About the Charter of garrison and guard services of the Armed Forces of Ukraine

The Verkhovna Rada of Ukraine decides:

1. Approve the Charter of garrison and guard services of the Armed Forces of Ukraine it (is applied).

2. To the Cabinet of Ministers of Ukraine in six-months time from the date of entry into force of this Law to approve Regulations on features of the organization and execution of guard duty in disciplinary battalion (part).

3. This Law becomes effective from the date of its publication.

Charter of garrison and guard services of the Armed Forces of Ukraine

This Charter determines the organization and procedure for execution of garrison and guard services, the rights and obligations of officials of garrison and the military personnel who is attracted for execution of these services.

The charter is obligatory for all military units, headquarters, the organizations, organizations and military schools of the Armed Forces of Ukraine.

Operation of this Charter extends to the military personnel of Service of foreign intelligence of Ukraine, prospecting body of the Ministry of Defence of Ukraine, the Security Service of Ukraine, Public service of special communication and information security of Ukraine, National guard of Ukraine, the State Border Service of Ukraine, the Public special service of transport, Management of the state protection of Ukraine formed according to the laws of Ukraine of other military forming, bodies of special purpose with law-enforcement functions.

Provisions of the Charter extend to persons liable for call-up and reservists during passing of charges by them.

Charter provisions regarding procedure for holding military funeral ritual extend to police officers who protected independence, sovereignty and territorial integrity of Ukraine.

General provisions

1. Military units, headquarters, organizations, organizations and military educational institutions of the Armed Forces of Ukraine, military units (organizations, organizations, bodies, etc.). The State Border Service of Ukraine, the Security Service of Ukraine, National guard of Ukraine and other military forming formed according to the laws of Ukraine, located (deployed) constantly or temporarily in the settlement (Items) or out of it (further - military units), territorially unite in garrison.

For interaction with other military forming formed according to the laws of Ukraine, law enforcement agencies of special purpose, the Public special service of transport, Public service of special communication and information security of Ukraine, local executive bodies, local government bodies, the companies, organizations, the organizations and citizens according to the existing administrative-territorial device of Ukraine to garrisons responsibility zones are determined.

2. In each garrison it will be organized garrison and guard services.

The garrison service is urged to provide respect for high military discipline by staff of garrison, necessary conditions for everyday life and preparation of military units, holding garrison actions with their participation.

Guard duty intends for reliable protection and defense of the important military facilities, Battle Flags and persons containing on guardroom or in disciplinary battalion (part).

3. Borders of garrison and zone of responsibility are determined by the order of the commander of troops of operational command, and in the city of Kiev - the order of the Ministry of Defence of Ukraine. Borders of garrison shall be well-known to all staff of garrison.

Zones of activities of governing bodies and divisions of Military service of law and order of the Armed Forces of Ukraine (further - Service of law and order) are determined by the order of the Ministry of Defence of Ukraine.

4. The management of garrison service and service of garrison guard from military units of garrison is performed by the chief of garrison.

The management of garrison and guard services in borders of operational command is performed by the commander of troops of operational command who is responsible for its condition.

Responsibility for condition of garrison and guard services in subordinate troops (forces) is assigned also to all direct chiefs.

The organization of service duty shifts of Service of law and order is determined by orders of the chief of the General Staff - the Commander-in-chief of the Armed Forces of Ukraine and instructions of the chief of Head department of Service of law and order.

Ordering troops of operational commands and all direct chiefs of commanders of the military units appointed by chiefs of garrisons shall check systematically condition of garrison and guard services in the troops (forces) subordinated to them, and also to hold the events directed to improvement of military discipline and procedure in garrisons with chiefs of garrisons.

Orders of the chief of garrison concerning garrison service shall be executed precisely by the military units deployed in limits of garrison, teams which are in limits of garrison, and the certain military personnel.

The order of the commander of troops of operational command (the chief of garrison) on these questions shall be carried out precisely by military units, teams in borders of this operational command (garrison) and the certain military personnel of the Armed Forces of Ukraine. Orders of the chief of garrison concerning garrison service are carried out by military units, teams of the State Border Service of Ukraine, the Security Service of Ukraine, National guard of Ukraine, other military forming created according to the laws of Ukraine which are located in borders of garrison, and the certain military personnel.

