The list of the documents and data requested from uslugopoluchatel for rendering the state service and its subspecies (in the presence)

The applicant provides the following documents:

1. For receipt of the status in general procedure and the status based on the consent of local executive body to assignment of the status of kandas through foreign institution of the Republic of Kazakhstan or the State corporation:

1) the autobiography (in any form);

2) copies of identity documents of the applicant and members of his family (in the presence), with notarially attested transfer on Kazakh or Russian;

3) copies of the documents establishing the applicant's compliance to the condition provided by the subitem 18) of Item 2 of these rules (the certificates of birth, the foreign passport, the certificate of the stateless person, other official documents of special bodies of the country of outcome of ethnic Kazakhs confirming nationality of applicants) in case of lack of the recommendation of the Commission on determination of belonging to the Kazakh nationality of persons applying for receipt of the status of kandas and nationality of the Republic of Kazakhstan in the simplified (registration) procedure) the provided subitem 11-1) of article 11 of the Law of the Republic of Kazakhstan "About population shift".

Documents are provided in originals and copies for reconciliation then originals of documents (except for autobiographies) return to the applicant, use of electronic copies and data from the state bases is also possible.

Data on identity documents, the service provider receives from the corresponding state digital systems through lock of "the digital government".

2. For prolongation of the status:

the applicant submits the application according to appendix 6 to these rules.

Reclamation from applicants of documents which receive from digital systems is not allowed.

The bases for refusal in rendering the state service and its subspecies (in the presence) established by the laws of the Republic of Kazakhstan

The decision on assignment or refusal of the status of kandas is accepted by local executive body and is drawn up according to appendix 4 to these rules within 30 working days after day of registration of a statement by local executive body.

The local executive body refuses assignment of the status of kandas and (or) inclusion in regional quota of acceptance of kandas on the following bases:

1) discrepancy of applicants to the conditions established by the subitem 1) of article 20 of the Law "About Population Shift";

2) establishment of unauthenticity of the documents submitted by the applicant for receipt of the state service, and (or) these (data) containing in them;

3) availability of the compromising data on making by the ethnic Kazakhs petitioning for assignment of the status of kandas and (or) inclusion in regional quota of acceptance of kandas, offenses in the territory of the Republic of Kazakhstan and other information on their belonging to the terrorist or extremist organizations;

4) lack of consent of the ethnic Kazakh represented according to article 8 of the Law of the Republic of Kazakhstan "About personal data and their protection" on access to personal data of limited access;

5) lack of regional quota of acceptance of kandas in territorial administrative unit or refusal of the ethnic Kazakh of the territorial administrative unit offered for resettlement.

Also refusal in rendering the state service are the bases, the stipulated in Article 19-1 Law of the Republic of Kazakhstan "About the state and socially responsible services".

6) copy of the certificate of birth of family members (in the presence).

The bases for refusal in rendering the state service and its subspecies (in the presence) established by the Law of the Republic of Kazakhstan

The refusal basis about inclusion in regional quota of acceptance of kandas are conditions, the stipulated in Article 20 Laws of the Republic of Kazakhstan "About population shift" (further – the Law).

1) discrepancy of applicants to the conditions established by the subitem 13) of article 1 of the Law, namely кандас – the ethnic Kazakh and (or) members of his family of the Kazakh nationality who were earlier not consisting in the nationality of the Republic of Kazakhstan, received the corresponding status according to the procedure established by authorized body concerning population shift;

2) establishment of unauthenticity of the documents submitted by the ethnic Kazakh for receipt of the state service, and (or) these (data) containing in them;

3) availability of the compromising data on making by the ethnic Kazakhs petitioning for assignment of the status of kandas and (or) inclusion in regional quota of acceptance of kandas, offenses in the territory of the Republic of Kazakhstan and other information on their belonging to the terrorist or extremist organizations;

4) lack of consent of the ethnic Kazakh represented according to article 8 of the Law of the Republic of Kazakhstan "About personal data and their protection" on access to personal data of limited access;

5) lack of regional quota of acceptance of kandas in territorial administrative unit or refusal of the ethnic Kazakh of the territorial administrative unit offered for resettlement.

