

8) coordinates and controls activities of executive bodies for anti-corruption, ensuring public safety and fight against crime for national security issues and defenses;