5. Ensuring military discipline and law and order among the military personnel of garrison, the organization of service of garrison guard, protection and defense of military facilities are assigned to the chief of garrison and the chief of governing body of Service of law and order in garrison.

Public authorities and local government bodies, military command and bodies of military management of the Armed Forces of Ukraine and other military forming formed according to the laws of Ukraine military personnel and other persons shall assist Service of law and order in accomplishment of the tasks assigned to it.

6. To garrison and guard services military units of the Armed Forces of Ukraine and division of Service of law and order which are part of garrison are attracted.

The priority of execution of garrison service and service of garrison guard in garrison military units is determined by the chief of garrison depending on their structure and appointment.

The list of military units of the Armed Forces of Ukraine which are not involved in execution of garrison service and service of garrison guard in garrison is determined by the chief of garrison.

Military units of other military forming formed according to the laws of Ukraine, law enforcement agencies of special purpose, the Public special service of transport in case of joint placement with military units of the Armed Forces of Ukraine are involved in service in garrison, except garrison guard. From these troops (military units) for the solution of joint questions on the organization of garrison service, counteraction diversionno - to terrorist groups, own safety, mitigation of consequences of natural disaster and so forth non-staff assistants to garrison are appointed.

In some cases, by order of the chief of garrison according to the procedure, determined by the Ministry of Defence of Ukraine, to accomplishment of tasks of Service of law and order on protection of military facilities, ensuring military discipline among the military personnel on streets and in other public places, to the prevention of the offenses made by the military personnel, and their termination the military personnel of other military units of the Armed Forces of Ukraine can temporarily be attracted. The direct management during execution of these tasks is assigned to the corresponding military official of Service of law and order.

Part I. Garrison service

Section 1. Military officials of garrison, the chief of governing body of service of law and order in garrison and their obligation

General provisions

7. In each garrison the order of the commander of troops of operational command, and in the city of Kiev and the cities of arrangement of headquarters of types of the Armed Forces of Ukraine by the order of the Ministry of Defence of Ukraine appoints the chief of garrison. Before appointment of the chief of garrison of its obligation the senior on position the commander (chief) carries out, and in case of equal positions - the senior on military rank.

In garrisons where military units of Naval forces of the Armed Forces of Ukraine are located, the order of the Commander of the Naval Forces of the Armed Forces of Ukraine appoints the senior sea chief concerning garrison and guard services submits to the chief of garrison.

In case of placement in the military camp of several military units of the Armed Forces of Ukraine the order of the chief of garrison from commanders of these parts appoints the senior of the military camp.

8. In garrisons in the presence in their structure of several military units of the Armed Forces of Ukraine from military officials, seniors on the corresponding position, the order of the chief of garrison are appointed:

deputy chief of garrison;

the deputy chief of garrison on moral and psychological providing;

the deputy chief of garrison on the back;

the assistant to the chief of garrison on legal work;

chief of communication of garrison;

chief of room and operational part of garrison;

chief of financial and economic service of garrison;

chief of health service of garrison;

chief of service of veterinary medicine of garrison;

the chief of service of radiation, chemical and biological protection - the chief of service of ecological safety of garrison;

chief of service of fire safety of garrison;

military conductor of garrison.

The part two is excluded according to the Law of Ukraine of 17.10.2019 No. 205-IX.

All military officials of garrison fulfill the duties in combination.

Instructions of military officials of garrison concerning their powers are obligatory for all staff of garrison.

Chief of garrison

9. The chief of garrison is responsible for maintenance of military discipline, the organization of execution of garrison and guard services, providing necessary conditions for everyday life and preparation of military units of garrison, holding garrison actions with their participation, condition of ecological and fire safety of garrison, interaction according to competence with other military forming formed according to the laws of Ukraine, law enforcement agencies of special purpose, the Public special service of transport, Public service of special communication and information security of Ukraine, local executive bodies, local government bodies, the companies, organizations and the organizations.