The bases for refusal on inclusion in regional quota of acceptance of immigrants:

1) establishment of unauthenticity of these (data) containing in the submitted documents;

2) lack of consent of the immigrant represented according to article 8 of the Law of the Republic of Kazakhstan "About personal data and their protection" on access to personal data of limited access;

3) discrepancy of the applicant to conditions, the established Items 1 and 2 of article 112 of the Social code of the Republic of Kazakhstan;

4) lack of regional quota of acceptance of immigrants in territorial administrative unit or refusal of the immigrant of the territorial administrative unit offered for resettlement;

5) discrepancy of applicants to categories, stipulated in Item 12 Rules of voluntary resettlement of the faces for increase in labor force mobility approved by the order of the Deputy prime minister – the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 22, 2023 No. 234 (it is registered in the Register of state registration of regulatory legal acts for No. 32880).

To the applicants having complete or partial loss of capability, or opportunity to perform self-service in the procedure established by the legislation to move, be guided independently, documents acceptance is made by the employee of the State corporation by means of the address through Single contact center 1414 for rendering the state service.

1) the state service in issue or prolongation of permissions to attraction of foreign labor power appears on paid basis according to the sizes of rates of charge, for issue or prolongation of permission to attraction of foreign labor power to the Republic of Kazakhstan, the approved order of the Government of the Republic of Kazakhstan of October 3, 2025 No. 819 "About establishment of rates of charge for issue or prolongation of permission to attraction of foreign labor power to the Republic of Kazakhstan";

2) the state service in renewal of earlier issued permissions to attraction of foreign labor power, and also in issue, prolongation or renewal of permissions to attraction of foreign labor power within internal transfer appears to the employer on free basis.

Payment of the fiscal duty is performed in cash and non-cash forms through the banks of the second level and the organization performing separate types of banking activities within 10 (ten) working days from the date of receipt of the notification in form according to appendix of 4 these rules of local executive bodies of areas, cities of republican value, the capital of adoption by it of the decision on issue or prolongation of permission to attraction of foreign labor power to the Republic of Kazakhstan.

Issue or prolongation of permissions to attraction of the foreign labor power performed within internal transfer is performed on free basis.

1) the statement certified by the EDS of the employer;

notarially attested electronic copy and transfer (if the document is not completed on state or Russian) the document (the letter or the agreement on transfer) approved between the foreign worker and foreign legal person employer from whom temporary transfer of the foreign worker is made (if foreign legal person employer, sends the workers to the Republic of Kazakhstan for performance of works, rendering services in the affiliated organization, representation, branch of the foreign legal entity in whom such foreign legal person employer directly or indirectly has shares or shares);

5) the electronic copy of the letter of the employer which confirms compliance of qualification and working experience of the foreign worker of position on which its attraction is performed;

6) information on accomplishment of replacement of foreign workers by the Kazakhstan citizens in case of issue of permissions to attraction of foreign labor power according to Item 14 of these rules;

7) information on local content in personnel in form according to appendix of 6 these rules (except for small business entities, public institutions and the companies, representations and branches of foreign legal entities numbering workers no more than 10 people, the foreign workers who arrived for independent employment to the Republic of Kazakhstan in compliance of issue or prolongation of references to the foreigner or the stateless person about compliance of its qualification for independent employment, the list of priority industries (types of economic activity) and professions demanded in them according to subitem 14-5) of article 11 of the Law of the Republic of Kazakhstan "About population shift", on the permissions issued within quotas over the countries of outcome in the presence of the international treaties on cooperation ratified by the Republic of Kazakhstan in the field of labor migration and social protection of migrant workers;

8) notarially attested copy of the document on conditions on local content in personnel for investment priority projects in the established form according to appendix of 7 these rules;

9) information on replacement of foreign workers by the Kazakhstan citizens it agrees Item 14 of these rules;

10) the electronic copy of the service provision agreement in the territory of the corresponding administrative and territorial unit (in case of attraction of foreign labor power within several administrative and territorial units);

11) the electronic copy of the letter of authorized body of the corresponding administrative territorial unit on satisfaction of the need for required foreign labor power (in case of attraction of foreign labor power within several administrative and territorial units);

12) electronic copy of the identity document of the foreign worker;

13) the document confirming introduction of collection for issue of permission;

3. Renewal of permission to attraction of foreign labor power:

1) for renewal of permission to attraction of foreign labor power are provided documents, stipulated in Item 2 lists of documents necessary for rendering the state service are necessary.

