Chapter 1. General provisions

Article 1. Subject of regulation of this Federal Law

1. This Federal Law governs the relations arising in connection with implementation of cadastral activities, activities of self-regulatory organizations of cadastral engineers, national merging of self-regulatory organizations of cadastral engineers (further - the cadastral relations).

4. Cadastral activities are performance of works concerning real estate according to the requirements established by the Federal Law as a result of which preparation of the documents containing necessary for implementation of the state cadastral registration of real estate (further - the cadastral registration) data on such real estate is provided (further - cadastral works), and rendering services in the cases established by the Federal Law. Person specified in article 29 of this Federal Law has special rights to implementation of cadastral activities (further - the cadastral engineer).

4.1. Cadastral works are performed concerning the parcels of land, buildings, constructions, rooms, objects of construction in progress (further also - real estate objects), parts of the parcels of land, buildings, constructions, rooms, and also other real estate objects which are subject according to the Federal Law to the cadastral registration.

4.2. In case of accomplishment of cadastral works as cadastral engineers coordinates of characteristic points of borders of the parcel of land (part of the parcel of land), coordinates of characteristic points of contour of the building, construction, parts of such real estate objects, coordinates of characteristic points of contour of object of construction in progress are determined, processing of results of determination of such coordinates during which the area of objects of the real estate is determined is performed and the description of location of real estate objects is performed, coordination of location of borders of the parcel of land is carried out. In the case established by this Federal Law in case of accomplishment of cadastral works as cadastral engineers location of the building, construction or object of construction in progress on the parcel of land by means of the spatial description of structural elements of the building, construction or object of construction in progress, including taking into account height or depth of such structural elements can be in addition established.

Article 2. Legal basis of regulation of the cadastral relations

The legal basis of regulation of the cadastral relations is constituted by this Federal Law, other Federal Laws and other regulatory legal acts of the Russian Federation published according to them.

Article 3.2. The body exercising federal state supervision of activities of self-regulatory organizations of cadastral engineers, national merging of self-regulatory organizations of cadastral engineers and maintaining the state register of self-regulatory organizations of cadastral engineers, the state register of cadastral engineers

Federal state supervision of activities of self-regulatory organizations of cadastral engineers, national merging of self-regulatory organizations of cadastral engineers (further - federal state supervision) and maintaining the state register of self-regulatory organizations of cadastral engineers, maintaining the state register of cadastral engineers are performed by the federal executive body authorized by the Government of the Russian Federation (further - body of federal state supervision).

Chapter 2. Maintaining State Immovable Property Cadastre

Article 7. The scope of information of the State Immovable Property Cadastre about real estate object

1. In the State Immovable Property Cadastre the following data on unique characteristics of real estate object are entered:

1) real estate object type (parcel of land, building, construction, room, object of construction in progress);

2) cadastral number and date of entering of this cadastral number into the State Immovable Property Cadastre;

3) the description of location of borders of real estate object in volume of the data determined by procedure for maintaining the State Immovable Property Cadastre if real estate object is the parcel of land;

4) the description of location of real estate object on the parcel of land in volume of the data determined by procedure for maintaining the State Immovable Property Cadastre if real estate object is the building, construction or object of construction in progress;

5) cadastral number of the building or construction in which the room is located, number of the floor on which this room is located (with number of storeys), the description of location of this room within this floor, or within the building or construction, or the corresponding part of the building or construction if real estate object is the room;

6) the area determined taking into account the requirements established according to this Federal Law if real estate object is the parcel of land, the building or the room.

2. In the State Immovable Property Cadastre also following additional data on real estate object are entered:

1) earlier assigned state accounting number (cadastral, accession or conditional number) if such number was assigned before assignment according to this Federal Law of cadastral number, and date of assignment of such number, data on the organization or body which assigned such number in the procedure established by the legislation;

2) cadastral number of real estate object, as a result of which Section, from which apportionment, which reconstruction or other action corresponding to the legislation of the Russian Federation with which (daleepreobrazuyemy real estate object) other real estate object was formed (further - formation of real estate object);

3) cadastral number of the real estate object formed of this real estate object;

4) cadastral number of the parcel of land within which are located the building, construction or object of construction in progress if real estate object is the building, construction or object of construction in progress;

5) cadastral numbers of the buildings located within the parcel of land, constructions, objects of construction in progress if real estate object is the parcel of land;

5. 1) cadastral numbers of the rooms located in the building or construction if real estate object is the building or construction;

5. 2) number of cadastral quarter in which there is real estate object;

6) cadastral number of the apartment in which the room is located if real estate object is the room;

7) the address of real estate object or in the absence of such address the description of location of real estate object (the subject of the Russian Federation, the municipality, the settlement and so forth);

8) data on the corporeal rights to real estate object in volume of the data determined by procedure for maintaining the State Immovable Property Cadastre if the specified rights are not registered in the Unified State Register of Rights on real estate and transactions with it;

9) data on restrictions (encumbrances) of the corporeal rights to real estate object, including the description of part of real estate object if such restrictions (encumbrances) extend to part of real estate object, in volume of the data determined by procedure for maintaining the State Immovable Property Cadastre;

