being guided by Article 125 (part 4) Constitutions of the Russian Federation, Item 3 parts one, parts three and the fourth Article 3, Item 3 parts two of Article 22, Articles 36, 74, 86, 96, 97, 99, 101, 102 and 104 Federal constitutional laws "About the Constitutional Court of the Russian Federation",

considered in the dug-out meeting case on check of constitutionality of Item 1 of Article 10 and Item 2 of article 13 of the Federal Law of December 17, 2001 "About work pensions in the Russian Federation" and the paragraph of third Item 7 of Rules of accounting of the insurance premiums included in the settlement pension capital (are approved by the order of the Government of the Russian Federation of June 12, 2002 N 407).

Reason for consideration of the case were requests of the Supreme Court of the Russian Federation and Uchalinsky district court of the Republic of Bashkortostan, and also the claim of citizens A. V. Dokukin, A. S. Muratov and T. V. Shestakova. The basis to consideration of the case was the found uncertainty in question of whether there correspond Constitutions of the Russian Federation the normative provisions challenged by applicants.

Considering that requests of courts and the claim of citizens concern the same subject, the Constitutional Court of the Russian Federation, being guided by article 48 of the Federal constitutional Law "About the Constitutional Court of the Russian Federation", connected cases on these addresses in one production.

Having heard the message of the judge-speaker O. S. Hokhryakova, explanation of agents of the parties, speeches of the representatives invited in meeting: from the Pension Fund of the Russian Federation - L. I. Chizhik, from the Ministry of Health and Social Development of the Russian Federation - Yu. V. Voronina, having researched the submitted documents and other materials, the Constitutional Court of the Russian Federation established:
