According to the resolution of the Cabinet of Ministers of November 24, 2004 and for the purpose of enhancement of monitoring of compliance with law in the field of mass communications the Cabinet of Ministers decides N555 "About Measures for Enhancement of Management Structure in the field of Mass Communications":

1. Approve Regulations on procedure of monitoring of compliance with law in the field of release and distribution printing and book, teleradio-, audiovisual products and information resources of the Internet in the Republic of Uzbekistan according to appendix.

2. To impose control over the implementation of this resolution on the Deputy prime minister of the Republic of Uzbekistan Aripov A. N.

Regulations on procedure of monitoring of compliance with law in the field of release and distribution printing and book, teleradio-, audiovisual products and information resources of the Internet in the Republic of Uzbekistan

I. General provisions

1. This Provision is developed according to the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of November 24, 2004 No. 555 "About measures for enhancement of management structure in the field of mass communications".

2. This Provision determines procedure for carrying out system monitoring of compliance with law in the field of release and distribution printing and book, teleradio-, audiovisual products and information resources of the Internet the Center for questions of mass communications of the Agency of information and mass communications (further - the Center), and also order of interaction of the Center and Commission of experts in the field of information and mass communications (further - the Commission) with the ministries, the state committees, departments, public authorities on places (further - state governing bodies).

3. In this Provision the following basic concepts are used:

audiovisual products - audiovisual works (film, TV and videos, slaydfilma, filmstrips and other film, TV, video and radio works, soundtracks, songs, computer games) on any information mediums;

information resources of the Internet - information, databank, the database electronically as a part of the information systems included in the Internet in the worldwide information network;

book products - the printed materials made in the form of books, brochures, booklets;

mass communications - technical, and also any other means by means of which systematic distribution of information (through seal, radio, television, cinema is performed,

audiovideo, telecommunication systems, including Internet, computer games);

printed materials - products (edition) produced by printing (printing) method;

the subject of the market of information services - the legal and (or) physical person performing activities in the Republic of Uzbekistan in the field of release, distribution printing and book, teleradio-, audiovisual products and information resources of the Internet;

the sphere of mass communications - activities of legal entities and physical persons for production, forming, processing, relaying, broadcasting and storage of radio - and TV programs, other mass information using information and communication technologies (space and satellite communication, data communication networks and the Internet, etc.), computer games, and also to production, distribution and storage of periodic printed and book materials, audiovisual products and soundtracks for mass use on any information mediums (audio-and videotapes, video compact disks and so forth);

teleradio products - separate release TV, radio - video, film chronicle programs.

II. Monitoring subject

4. Subject of monitoring of compliance with law in the field of release and distribution printing and book, teleradio-, audiovisual products and information resources of the Internet is realization of complex of the actions intended for studying of observance by subjects of the market of information services of requirements of the legislation in this sphere and providing:

a) operational identification of violations of requirements of the legislation, including identification of cases of non-compliance with information services by subjects of the market:

conditions of license agreements and state registration, and also the subjects performing the activities without license and state registration;

technical regulations or standards in the field of release and distribution printing and book, teleradio-, audiovisual products and information resources of the Internet;

procedure for distribution of teleradio products of foreign mass media in the territory of the Republic of Uzbekistan;

b) informing authorized bodies on the violations allowed by subjects of the market of information services;

c) development of suggestions for improvement of the legislation in the field of release and distribution printing and book, teleradio-, audiovisual products and information resources of the Internet.

5. Monitoring is performed on permanent basis.

III. Objects of monitoring

6. Objects of monitoring are and are subject to studying:

printing and book editions; audiovisual products;

products of National broadcasting company of Uzbekistan, teleradio studios (radio, cable, radio cable television, broadcasting);

teleradio products of foreign mass media;

products of news agencies; information resources of the Internet.

7. Monitoring is performed by the Center and its regional departments.

8. Monitoring is performed in the place of state registration of the subject of the market of information services.

9. The central office of the Center performs monitoring of the products made and distributed in Tashkent and also teleradio products of foreign mass media.

IV. Representation of control copies of products

10. For the purpose of ensuring implementation of monitoring subjects of the market of information services on free basis represent to the Center or to its regional departments control copies of periodic printing editions, book and audiovisual products.

11. Subjects of the market of information services in Tashkent bring control copies directly to the Center. The subjects of the market of information services performing activities in other regions bring control copies to regional departments of the Center.

12. Control of delivery in the Center or in its regional departments is performed by subjects of the market of information services of control copies:
