About introduction of amendments to some orders

I ORDER:

1. Approve the enclosed list of some orders to which changes are made (further - changes).

2. To provide to department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

4. This order becomes effective since July 12, 2026, except for paragraphs of the fifty third, fifty fourth, fifty eighth Item 1, of paragraphs two, the third, fifth, sixth, eighty sixth, ninetieth, ninety third, ninety seventh, 100-th, hundred second, hundred fourth Item 2, of paragraphs of the third, fourth, fifth, sixth, seventh, eighth, ninth, twelfth, thirteenth, eighteenth, nineteenth, twenty second, twenty third, twenty fourth, twenty eighth Item 3, of paragraphs two, the third, fifth, sixth, thirty fourth, thirty fifth, forty third, forty fourth, forty sixth, forty ninth, fifty first, fifty second, fifty third Item 4, of paragraphs two, the third, fifth, sixth, sixty sixth, seventieth, seventy third, seventy sixth, seventy eighth Item 5, of paragraphs two, third, the fifth, sixth, fiftieth, fifty first, fifty second, fifty third, fifty fourth, fifty fifth, sixty eighth, sixty ninth, seventieth, seventy first, seventy second Item 6 to changes which become effective after ten calendar days after day of its first official publication.

Determine that till July 12, 2026 appendices 3, 7 and 10 to Rules of appointment and implementation of payment of public welfare payment for the birth, attendance allowances, extra family allowances, benefits of the awarded mother, the approved order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of May 24, 2023 No. 169 "About approval of Rules of appointment and implementation of payment of public welfare payment for the birth, attendance allowances, extra family allowances, benefits of the awarded mother" (it is registered in the Register of state registration of regulatory legal acts No. 32571), appendix 3 to Rules of appointment and payment of special public welfare payment, the approved order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of May 31, 2023 No. 192 "About approval of Rules of appointment and payment of special public welfare payment" (it is registered in the Register of state registration of regulatory legal acts No. 32659), appendices 4 and 8 to Rules of appointment and payment of the public welfare payment granted and paid to mother or the father, the adoptive father (adopter), the guardian (custodian) who are bringing up the child with disability (children with disability), public welfare payment to the faces performing face care with disability of the first group, approved by the order of the Deputy prime minister - the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 9, 2023 No. 215 "About approval of Rules of appointment and payment of the public welfare payment granted and paid to mother or the father, the adoptive father (adopter), the guardian (custodian) bringing up the child with disability (children with disability), public welfare payment to persons performing face care with disability of the first group" (it is registered in the Register of state registration of regulatory legal acts No. 32851) and appendix 2 to the Rules of appointment and payment of the address public assistance approved by the order of the Deputy prime minister - the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 21, 2023 No. 227 "About approval of Rules of appointment and payment of the government address public assistance" (it is registered in the Register of state registration of regulatory legal acts No. 32885), are effective in edition according to appendices 1, of 2, of 3, of 4, of 5, 6 and 7 to this order.

For purpose of benefits for the birth and on leaving the applicant addresses to authorized body to destination of benefits through the State corporation, on the portal or through digital objects of banks of the second level with statements in forms according to appendices 1 and 2 to these rules according to the enclosed documents specified in the list of the main requirements to rendering the state service "Purpose of Benefits for the Birth of the Child and on Child Care" according to appendix 3 to these rules.

Submission of the statement for purpose of benefits for the birth and on leaving is not required in case of purpose of benefit through pro-active service according to the Law.

Data of the identity document of the applicant, the certificate (certificate) on the birth of child(children) or the statement from the birth record, or the certificate of registration of the act of civil status issued by bodies of civil registration, the certificate on the conclusion (termination) of scrap (matrimony), the document confirming establishment of guardianship (guardianship) over the child or data on adoption (adoption) from the birth record of data on registration at the place of residence, the data on bank account number specified in the electronic statement of the applicant receive from the corresponding state digital systems through lock of "the digital government" (further – digital systems) according to requests in digital systems of state bodies and (or) organizations according to appendix 4 to these rules.

By provision of the certificate (certificates) on the birth of child(children) granted or certified by competent organization of foreign state or specially on that the authorized person within its competence and in the established form sealed official foreign state, procedures of apostilization or legalization are adopted only after passing, according to the joint order of the acting minister of justice of the Republic of Kazakhstan of November 4, 2021 No. 950, the Minister of Internal Affairs of the Republic of Kazakhstan of November 15, 2021 No. 702, the Minister of Finance of the Republic of Kazakhstan of November 16, 2021 No. 1182, the Head of Department on ensuring activity of the courts under the Supreme Court of the Republic of Kazakhstan (the office of the Supreme Court of the Republic of Kazakhstan) of November 16, 2021 No. 30, the Minister for Culture and Sports of the Republic of Kazakhstan of November 24, 2021 No. 363, the acting as the Attorney-General of the Republic of Kazakhstan of November 24, 2021 No. 155, the Minister of Education and Science of the Republic of Kazakhstan of November 29, 2021 No. 574 and the Minister of Defence of the Republic of Kazakhstan of December 8, 2021 No. 851 "About approval of Single rules of putting down of apostille" (it is registered in the Register of state registration of regulatory legal acts at No. 25789) the order of the acting minister of foreign affairs of the Republic of Kazakhstan of December 6, 2017 No. 11-1-2/576 "About approval of Rules of legalization of documents" (it is registered in the Register of state registration of regulatory legal acts at No. 16116) if other is not provided by the international treaty ratified by the Republic of Kazakhstan.