10)  Item 10 of Article 7 ceased to be valid according to the Federal Law of the Russian Federation of 23.07.2013 No. 250-FZ

11) data on the cadastral project cost of the real estate in volume of the data determined by procedure for maintaining the State Immovable Property Cadastre;

12) data on the woods, water objects and on other natural objects located within the parcel of land if real estate object is the parcel of land;

13) category of lands to which the parcel of land is referred if real estate object is the parcel of land;

14) the permitted use if real estate object is the parcel of land;

14. 1) mark about the adoption of the act and (or) the conclusion of the agreement providing according to the land legislation executive body of the government or local government body of the parcel of land which is in the state-owned or municipal property for construction of the hired house of social use or the hired house of commercial use or for development of the territory for the purpose of construction and operation of the hired house of social use or for development of the territory for the purpose of construction and operation of the hired house of commercial use or mark about the decision of the owner of the parcel of land which is in private property, on construction in such parcel of land of the hired house of social use or the hired house of commercial use or about the contract of the specified owner of the parcel of land with public authority, local government body or the other person, provided to the specified owner according to the housing legislation the state, municipal and (or) other support for creation, operation of the hired house of social use on such parcel of land if real estate object is the parcel of land;

15) purpose of the building (the non-residential building, the apartment house, residential building or the apartment house) if real estate object is the building;

16) purpose of the room (premises, the non-residential premise) if real estate object is the room;

17) premises type (the room, the apartment) if real estate object are the premises located in the apartment house;

18) purpose of construction if real estate object is the construction;

19) the number of floors, including underground floors if real estate object is the building or construction (with number of storeys at the building or construction);

20) material of external walls if real estate object is the building;

21) owner's address;

21. 1) e-mail address of the owner;

22) the information about the cadastral engineer performing cadastral works concerning real estate object in volume of the data determined by procedure for maintaining the State Immovable Property Cadastre;

23) year of commissioning of the building or construction upon completion of its construction or year of completion of its construction if real estate object is the building or construction;

24) data on the termination of existence of real estate object (date of removal from the cadastral registration) if the real estate object stopped existence.

25) the main characteristic of real estate object (extent, depth, depth, the area, amount, height, building area) determined by procedure for maintaining the State Immovable Property Cadastre and its value if real estate object is the construction;

26) degree of readiness of object of construction in progress as a percentage;

27) the main characteristic of real estate object (extent, depth, depth, the area, amount, height, building area) determined by procedure for maintaining the State Immovable Property Cadastre and its projectible value if real estate object is object of construction in progress;

28) projectible purpose of the building, construction which construction is not complete if real estate object is object of construction in progress;

29) the name of the building, construction determined by procedure for maintaining the State Immovable Property Cadastre in the presence of such name;

30) data on inclusion of real estate object in the unified state register of objects of cultural heritage (historical and cultural monuments) of the people of the Russian Federation in volume of the data determined by procedure for maintaining the State Immovable Property Cadastre, and also data on reference of real estate object to the revealed objects of cultural heritage which are subject to the state protection before decision making about its inclusion in the unified state register of objects of cultural heritage (historical and cultural monuments) of the people of the Russian Federation or on refusal to include it in this register, in volume of the data determined by procedure for maintaining the State Immovable Property Cadastre;

31) conditional number of the parcel of land formed according to the approved boundary-setting plan, the project of land surveying of the parcel of land or the parcels of land or the scheme of arrangement of the parcel of land or the parcels of land on the cadastral plan of the territory and details of the decision on approval of this boundary-setting plan or decision which provides approval of this scheme;

32) mark about availability of land dispute on location of borders of the parcels of land in the case provided by part 4 of article 45.1 of this Federal Law.

3. The public data on the rights and on restrictions (encumbrances) of the rights to real estate containing in the Unified State Register of Rights on real estate and transactions with it are considered brought in the State Immovable Property Cadastre.

Article 26.1. Appeal of the decision on suspension

1. The decision on suspension of implementation of the cadastral registration (in cases if the Federal Law of July 13, 2015 No. 218-FZ "About state registration of the real estate" allows possibility of implementation of the cadastral registration without simultaneous state registration of the rights) or the decision on suspension of implementation of the state cadastral registration and state registration of the rights, accepted concerning the documents necessary for implementation of the state cadastral registration (further - the decision on suspension), can be appealed administratively by the applicant or his representative, and also the cadastral engineer who prepared the boundary plan, the technical plan or the act of inspection provided in No. 218-FZ established by the Federal Law of July 13, 2015 "About state registration of the real estate" procedure with the statement for the cadastral registration and (or) state registration of the rights or the legal entity which worker is the cadastral engineer who prepared the boundary plan, the technical plan or the act of inspection provided in No. 218-FZ established by the Federal Law of July 13, 2015 "About state registration of the real estate" procedure with the statement for the cadastral registration and (or) state registration of the rights in the appeal commission created in case of the federal executive body authorized by the Government of the Russian Federation on implementation of the state cadastral registration, state registration of the rights, maintaining the Single state real estate register and normative legal regulation in the specified spheres, its territorial authorities (further - body of registration of the rights) in the procedure established by this Article (further - the appeal commission). At the same time appeal of the decision on suspension judicially is possible only after appeal of such decision in the appeal commission.
