I ORDER:

1. Approve the enclosed list of some orders to which changes are made (further – the List).

2. To provide to department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication, except for paragraphs of the third, fourth, sixth, seventh Item 2, of Item 3 of the List which become effective since July 12, 2026.

Rules of work, maintenance and access to digital systems and databases

Chapter 1. General provisions

1. These rules of work, maintenance and access to digital systems and databases (further – Rules) are developed according to the subitem 1) of Article 7-2, the subitem 2) of Item 1 of article 16 of the Law of the Republic of Kazakhstan "About cyber security" (further – the Law), the subitem 79) of Item 15 of the Regulations on the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan (further – the Ministry) approved by the order of the Government of the Republic of Kazakhstan of February 18, 2017 No. 81 "Some questions of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan" and determine operating procedure, maintenances and access to digital systems and databases (further – TsS).

2. Action of these rules extends to the users who are working, accompanying and having access to TsS.

3. In Rules the following basic concepts are used:

1) information – the information about persons, objects, facts, events, the phenomena and processes fixed in any form, constituted or received by owners of information and which is available at their order;

2) information access – the right of everyone guaranteed by the state, enshrined in the Constitution and the laws of the Republic of Kazakhstan to freely receive and distribute information by any method which is not prohibited by the law;

3) the database – data set, organized according to the conceptual structure describing characteristics of these data, and also interrelations between their objects;

4) cyber security – condition of security of digital objects from violation of their confidentiality, integrity or availability;

5) the administrator of cyber security (further – the administrator of CB) – the person exercising control over fulfillment of requirements on protection of digital resources, providing access to TsS;

6) SKUD – control and management system for access to digital systems;

7) the request of access – the request for registration (creation of accounting record) of the user and provision to it (or its change) access rights to digital systems;

8) the specifications and technical documentation – set of the documents determining general tasks, the principles and requirements to creation and use (operation) of digital objects, and also control of their compliance to the established requirements in the field of digitalization;

9) the applicant – the legal entity performing activities in the field of rendering the state services according to the legislation of the Republic of Kazakhstan;

10) the user – the subject of the digital circle using digital objects for accomplishment of specific function and (or) task;

11) technical documentation – documentation set on digital object based on which creation and development of object of digitalization, and also its trial and commercial operation is performed;

12) the TsS administrator – person performing system maintenance of software and hardware and maintenance of TsS;

13) digital system - functionally connected complex of digital resources using objects of digital infrastructure for the purpose of ensuring creation, collection, processing, storage and distribution of digital data, and also automating interaction of subjects of the digital circle and (or) providing rendering services in the digital circle;

14) owner of digital systems – Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan;

15) digital object – the isolated element of the digital circle created used or transferred by means of digital technologies having unique digital characteristics and allowing subjects of the digital circle to perform competences of ownership, use or the order in the amount established by the legislation of the Republic of Kazakhstan;

16) the owner of digital object – subject to which the owner of digital object granted rights of possession and uses of digital object in the limits determined by the law or the agreement and procedure;

17) maintenance of digital object – the ensuring use put into commercial operation of digital object according to its appointment, including actions for carrying out adjustment, modification and elimination of defects of the software without carrying out upgrade and implementation of additional functional requirements and on condition of preserving its integrity;

18) digital resource – set of the arranged digital data, digital records and the software for their creation, storage, processing, display and distribution.

Chapter 2. Operating procedure with digital systems and databases

4. Work with TsS represents set of actions of users which need to be observed during the work with TsS.

Actions of users of TsS are performed on the basis of the teams entered by TsS developers. These teams allow to systematize work of users of TsS and to regulate their legal responsibility during the work with TsS.

5. Users of TsS:

1) is used by TsS according to their application;

2) follow rules of cyber security during the work with TsS;

3) ensure safety of logins and passwords, do not allow their transfer to the third parties;

4) is timely updated by passwords;

5) inform the TsS administrators or administrators of CB on the facts of violation of integrity of data, failures in functioning of TsS, cyber security incidents.

6. During the work with TsS it is not allowed to users:

1) to use someone else's accounts;

2) independently to change parameters of functioning of TsS without the permission of the TsS administrators;

3) to copy, modify, delete or distribute the data containing in TsS;

To use 4) TsS for the purpose of which are not connected with execution of service duties;

To load 5) into TsS the software which is not approved with the TsS administrators;

6) to take actions capable to lead to violation of operability of TsS or compromise of information.

7. Actions of users in TsS are subject to registration in SKUD.

8. All works on maintenance, updating, change of functionality of TsS are performed by the TsS administrators.

Chapter 3. Procedure for maintenance of digital systems and databases

9. Ensuring maintenance of TsS is performed according to the Law and policy of the cyber security of the Ministry approved according to Item 30 of Single requirements in the field of information and communication technologies and the ensuring information security approved by the order of the Government of the Republic of Kazakhstan of December 20, 2016 No. 832 "About approval of single requirements in the field of information and communication technologies and ensuring information security".

