About the Disciplinary charter of the Armed Forces of Ukraine

1. Approve the Disciplinary charter of the Armed Forces of Ukraine it (is applied).

Disciplinary charter of the Armed Forces of Ukraine

This Charter determines essence of military discipline, obligation of the military personnel, and also persons liable for call-up and reservists during passing of training (checking) and special sessions concerning its observance, types of encouragement and authority punishments, the rights of commanders concerning their application, and also procedure for provision and consideration of the applications, offers and claims.

All military personnel of the Armed Forces of Ukraine irrespective of the military ranks, official position and merits shall be guided by requirements of this Charter steadily.

Provisions of the Charter extend to the citizens discharged from military service in resignation or stocked with the right of wearing military uniform of clothes, during wearing military uniform of clothes by them.

Operation of this Charter extends to the military personnel of Service of foreign intelligence of Ukraine, the Security Service of Ukraine, Public service of special communication and information security of Ukraine, National guard of Ukraine, the State Border Service of Ukraine, the Public special service of transport, Management of the state protection of Ukraine formed according to the laws of Ukraine of other military forming, bodies of special purpose with law-enforcement functions.

Section I. General provisions

1. The military discipline is faultless and steady observance by all military personnel of procedure and the rules established by charters of the Armed Forces of Ukraine and other legislation of Ukraine.

2. The military discipline is based on understanding by the military personnel of the conscription, responsibility for protection of the Fatherland, independence and territorial integrity of Ukraine, on their fidelity to the Military oath.

3. The military discipline is reached in the way:

education of high fighting and moral and psychological qualities of the military personnel on national and historical traditions of the Ukrainian people and traditions of the Armed Forces of Ukraine, patriotism, conscientious attitude to execution of conscription, fidelity to the Military oath;

the personal liability of each serviceman for observance of the Constitution and the laws of Ukraine of the Military oath, execution of the obligations, requirements of charters of the Armed Forces of Ukraine;

forming of legal culture of the military personnel;

skillful combination of daily insistence of commanders and chiefs (further - commanders) to subordinates without lowering of their personal advantage, with observance of the rights and freedoms, permanent care of them and the correct application of means of belief, coercion and public influence of collective;

model execution by commanders of conscription, their fair attitude towards subordinates;

maintenance in military connections, parts (divisions), institutions and organizations of necessary material living conditions, authorized procedure;

timely and complete supply of the military personnel with the established providing types;

accurate organization and complete involvement of staff to fighting study.

4. The military discipline obliges each serviceman:

observe the Constitution and the laws of Ukraine, the Military oath, to steadily fulfill requirements of charters of the Armed Forces of Ukraine, orders of commanders;

be vigilant, keep the state secret;

follow the rules of relations determined by charters of the Armed Forces of Ukraine between the military personnel, strengthen military society;

render respect for commanders and to each other, be polite and observe military etiquette;

handle advantage and honor, not to allow most and to constrain others from unworthy acts;

not use during passing of military service (except medical appointment) drugs, psychotropic substances or their analogs, and also not to take alcoholic drinks during fulfillment of duties of military service.

5. The commander is responsible for condition of military discipline in connection, military unit (division), institution and organization. Interests of protection of the Fatherland oblige the commander to support constantly military discipline, to demand its observance from subordinates, not to disregard any disciplinary offense.

The condition of military discipline in military unit (division), institution, organization and the organization is determined by capability of staff to carry out in full and in time objectives, moral and psychological condition of staff, to support by capability of commanders at the proper level military discipline.

Concerning each case of offense the commander shall make the decision concerning need of involvement of the guilty person to responsibility depending on the circumstances of making of offense, degree of fault, previous behavior of the violator and the size put to the state and other persons of damage and also taking into account the fighting immunity determined by the Law of Ukraine "About defense of Ukraine".

Activities of the commander concerning maintenance of military discipline are estimated not by the number of the authority punishments imposed by it, but fulfillment of duties with observance of requirements of the laws and charters of the Armed Forces of Ukraine, complete use of the disciplinary power for establishing order and prevention of violations of military discipline.

Each serviceman shall assist the commander in recovery and permanent maintenance of procedure and discipline.

The commander who did not provide respect for military discipline also did not take measures for its recovery, bears the responsibility established by the law.

6. The commander's right - to make orders and orders, and the subordinate's debt - them to carry out, except case of otdavaniye of obviously criminal order or the order. The order shall be executed honesty, precisely and at the scheduled time.

Responsibility for the order is born by the commander who gave it.

In case of disobedience or the subordinate's resistance the commander shall use for recovery of procedure all the Armed Forces of Ukraine of enforcement measures provided by charters up to attraction it to criminal liability.

The commander shall take measures for detention of the subordinate when making or making of attempt at making of criminal offense by it or directly after making of the criminal offense connected with disobedience, resistance or threat to the chief, use of violence, unauthorized leaving of military unit or the duty station, evasion from military service or desertion with immediate delivery of the detainee to the authorized officer or to take measures for the immediate notification of the authorized officer on detention and the location of person suspected of making of act with signs of criminal offense.