He has the right, in case of need, for accomplishment of the tasks assigned to it to raise staff and vehicles of military units of garrison.

The chief of garrison concerning garrison service and service of garrison guard is subordinated to the commander of troops of operational command and is the direct chief on these questions for all military personnel of garrison, including commanders of connections and military units which are part of garrison, and also for the senior sea chief.

To accomplishment of the obligations the chief of garrison announces crime in the order on garrison, reports on the commander of troops of operational command and the immediate superior, and also reports about it in relevant organs of the executive authority and local government bodies.

The chief of garrison shall:

to direct daily activities of military officials of garrison;

in coordination with relevant organ of management of service of law and order to develop and submit on approval to the immediate superior the plan of fire safety of garrison and the schedule of garrison guard;

organize protection and defense of garrison objects, to establish procedure for the admission of persons who arrived for printing (sealing) of garrison objects, to check at least once a month service by garrison guard;

to monthly involve officials of garrison in check of condition of service of troops and military discipline of all military units of garrison according to the approved schedule, irrespective of their subordination, with the publication of the order on garrison;

place parts, divisions, teams which arrive to garrison;

determine procedure for use of educational objects for military units of garrison;

consider and approve plans of all-garrison actions;

keep in contact with executive bodies and local government bodies, the chief of governing body of Service of law and order in zone of responsibility and to agree with them on the issues connected with garrison service and holding joint actions;

direct work of room and operational part of garrison on accommodation of military units and approve distribution of living space in garrison;

quarterly with involvement of the corresponding chief of governing body of Service of law and order in zone of responsibility to analyze condition of military discipline, garrison and guard services in garrison and to bring with commanders of military units and their deputies (assistants) on moral and psychological providing work results, to take measures for the prevention of criminal offenses and extraordinary events, increase in vigilance and preserving the state secret;

organize and hold events with participation of troops;

organize holding military funeral ritual during burials of persons determined by article 81 of this Charter;

appoint guards of honor and posts from military units and to exercise control of their preparation;

organize fire safety in garrison and special training of chiefs of services of fire safety of military units, carry out at least two times a year exercise of the plan of fire safety of garrison with attraction of all forces and means of garrison;

provide observance of conditions of ecological safety in garrison;

establish time of transition of military units of garrison for summer or winter dress code;

announce the beginning and the end of the heated period in garrison;

check what condition contains constructions, the territories of military camps, military cemeteries, mass graves, military monuments and to look after them properly;

organize observance of ecological conditions in garrison;

make personally office investigation of emergencies and offenses which were made within garrison by the military personnel, and in case of identification of signs of criminal offense without delay to notify the corresponding prosecutor, the chief of governing body of Service of law and order and body which makes pre-judicial investigation and to transfer the last all materials;

assist military officials of Service of law and order in accomplishment of the tasks by them on identification of the reasons, conditions and circumstances of the criminal and other offenses made in military units and on military facilities of garrison;

take measures for protection of the military transport which guard is discharged of service, before its replacement;

the paragraph twenty third is excluded according to the Law of Ukraine of 17.10.2019 No. 205-IX;

conduct acceptance of the military personnel and members of their families on private matters, to make decisions concerning statements, claims and other addresses;

carry out other obligations determined by this Charter.

10. The chief of garrison meets the President of Ukraine and the Supreme Commander of the Armed Forces of Ukraine, the Chairman of the Verkhovna Rada of Ukraine, the Prime Minister of Ukraine, the Minister of Defence of Ukraine, the chief of the General Staff and the commander-in-chief of the Armed Forces of Ukraine which arrived to garrison, it is represented to them and accompanies them. For meeting of specified persons the guard of honor is built according to the special order only in garrisons where headquarters of types, operational commands of the Armed Forces of Ukraine are located. Besides, the chief of garrison meets deputy defense secretaries, the ordering troops of operational commands of the Armed Forces of Ukraine and all the direct chiefs.

Deputy chief of garrison

11-1. The deputy chief of garrison is subordinated to the chief of garrison. He is responsible for the organization and execution of garrison service and service by garrison guard, for accomplishment of actions of combat and mobilization readiness of garrison, holding actions with the participation of troops (forces) of garrison.