4. Prolongation of permission to attraction of foreign labor power:

1) the statement certified by the EDS of the employer;

2) the information about the involved foreign workers;

3) information on local content in personnel;

4) electronic copy of the identity document of the foreign worker;

5) the document confirming introduction of collection for issue of permission.

5. Issue or renewal of permission to attraction of foreign labor power within internal transfer:

1) the statement certified by the EDS of the employer;

2) the electronic copy of notarially attested transfer (if the document is not completed in the Kazakh or Russian languages) the employment contract (concluded with the legal entity founded in the territory of the member country of the World Trade Organization, who is and acting outside the territory of the Republic of Kazakhstan), or letters or the agreement on internal transfer signed with the employer (concluded with the legal entity founded in the territory of the member country of the World Trade Organization, who is and acting outside the territory of the Republic of Kazakhstan), with branch, representation, the affiliate of this legal entity, founded / undergone accounting registration in the Republic of Kazakhstan;

3) information on labor activity of the worker with appendix of the supporting documents recognized in the Republic of Kazakhstan;

4) information on accomplishment of the special conditions assigned in case of issue of permissions to attraction of foreign labor power according to Item 80 of these rules;

5) the electronic copy of the letter of foreign legal person employer who confirms about compliance of qualification and working experience of the foreign worker of position on which internal transfer, and also the letter from the host party, confirmatory is made that the worker has necessary qualification and working experience of work;

6) information on the accepted special conditions for obtaining and prolongation of permissions on form according to appendix of 8 these rules;

7) information on local content in personnel in case of involvement of foreign workers within internal transfer according to appendix of 9 these rules;

8) the electronic copy of the program for increase in local content in personnel (in the presence);

9) electronic copy of the identity document of the foreign worker.

6. Prolongation of permission to attraction of foreign labor power within internal transfer:

1) the statement certified by the EDS of the employer;

2) information on accomplishment of special conditions of the permissions to attraction of foreign labor power issued for previous and flowing calendar years, according to Item 80 of these rules;

3) information on local content in personnel in case of involvement of foreign workers within internal transfer;

4) reasons for prolongation of term of permissions;

electronic copy of the identity document of the foreign worker;

5) information on the accepted special conditions.

7. Renewals of permission in connection with change of surname, name, middle name, number and series of the identity document of the foreign worker and in case of reorganization of the employer legal entity of the Republic of Kazakhstan or branch (representation) of the foreign legal entity in the form of merge, accession, separation, allocation or transformation, and also in case of the change of its name or details specified in permission to attraction of foreign labor power:

1) the statement certified by the EDS of the employer;

2) the electronic copies of documents confirming change of surname, name, middle name, number and series of the identity document of the foreign worker, reorganization of the employer legal entity of the Republic of Kazakhstan or branch (representation) of the foreign legal entity in the form of merge, accessions, separations, allocations or transformations and also in case of the change of its name or details specified in permission to attraction of foreign labor power.

The applicant provides the following documents:

1. For receipt of the status in general procedure and the status based on the consent of local executive body to assignment of the status of kandas through foreign institution of the Republic of Kazakhstan or the State corporation:

1) the autobiography (in any form);

2) copies of identity documents of the applicant and members of his family (in the presence), with notarially attested transfer on Kazakh or Russian;

3) copies of the documents establishing the applicant's compliance to the condition provided by the subitem 18) of Item 2 of these rules (the certificates of birth, the foreign passport, the certificate of the stateless person, other official documents of special bodies of the country of outcome of ethnic Kazakhs confirming nationality of applicants) in case of lack of the recommendation of the Commission on determination of belonging to the Kazakh nationality of persons applying for receipt of the status of kandas and nationality of the Republic of Kazakhstan in the simplified (registration) procedure) the provided subitem 11-1) of article 11 of the Law of the Republic of Kazakhstan "About population shift".

Documents are provided in originals and copies for reconciliation then originals of documents (except for autobiographies) return to the applicant, use of electronic copies and data from the state bases is also possible.

Data on identity documents, the service provider receives from the corresponding state information systems through lock of "the electronic government".

2. For prolongation of the status:

the applicant submits the application according to appendix 6 to these rules.

