1. Approve the Procedure for consideration of the applications about change of name (surname, own name, middle name) physical person which is applied.

2. Declare invalid the resolution of the Cabinet of Ministers of Ukraine of March 27, 1993 No. 233 "About approval of the Regulations on procedure for consideration of petitions for change by citizens of Ukraine of surnames, names, middle names" (the joint venture of Ukraine, 1993, No. 9, the Art. 180).

Procedure for consideration of the applications about change of name (surname, own name, middle name) physical person

1. This Procedure determines the mechanism of acceptance and consideration of the applications about change of name (surname, own name, middle name) physical persons - citizens of Ukraine.

2. (Further - name) citizens of Ukraine who live in the territory of Ukraine accepts statements for change of name (surname, own name, middle name), considers, and also the department of state registration of acts of civil status of the place of their accommodation keeps their account; citizens of Ukraine who constantly live abroad diplomatic representation or consular establishment of Ukraine in which they stay on the permanent consular registry.

3. The application for change of name is directed by the citizen of Ukraine (further - the applicant) personally in writing on condition of presentation of the passport of the citizen of Ukraine and in case the applicant constantly lives abroad, - on condition of presentation of the passport of the citizen of Ukraine for trip abroad, except the case provided by the paragraph the second this Item.

The statement for change of surname in connection with annulment of marriage which was not changed during state registration of annulment of marriage or annulment of marriage judicially authenticity of the signature of the applicant on which is notarially certified, can be given through the representative or is sent by mail.

For change of name of physical person which reached fourteen-year age together with the corresponding statement the application in writing of parents (one of parents - in case the second died, it is recognized bezvest as absent, it is declared the dead, it is acknowledged it is limited capable, incapacitated, it is deprived of the parent rights concerning this child and also if the information about the father (mother) of the child is excluded from assembly record about its birth or if the information about the man as the father of the child is introduced in assembly record about its birth according to the statement of mother) or the custodian about provision of consent to change of name is submitted.

4. Are enclosed to the application for change of name:

certificate of birth of the applicant;

the marriage certficate (in case the applicant is married);

the certificate on annulment of marriage (in case marriage is dissolved);

certificates of birth of children (in case the applicant has juvenile or minor children);

certificates on change of name of the applicant, the father or mother if it was changed earlier;

applicant's photograph;

the commitment letter of the applicant constituted in any form, authenticity of the signature on which is notarized, of awareness of the applicant of the responsibility for the message of false data and about need of exchange of the passport of the citizen of Ukraine or the passport of the citizen of Ukraine which is rather established by the law for trip abroad and other documents in case of change of name (in case of filing of application through the representative or sendings by mail in case, the stipulated in Item 3 presents of the Procedure);

receipt on payment of the state fee.

5. During filing of application, except filing of application through the representative or sendings by mail in case, the stipulated in Item 3 presents of the Procedure the department of state registration of acts of civil status, diplomatic representation or consular establishment of Ukraine warns the applicant about change of name about established by the legislation responsibility for the message of inveracious data and need of exchange of the passport of the citizen of Ukraine or the passport of the citizen of Ukraine for trip abroad and other documents in case of change of name.

6. The department of state registration of acts of civil status, diplomatic representation or consular establishment of Ukraine which adopted the statement for change of name check the data noted in the statement and in documents which are attached to it.

For confirmation of reliability of the documents filed by the applicant the department of state registration of acts of civil status which adopted the statement for change of name applies to noted documents of the copy of the corresponding assembly records of civil status or the statement from the State register of acts of civil status of citizens.

In case of storage of assembly records of civil status in archives of other departments of state registration of acts of civil status the department which adopted the statement for change of name sends the corresponding requests to the specified departments.

The diplomatic representation or consular establishment of Ukraine which adopted the statement for change of name send inquiries through the MFA to Ukrgosreestr for further transfer to departments of state registration of acts of civil status in which there are stored corresponding assembly records of civil status, about reclamation of their copies or statements from the State register of acts of civil status of citizens.

Change of name is carried out in the presence in archives of departments of state registration of acts of civil status of Ukraine of the corresponding assembly records of civil status and the acts of civil status of citizens this in the State register.

In case of absence in archives of departments of state registration of acts of civil status of Ukraine of assembly records of civil status to whom by results of state registration of change of name it is necessary to make changes according to the law or data in the State register of acts of civil status of citizens the statement for change of name can be considered only after their renewal and entering of data into noted Register in accordance with the established procedure.