The deputy chief of garrison shall:

develop plans of holding actions with the participation of troops (forces) of garrison, reduction of garrison in combat readiness, the plan of strengthening of protection of garrison objects;

constitute the schedule of garrison guard, the sheet of the garrison job specification, sheets of posts, schemes of placement of posts, instructions to chiefs of guard and their assistants, the person on duty of guard and his assistant, and also to constitute the schedule of check of guard by military officials of garrison and to submit them for approval to the chief of garrison, to exercise control of their accomplishment;

organize and control protection of the military camps separate premises of military units;

appoint guards of honor from military units and exercise control of their preparation;

record military cemeteries, mass graves and military monuments which are in limits of garrison, monitor their leaving.

In case of temporary absence of the chief of garrison the deputy chief of garrison fulfills its duties.

The deputy chief of garrison on moral and psychological providing

12. The deputy chief of garrison on moral and psychological providing is subordinated to the chief of garrison. He is responsible for the organization and holding all-garrison actions for strengthening of military discipline in garrison, social, legal, information, moral and psychological security, and also for the organization of work on questions of culture and leisure according to instructions of the chief of garrison.

The deputy chief of garrison on educational work shall:

the paragraph two is excluded according to the Law of Ukraine of 17.10.2019 No. 205-IX;

know moral and psychological condition of the military personnel and military discipline, fulfill measures for strengthening of military discipline, organization and procedure in garrison, to the prevention of offenses;

organize humanitarian preparation, carry out social and political and legal informing the military personnel, members of their families, civil personnel of military units of garrison;

it is permanent to study requests and mood of staff;

establish and keep in close connection with executive bodies and local government bodies, organizations, the companies, the organizations, media;

develop and submit for approval to the chief of garrison the plan all-garrison culturally - educational actions and to organize their carrying out;

direct work of garrison cultural institutions and leisure, to develop and submit for approval to the chief of garrison the plan of servicing of military units of garrison by local and garrison cultural institutions and leisure;

together with executive bodies and local government bodies, public organizations to participate in holding actions on voyenno - to patriotic education of the population, especially youth;

participate in carrying out work on observance of requirements of the legislation of Ukraine on protection of the surrounding environment;

it is permanent to carry out the work directed to preserving in garrison of the state and military secret and increase in vigilance, especially in military units and divisions which keep the watch;

show permanent care of health protection of the military personnel, life and the device of troops of garrison;

at least once a month to check service by garrison and internal guard, and also the organization and carrying out measures of moral and psychological providing staff of guard;

to timely report on the chief of garrison on moral and psychological condition and military discipline of troops of garrison, and also on holding all-garrison actions.

The deputy chief of garrison on the back

13. The deputy chief of garrison on the back is subordinated to the chief of garrison. He is responsible for timely holding garrison actions for logistic support of military units of garrison.

The deputy chief of garrison on the back shall:

the paragraph two is excluded according to the Law of Ukraine of 17.10.2019 No. 205-IX;

the paragraph third is excluded according to the Law of Ukraine of 17.10.2019 No. 205-IX;

the paragraph the fourth is excluded according to the Law of Ukraine of 17.10.2019 No. 205-IX;

carry out with the military personnel of officers of logistics of military units of garrison of action for experience exchange of work and maintaining army economy of the best military units of garrison;

study economic condition of the region of arrangement of military units of garrison for the purpose of the best use of local resources by them;

place military divisions (teams) arriving to the territory of garrison, certain military personnel, and also the guard accompanying transport with military loads and to provide them with food;

determine on what providing military units the convicts detained and the detained military personnel who contain on the guardrooms, in rooms which are temporarily detained Services of law and order will be.

14. The assistant to the chief of garrison on legal work is subordinated to the chief of garrison. The assistant to the chief of garrison on legal work shall:

coordinate work and participate in ensuring realization of the state legal policy in garrison;

Chief of communication of garrison

15. The chief of communication of garrison is subordinated to the chief of garrison. He is responsible for the organization and condition of communication in garrison.