Reclamation from applicants of documents which receive from information systems is not allowed.

The bases for refusal in rendering the state service and its subspecies (in the presence) established by the laws of the Republic of Kazakhstan

The decision on assignment or refusal of the status of kandas is accepted by local executive body and is drawn up according to appendix 4 to these rules within 30 working days after day of registration of a statement by local executive body. The local executive body refuses assignment of the status of kandas and (or) inclusion in regional quota of acceptance of kandas on the following bases:

1) discrepancy of applicants to the conditions established by the subitem 1) of article 20 of the Law "About Population Shift";

2) establishment of unauthenticity of the documents submitted by the applicant for receipt of the state service, and (or) these (data) containing in them;

3) availability of the compromising data on making by the ethnic Kazakhs petitioning for assignment of the status of kandas and (or) inclusion in regional quota of acceptance of kandas, offenses in the territory of the Republic of Kazakhstan and other information on their belonging to the terrorist or extremist organizations;

4) lack of consent of the ethnic Kazakh represented according to article 8 of the Law of the Republic of Kazakhstan "About personal data and their protection" on access to personal data of limited access;

5) lack of regional quota of acceptance of kandas in territorial administrative unit or refusal of the ethnic Kazakh of the territorial administrative unit offered for resettlement.

Also refusal in rendering the state service are the bases, the stipulated in Article 19-1 Law of the Republic of Kazakhstan "About the state and socially responsible services".

5) the document on registration of person who is looking for work and (or) the unemployed according to the procedure, provided by Rules of registration of persons who are looking for work, the unemployed and implementation of the labor mediation rendered by the career centers approved by the order of the Deputy prime minister - the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 9, 2023 No. 214 (it is registered in the Register of state registration of regulatory legal acts for No. 32850);

6) copy of the certificate of birth of family members (in the presence);

The refusal basis about inclusion in regional quota of acceptance of kandas are conditions, the stipulated in Article 20 Laws of the Republic of Kazakhstan "About population shift" (further – the Law).

1) discrepancy of applicants to the conditions established by the subitem 13) of article 1 of the Law, namely кандас – the ethnic Kazakh and (or) members of his family of the Kazakh nationality who were earlier not consisting in the nationality of the Republic of Kazakhstan, received the corresponding status according to the procedure established by authorized body concerning population shift;

2) establishment of unauthenticity of the documents submitted by the ethnic Kazakh for receipt of the state service, and (or) these (data) containing in them;

3) availability of the compromising data on making by the ethnic Kazakhs petitioning for assignment of the status of kandas and (or) inclusion in regional quota of acceptance of kandas, offenses in the territory of the Republic of Kazakhstan and other information on their belonging to the terrorist or extremist organizations;

4) lack of consent of the ethnic Kazakh represented according to article 8 of the Law of the Republic of Kazakhstan "About personal data and their protection" on access to personal data of limited access;

5) lack of regional quota of acceptance of kandas in territorial administrative unit or refusal of the ethnic Kazakh of the territorial administrative unit offered for resettlement.

The bases for refusal on inclusion in regional quota of acceptance of immigrants:

1) establishment of unauthenticity of these (data) containing in the submitted documents;

2) lack of consent of the immigrant represented according to article 8 of the Law of the Republic of Kazakhstan "About personal data and their protection" on access to personal data of limited access;

3) discrepancy of the applicant to conditions, the established Items 1 and 2 of article 112 of the Social code of the Republic of Kazakhstan;

4) lack of regional quota of acceptance of immigrants in territorial administrative unit or refusal of the immigrant of the territorial administrative unit offered for resettlement;

The state service is rendered for a fee/free of charge to physical persons and legal entities.

1) the state service in issue or prolongation of permissions to attraction of foreign labor power appears on paid basis according to the sizes of rates of charge, for issue or prolongation of permission to attraction of foreign labor power to the Republic of Kazakhstan, the approved order of the Government of the Republic of Kazakhstan of October 3, 2025 No. 819 "About establishment of rates of charge for issue or prolongation of permission to attraction of foreign labor power to the Republic of Kazakhstan";

2) the state service in renewal of earlier issued permissions to attraction of foreign labor power, and also in issue, prolongation or renewal of permissions to attraction of foreign labor power within internal transfer appears to the employer on free basis.

