About abolition of the State trade corporation "Turkmenneftegaz", questions of Head department of Turkmennebitonumleri

For the purpose of enhancement of structure and management of oil and gas complex of Turkmenistan, increase in level of security with oil products of the companies and the population of the country according to the National program "The Strategy of Economic, Political and Cultural Development of Turkmenistan for the Period till 2020" I decide:

1. Abolish the State trade corporation "Turkmenneftegaz".

2. Transfer in accordance with the established procedure to the jurisdiction:

The ministries of the oil and gas industry and mineral resources of Turkmenistan - Head department of Turkmennebitonumleri of the abolished State trade corporation "Turkmenneftegaz" as the independent legal entity;

Turmengaz state concern - The Combining "Turkmengazosnabzheniye", Consolidation of Turkmentransgaz and Management of gas-technical supervision of the abolished State trade corporation "Turkmenneftegaz" as independent legal entities;

Head department of Turkmennebitonumleri - Service on control of use of oil products of the abolished State trade corporation "Turkmenneftegaz";

Nebitgazkhyzmat joint-stock company - Service on operation of the Exhibition center in Ashgabat and the State company for production of agricultural products of the abolished State trade corporation "Turkmenneftegaz".

3. Assign to Head department of Turmennebitonumleri of function on providing the population, the companies and organizations of Turkmenistan with oil products and control of their use.

4. Abolish in accordance with the established procedure Management of material resources and picking of the abolished State trade corporation "Turkmenneftegaz", having created on its technological Management of Logistics base with the status of the legal entity as a part of State concern "Turkmenneftegazstroy''.

5. Determine that:

legal successor of the abolished State trade corporation "Turkmenneftegaz" by the rights and obligations connected with investing, productive activity and according to credit agreements in oil processing industry, and also equity in Nebitgazkhyzmat joint-stock company is the Turkmenbashi complex of oil refineries;

legal successor of the abolished State trade corporation "Turkmenneftegaz" by the rights and obligations connected with implementation of contracts and agreements on natural gas export and the liquefied gas made by the Nayipsky workshop on production of the liquefied gas is the Turkmengaz State concern, on export of oil products and the liquefied gas - Turkmenbashi complex of oil refineries;

legal successors under agreements and purchase contracts of material products signed by Management of material resources and picking of the abolished State trade corporation "Turkmenneftegaz", are the Turkmenbashi complex of oil refineries, Turkmengaz State concern and Head department of Turkmennebitonumleri according to purpose of the contract.

6. Establish the total number of employees of Head department of Turkmennebitonumleri in number of 5000 units, including employees of central office - 30 units (without service personnel).

7. Permit the chief of Head department of Turkmennebitonumleri to have two deputies.

8. To head department of Turkmennebitonumleri:

in 2 weeks time to develop and submit for approval in the Cabinet of Ministers of Turkmenistan the draft of the Charter about Head department;

in 10-day time to submit for approval to the Cabinet of Ministers of Turkmenistan the staff list and official pay rates of employees of central office of Head department of Turkmennebitonumleri.

9. Approve enclosed:

structure of central office of Head department of Turkmennebitonumleri;

the list of the companies and organizations which are part of Head department of Turkmennebitonumleri.

10. Recognize invalid resolutions of the President of Turkmenistan from 1 Gorkut of 1996 No. 2699 "About formation of the State trade corporation "Turkmenneftegaz" (Collection of acts of the President of Turkmenistan and decisions of the Government of Turkmenistan, 1996, No. 7, the Art. 3296) and from 22 Bitaraplyk 1997 No. 3460 "About approval of the Regulations on the State trade corporation "Turkmenneftegaz" (Collection of acts of the President of Turkmenistan and decisions of the Government of Turkmenistan, 1997, No. 12, the Art. 4325).

11. This resolution becomes effective with 1 Turkmenbashi of 2006.

12. To impose control over the implementation of this resolution on the Minister of the oil and gas industry and mineral resources of Turkmenistan Atayev G.
