I ORDER:

1. Bring in the order of the Minister of health and social development of the Republic of Kazakhstan of December 25, 2015 No. 1019 "About approval of Rules and terms of carrying out training, instructing and examinations on safety issues and labor protections of the workers, heads and persons responsible for safety and labor protections" (it is registered in the Register of state registration of regulatory legal acts for No. 12665) the following change:

And labor protections of the workers, heads and persons responsible for the safety and labor protections approved by the specified order to be reworded as follows rules and terms of carrying out training, instructing and examinations on safety issues according to appendix to this order.

2. To provide to department of work and social partnership of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within three working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the first vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

4. This order becomes effective since July 12, 2026 and is subject to official publication.

Rules and terms of carrying out training, instructing and examinations on safety issues and labor protections of the workers, heads and persons responsible for safety and labor protections

Chapter 1. General provisions

1. These rules and terms of carrying out training, instructing and examinations on safety issues and labor protections of the workers, heads and persons responsible for safety and labor protections, (further – Rules) are developed according to the subitem 30) of Article 16 of the Labor code of the Republic of Kazakhstan (further – the Code) and determine procedure and terms of carrying out training, instructing and examinations by safety issues and labor protections of the workers, heads and persons responsible for safety and labor protections.

2. In these rules the following basic concepts are used:

1) special professional competences - the competences necessary for the heads and persons responsible for safety and labor protections of the organization for effective professional activity for safety and labor protections in certain industry;

2) single digital system of the social and labor sphere (further – ETsS) – digital system of authorized state body, local executive bodies concerning social protection and employment of the population, the centers of labor mobility, career centers, the Center of development of manpower and interdepartmental interaction for the purpose of provision of the state services to the population in the social and labor sphere;

3) the Single educational and methodical center – the division of the Republican state company on the right of economic maintaining "Republican research institution on labor protection of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan" performing the activities at the expense of own means by rendering (further – EUMTs) paid services and the providing organizational and methodical maintenance of examination, development of standard training programs and training in safety and labor protection;

4) authorized state body on work – the central executive body enabling forming and the realization of state policy in the field of employment relationships according to the legislation of the Republic of Kazakhstan;

5) labor safety – the condition of security of workers provided with complex of the actions excluding impact of harmful and (or) dangerous factors on workers in the course of labor activity;

6) general professional powers – the competences necessary for the heads and persons responsible for safety and labor protections of the organization, for effective professional activity on safety and labor protections;

7) the certificate - the document which is confirming passing by the worker of examination in examination of rules, regulations and security guidelines and labor protection in paper or electronic form, having unique digital characteristics and allowing subjects of the digital circle to perform competences of ownership, use or the order in the amount established by the legislation of the Republic of Kazakhstan;

8) safety regulations – the qualitative and quantitative indices characterizing conditions of production, production and labor process from the point of view of ensuring the organizational, technical, sanitary and hygienic, biological and other regulations, rules, procedures and criteria directed to preserving life and health of workers in the course of their labor activity;

9) distance training – the training performed in case of interaction of the teacher and students at distance including using digital technologies and telecommunication means;

10) competence - capability to apply the skills allowing to carry out one or several professional tasks constituting labor function;

11) the training organization – the organization performing professional training, retraining and advanced training on safety issues and labor protections, included in the List of the training organizations for safety and labor protection;

12) the list of the training organizations – the database containing information on the training organizations, created by authorized state body on work in ETsS;

13) the work permit – the document in paper or electronic form resolving performance of works with the increased danger in which content and the place of performance of works, time of their beginning and the termination, condition of safe accomplishment, necessary security measures, structure of crew, responsible persons and results of risks assessment are specified;

14) the single list of certificates – the digital database about the issued certificates by results of training and examination in the field of safety and the labor protections created and accompanied with authorized state body on work in ETsS;

15) the electronic certificate – the electronic document which is confirming passing by the heads and persons responsible for safety and labor protections, examinations on safety issues and labor protections, having unique digital characteristics and allowing subjects of the digital circle to perform competences of ownership, use or the order in the amount established by the legislation of the Republic of Kazakhstan, registered by the training organization in ETsS (further – the certificate).

3. Treat training in safety and labor protection:

1) instructing in safety and labor protection;

2) training on workplace;

3) training in safe methods (skills) of work in the course of labor activity (in all forms and types of training);

4) advanced training in the field of safety and labor protection.

4. The workers employed, and also transferred to other work are trained with the subsequent examination on safety issues and labor protections in the terms established by the employer, but no later than one month after execution of an employment agreement or change of its conditions.