Payment of the fiscal duty is performed in cash and non-cash forms through the banks of the second level and the organization performing separate types of banking activities within 10 (ten) working days from the date of receipt of the notification in form according to appendix of 4 these rules of local executive bodies of areas, cities of republican value, the capital of adoption by it of the decision on issue or prolongation of permission to attraction of foreign labor power to the Republic of Kazakhstan.

Issue or prolongation of permissions to attraction of the foreign labor power performed within internal transfer is performed on free basis.

List of documents necessary for rendering the state service and its subspecies (in the presence)

1. In case of involvement of seasonal foreign workers:

1) the statement in form according to appendix 1 to these rules (further – the statement) certified by the digital signature (further – the EDS) the employer;

2) the information about the involved foreign workers with indication of surname, name, middle name (in case of its availability) (including Latin letters), birth dates, nationality, number, date and body of issue of the passport (identity document), the country of permanent residence, the country of departure, education, the name of specialty, compliance with professional standards, the Job evaluation catalog of positions of heads, specialists and other employees applied in the Republic of Kazakhstan, standard qualification characteristics of positions of heads, specialists and other employees of the organizations, the Single wage rate book of works and professions of workers, tariff and qualification characteristics of professions of workers and the national qualifier of the Republic of Kazakhstan 01-2017 "The qualifier of occupations" (further – Qualification requirements) according to subitem 16-1) of article 16 of the Code (further – the information about the involved foreign workers);

3) electronic copy of the identity document of the foreign worker;

4) the document confirming introduction of collection for issue of permission;

2. In case of involvement of foreign workers on the first, second, third and fourth categories:

1) the statement certified by the EDS of the employer;

2) the information about the involved foreign workers;

3) electronic copies of notarially attested education documents and transfers (if the document is not filled on state or Russian) legalized in the procedure established by the legislation of the Republic of Kazakhstan except as specified, provided by the become effective international treaties of the Republic of Kazakhstan;

4) notarially attested electronic copy and transfer (if the document is not completed on state or Russian) the contract for performance of works, rendering services (if foreign legal person employer, performs the activities in the Republic of Kazakhstan without formation of branch, representation according to Item 39 of these rules);

notarially attested electronic copy and transfer (if the document is not completed on state or Russian) the document (the letter or the agreement on transfer) approved between the foreign worker and foreign legal person employer from whom temporary transfer of the foreign worker is made (if foreign legal person employer, sends the workers to the Republic of Kazakhstan for performance of works, rendering services in the affiliated organization, representation, branch of the foreign legal entity in whom such foreign legal person employer directly or indirectly has shares or shares);

5) the electronic copy of the letter of the employer which confirms compliance of qualification and working experience of the foreign worker of position on which its attraction is performed;

6) information on accomplishment of replacement of foreign workers by the Kazakhstan citizens in case of issue of permissions to attraction of foreign labor power according to Item 14 of these rules;

7) information on local content in personnel in form according to appendix of 6 these rules (except for small business entities, public institutions and the companies, representations and branches of foreign legal entities numbering workers no more than 10 people, the foreign workers who arrived for independent employment to the Republic of Kazakhstan in compliance of issue or prolongation of references to the foreigner or the stateless person about compliance of its qualification for independent employment, the list of priority industries (types of economic activity) and professions demanded in them according to subitem 14-5) of article 11 of the Law of the Republic of Kazakhstan "About population shift", on the permissions issued within quotas over the countries of outcome in the presence of the international treaties on cooperation ratified by the Republic of Kazakhstan in the field of labor migration and social protection of migrant workers;

8) notarially attested copy of the document on conditions on local content in personnel for investment priority projects in the established form according to appendix of 7 these rules;

9) information on replacement of foreign workers by the Kazakhstan citizens it agrees Item 14 of these rules;

10) the electronic copy of the service provision agreement in the territory of the corresponding administrative and territorial unit (in case of attraction of foreign labor power within several administrative and territorial units);

11) the electronic copy of the letter of authorized body of the corresponding administrative territorial unit on satisfaction of the need for required foreign labor power (in case of attraction of foreign labor power within several administrative and territorial units);

12) electronic copy of the identity document of the foreign worker;

13) the document confirming introduction of collection for issue of permission;

3. Renewal of permission to attraction of foreign labor power:

for renewal of permission to attraction of foreign labor power are provided documents, stipulated in Item 2 lists of documents necessary for rendering the state service are necessary.