The chief of communication of garrison shall:

the paragraph two is excluded according to the Law of Ukraine of 17.10.2019 No. 205-IX;

develop and submit for approval to the chief of garrison the plan of the organization and ensuring intra garrison communication and to control its condition;

participate in joint actions with representatives of the central executive body concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash concerning the organization of communication;

exercise control of the organization and permanent readiness of the warning system of officials, military facilities, and also the military personnel and members of their families who live in military camps of garrison;

give to the chief of communication of the highest level of the request for necessary means of communication and operational materials for ensuring intra garrison and intergarrison communication;

perform actions for providing and servicing of means of communication of governing bodies and divisions of Service of law and order in zone of responsibility, garrison guard, to timely organize repair of the available means of communication;

exercise control of observance of rules of negotiating via means of communication.

Chief of room and operational part of garrison

16. The chief of room and operational part of garrison is responsible for the organization of operation, timely repair and accounting of barracks housing stock, for room providing the military units attributed to kvartirno - operational part. He is subordinated to the chief kvartirno - operational management of operational command. Concerning use of barracks fund, distribution of premises and streamlining of troops it follows instructions of the chief of garrison.

The chief of room and operational part of garrison shall:

develop and submit for approval to the chief of garrison plans concerning improvement, gardening, barrier and cleaning of the territories of military camps of garrison and to control their accomplishment;

direct works on repair of barracks housing stock, the household companies and other buildings of military units and exercise control for it is repair - construction works which are performed by directly military units;

provide military units with all types of room providing and check correctness of their use;

organize providing military units with the electric power, water, construction materials and to control correctness of their use;

perform management on technical issues with room and operational services in military units;

participate in plan development and holding actions for environmental protection and rational use of natural resources in garrison;

record protective and special constructions of garrison and exercise control of their correct operation, storage and content;

check correctness of requests of military units for appliances and means for room providing, to constitute summary requests and to give them to dovolstvenny bodies of the highest level;

record military towns, buildings in them, the utility equipment, all types of room providing and means which are provided for room providing.

The chief of room and operational part can perform the activities in several garrisons.

Chief of financial and economic service of garrison

17. The chief of financial and economic service of garrison is subordinated to the chief of garrison. He is responsible for the organization of financial and economic work in garrison.

The chief of financial and economic service of garrison shall:

record military units of garrison which are financed from the Government budget of Ukraine and are serviced in bodies which perform treasurer servicing of budgetary funds;

organize interaction with bodies which perform treasurer servicing of budgetary funds;

timely and qualitatively to carry out orders of the senior chiefs concerning collection, generalization and provision of necessary financial and economic information, implementation of checks of activities of financial and economic bodies of military units of garrison;

to bring quickly to financial and economic bodies of military units of the order of relevant organ which performs treasurer servicing of budgetary funds, to make explanations on their application, to assist commanders and chiefs of financial and economic bodies of military units of garrison in interaction with bodies which perform treasurer servicing of budgetary funds;

if necessary to approve with bodies which perform treasurer servicing of budgetary funds and banks of graphics of receipt of cash;

have information on remaining balance of means on registration accounts of military units of garrison on codes of program and economic classification of expenses, and also the reasons of their origin;

inform the corresponding seniors on subordination of chiefs on the amounts of means which timely are not used;

have information on questions of interaction of financial and economic bodies of military units of garrison with bodies which perform treasurer servicing of budgetary funds; about impossibility of the solution of single questions without delay to inform the senior chiefs on subordination;

plan, organize and carry out special preparation with staff of financial and economic bodies of military units of garrison;

have information, control and take measures for timely submission by military units to bodies which perform treasurer servicing of budgetary funds - financial and planned documents, reports, to modification of indicators of profit and loss budgets and plans of assignments from the general fund of the budget, in the single database and network of managers of budgetary funds;

carry out other tasks assigned to it by orders, orders and orders of the chief of garrison, other senior chiefs.

Provisions of this Article extend only to the Armed Forces of Ukraine.

Chief of health service of garrison

18. The chief of health service of garrison is subordinated to the chief of garrison. He is responsible for the organization and carrying out treatment-and-prophylactic and anti-epidemic actions, and also exercises control over the implementation of health regulations in garrison.