10. The owner of digital object through the TsS administrators provides working capacity, performs rapid response to requests of users concerning functioning of TsS.

11. TsS function in the state and Russian languages in the round-the-clock mode.

12. Sources of information on emergence of technical failure in functioning of TsS are:

1) the message of the user submitted by means of feedback form according to Item 14 of these rules;

2) the message of the administrators who are carrying out monitoring of functioning of TsS;

3) the software and hardware on monitoring and detection of defects of TsS used for determination of working capacity and availability of functionality, which found technical failure;

4) the TsS system magazines in which the records testimonial of origin or possibility of technical failure are registered.

13. The user submits the application about emergence of technical failure by e-mail or by phone which is specified in TsS containing the following data:

1) surname, name, middle name (in case of its availability), position, the personal unique identifier (login) of the user;

2) address reason;

3) contact information of the user (phone number, e-mail address).

14. Users in case of technical issues on the services provided through TsS address the TsS administrators by means of form of the feedback placed on Internet resource. The address of users contains the following data:

1) contact information;

2) investment (file);

3) address subject;

4) text of the address;

5) e-mail address.

15. The term of accomplishment of the request no more than three working days from the date of application of the user if the reason of the address of the user is connected with functioning of TsS.

16. The TsS administrators place the following information on functioning on TsS:

1) instructions in text and video formats, frequently asked questions and answers to them;

2) about new opportunities of Internet resource for informing users.

17. For the purpose of ensuring operability of TsS, the owner of digital systems through the TsS administrator provides:

1) smooth operation of TsS in the round-the-clock mode, including festive and the days off;

2) safety, protection, recovery in case of failure or damage of information, backup and control over timely updating of information in TsS, the automated accounting, safety and periodic archiving of information of all addresses of TsS;

3) introduction of adjustments, modifications in the TsS program code within permission of addresses, and elimination of defects of TsS, without carrying out upgrade and implementation of additional functional requirements and on condition of preserving its integrity;

4) interaction with digital systems of state bodies and other digital objects;

5) placement of additional types of information;

6) carrying out audit of condition of TsS;

7) connection to the Operational center of cyber security according to article 7-2 of the Law.

Chapter 4. Procedure for access to digital systems and databases

18. For provision of access to TsS it is necessary to register the user in TsS.

19. The procedure of registration (creation of accounting record) of the user and provision to it (or its change) access rights to TsS is initiated by the request of access.

The application of access to TsS is submitted through SKUD.

20. The accounting record of the user contains the personal unique identifier (login) and the temporary password for the first entrance to TsS under which it is registered and works in TsS.

21. Organizational support of processes of registration of the user and provision to it or changes of its access rights to TsS is performed by the administrator of CB based on the submitted applications.

22. According to the arrived requests of access to TsS, the administrator of CB within three working days from the moment of receipt of the request directs the answer to the corporate e-mail specified in the request.

In the answer the personal unique identifier (login) and the temporary password for the first entrance, or information on refusal in satisfaction of the request of access to TsS in case of lack of the basis for provision of access to TsS is specified.

23. The order on employment, movement of other position, dismissal of the employee approved within one year before date of application forms the basis for application of access to TsS. The copy of the document which formed the basis goes appendix to the request of access to TsS.

24. The temporary password for the first entrance to TsS is replaced with the user in case of the first entrance to TsS. Process of registration of users is considered the user of the password completed after change for the first entrance to TsS.

25. Issue of the personal unique identifier (login) and the temporary password for the first entrance to TsS to the user is registered the administrator of CB in the magazine of registration of users and issues of personal unique identifiers (logins) in form according to appendix 1 to these rules, except as specified uses of SKUD automatically.

26. During the work in TsS it is not allowed:

1) use by several users of the same personal unique identifier (login);

2) transfer by the user of the of the personal unique identifier (login) and password to other persons.

27. In case of dismissal, transfer into other work the position in the organization of the applicant, expansion (reduction) of functional obligations of the user, work-related in TsS, is made change of the rights of the user based on again submitted application.

28. Accounting record of the user with which use the entrance to TsS was not performed more than 30 (thirty) calendar days and (or) cyber security violations are revealed, it is blocked.

29. For activation of the blocked accounting records, and also in case of loss of the password and (or) the personal unique identifier (login), not providing requirements for safety of the personal unique identifier (login) and the password with the applicant the repeated application in form according to appendix 2 to these rules is submitted.

30. Access to TsS is provided to exclusively acting staff of state bodies and public institutions within their ex-officio full powers.

Access to TsS to other persons is not provided, except as specified, stipulated by the legislation the Republic of Kazakhstan.

31. Users in case of operation of TsS are guided by the Law and the specifications and technical documentation, state standards in the field of digital technologies and cyber security, policy of cyber security of the owner of digital systems.