4. Prolongation of permission to attraction of foreign labor power:

1) the statement certified by the EDS of the employer;

2) the information about the involved foreign workers;

3) information on local content in personnel;

4) electronic copy of the identity document of the foreign worker;

5) the document confirming introduction of collection for issue of permission.

5. Issue or renewal of permission to attraction of foreign labor power within internal transfer:

1) the statement certified by the EDS of the employer;

2) the electronic copy of notarially attested transfer (if the document is not completed in the Kazakh or Russian languages) the employment contract (concluded with the legal entity founded in the territory of the member country of the World Trade Organization, who is and acting outside the territory of the Republic of Kazakhstan), or letters or the agreement on internal transfer signed with the employer (concluded with the legal entity founded in the territory of the member country of the World Trade Organization, who is and acting outside the territory of the Republic of Kazakhstan), with branch, representation, the affiliate of this legal entity, founded / undergone accounting registration in the Republic of Kazakhstan;

3) information on labor activity of the worker with appendix of the supporting documents recognized in the Republic of Kazakhstan;

4) information on accomplishment of the special conditions assigned in case of issue of permissions to attraction of foreign labor power according to Item 80 of these rules;

5) the electronic copy of the letter of foreign legal person employer who confirms about compliance of qualification and working experience of the foreign worker of position on which internal transfer, and also the letter from the host party, confirmatory is made that the worker has necessary qualification and working experience of work;

6) information on the accepted special conditions for obtaining and prolongation of permissions on form according to appendix of 8 these rules;

7) information on local content in personnel in case of involvement of foreign workers within internal transfer according to appendix of 9 these rules;

8) the electronic copy of the program for increase in local content in personnel (in the presence);

9) electronic copy of the identity document of the foreign worker;

6. Prolongation of permission to attraction of foreign labor power within internal transfer:

1) the statement certified by the EDS of the employer;

2) information on accomplishment of special conditions of the permissions to attraction of foreign labor power issued for previous and flowing calendar years, according to Item 80 of these rules;

3) information on local content in personnel in case of involvement of foreign workers within internal transfer;

4) reasons for prolongation of term of permissions;

electronic copy of the identity document of the foreign worker;

5) information on the accepted special conditions.

7. Renewals of permission in connection with change of surname, name, middle name, number and series of the identity document of the foreign worker and in case of reorganization of the employer legal entity of the Republic of Kazakhstan or branch (representation) of the foreign legal entity in the form of merge, accession, separation, allocation or transformation, and also in case of the change of its name or details specified in permission to attraction of foreign labor power:

1) the statement certified by the EDS of the employer;

2) the electronic copies of documents confirming change of surname, name, middle name, number and series of the identity document of the foreign worker, reorganization of the employer legal entity of the Republic of Kazakhstan or branch (representation) of the foreign legal entity in the form of merge, accessions, separations, allocations or transformations and also in case of the change of its name or details specified in permission to attraction of foreign labor power.

The bases for refusal in rendering the state service and its subspecies (in the presence) established by the Law of the Republic of Kazakhstan

1. In case of issue or prolongation (renewal) of permission to attraction of foreign labor power:

1) establishment of unauthenticity of the documents submitted by the employer for receipt of the state service, and (or) these (data) containing in them;

2) discrepancy of uslugopoluchatel and (or) the provided materials, objects, supplied and the information necessary for rendering the state service, to the requirements established by regulatory legal acts of the Republic of Kazakhstan;

3) concerning uslugopoluchatel there is decision (sentence) of court on prohibition of activities or the separate types of activity requiring receipt of certain state service which took legal effect;

4) concerning uslugopoluchatel there is judgment which took legal effect based on which the uslugopoluchatel is deprived of the special right connected with receipt of the state service;

5) lack of consent of the uslugopoluchatel provided according to article 8 of the Law of the Republic of Kazakhstan "About personal data and their protection" on access to personal data of limited access which are required for rendering the state service;

6) other bases for refusal in rendering the state service provided by the Laws of the Republic of Kazakhstan.