For purpose of benefits for the birth and on leaving submission of the certificate of birth of child(children) or the reference containing data from civil registrations on the birth, certificates on the conclusion, annulment of marriage (matrimony), except for the data on marriage (matrimony) registered outside the Republic of Kazakhstan and also the document confirming establishment of guardianship (guardianship) over the child or data on adoption (adoption) from the birth record, data on bank account number is not required in case of confirmation of information containing in the specified documents according to requests in digital systems of state bodies and (or) the organizations according to appendix 4 to these rules.

The list of the main requirements to rendering the state service including names of the state service and the service provider, provision methods, terms, form and result of rendering the state service, the amount of the payment levied from uslugopoluchatel when rendering the state service and methods of its collection in cases, stipulated by the legislation the Republic of Kazakhstan, the working schedule of the service provider, the State corporation and digital objects, the list of the documents and data requested at uslugopoluchatel for rendering the state service, the basis for refusal in rendering the state service, established by the laws of the Republic of Kazakhstan and also other requirements taking into account features of rendering the state service are stated in annex 3 to these rules.

In case of registration of the birth of child(children) at the choice of uslugopoluchatel the state service "Purpose of Benefits for the Birth of the Child and on Child Care" is rendered by the principle of "one statement".";

"7. Data of the identity document of the applicant, the certificate (certificate) on the birth of child(children) or the statement from the birth record, or the certificate of registration of the act of civil status issued by bodies of civil registration, the certificate on the conclusion (termination) of scrap (matrimony), the document confirming establishment of guardianship (guardianship) over the child or data on adoption (adoption) from the birth record, data on registration at the place of residence, the data on bank account number specified in the electronic statement of the applicant receives from the corresponding state digital systems through lock of "the digital government" (further – digital systems) according to requests in digital systems of state bodies and (or) organizations according to appendix 4 to these rules.

By provision of the certificate (certificates) on the birth of child(children) granted or certified by competent organization of foreign state or specially on that the authorized person within its competence and in the established form sealed official foreign state, procedures of apostilization or legalization are adopted only after passing, according to the joint order of the acting minister of justice of the Republic of Kazakhstan of November 4, 2021 No. 950, the Minister of Internal Affairs of the Republic of Kazakhstan of November 15, 2021 No. 702, the Minister of Finance of the Republic of Kazakhstan of November 16, 2021 No. 1182, the Head of Department on ensuring activity of the courts under the Supreme Court of the Republic of Kazakhstan (the office of the Supreme Court of the Republic of Kazakhstan) of November 16, 2021 No. 30, the Minister for Culture and Sports of the Republic of Kazakhstan of November 24, 2021 No. 363, the acting as the Attorney-General of the Republic of Kazakhstan of November 24, 2021 No. 155, the Minister of Education and Science of the Republic of Kazakhstan of November 29, 2021 No. 574 and the Minister of Defence of the Republic of Kazakhstan of December 8, 2021 No. 851 "About approval of Single rules of putting down of apostille" (it is registered in the Register of state registration of regulatory legal acts at No. 25789) the order of the acting minister of foreign affairs of the Republic of Kazakhstan of December 6, 2017 No. 11-1-2/576 "About approval of Rules of legalization of documents" (it is registered in the Register of state registration of regulatory legal acts at No. 16116) if other is not provided by the international treaty ratified by the Republic of Kazakhstan.

For purpose of extra family allowances, submission of the certificate of birth of child(children), the certificate on the conclusion (termination) of scrap (matrimony), except for the data on marriage (matrimony) registered outside the Republic of Kazakhstan, the document confirming establishment of guardianship (guardianship) over the child or data on adoption (adoption) from the birth record, and also data on study on internal department of educational institution, data on bank account number are not required in case of confirmation of information containing in the specified documents according to requests in digital systems of state bodies and (or) the organizations according to appendix 4 to these rules.

The list of the main requirements to rendering the state service including names of the state service and the service provider, provision methods, terms, form and result of rendering the state service, the amount of the payment levied from uslugopoluchatel when rendering the state service and methods of its collection in cases, stipulated by the legislation the Republic of Kazakhstan, the working schedule of the service provider, the State corporation and digital objects, the list of the documents and data requested at uslugopoluchatel for rendering the state service, the basis for refusal in rendering the state service, established by the laws of the Republic of Kazakhstan and also other requirements taking into account features of rendering the state service are stated in annex 7 to these rules.";

state Items 13 and 14 in the following edition:

"13. For purpose of the benefit of the awarded mother to the statement provided in the State corporation or through the portal in forms according to appendices 8 and 9 respectively to these rules the documents specified in the list of the main requirements to rendering the state service "Purpose of Public Welfare Payment to the Mothers Awarded with Suspension Brackets " Three-copecks Piece of Alg ", " Kum_s of Alg " or Who Were Entitled Earlier "Mother Heroine", Awarded with the Degree Awards "Maternal Glory" I and II" according to appendix 10 to these rules are attached.

The data proving the identity on rewarding or receipt of rank of the mother awarded with suspension bracket "Three-copecks piece of alg", "Kum_s of alg" or who was entitled earlier "Mother heroine", awarded with the degree awards "Maternal Glory" I and II, registration at the place of residence data on bank account number of the applicant, receive from the corresponding state digital systems according to requests in digital systems of state bodies and (or) organizations according to appendix 4 to these rules.

Submission of the document on rewarding or receipts of rank of the mother awarded with suspension bracket "Three-copecks piece of alg", "Kum_s of alg" or who was entitled earlier "Mother heroine", awarded with the awards "Maternal Glory" I and II of degree, data on bank account number is not required in case of confirmation of information containing in the specified documents according to requests in digital systems of state bodies and (or) the organizations according to appendix 4 to these rules.

The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering and also other data taking into account features of provision of the state service is provided in the list of the main requirements to rendering the state service "Purpose of Public Welfare Payment to the Mothers Awarded with Suspension Brackets " Three-copecks Piece of Alg ", " Kum_s of Alg " or Who Were Entitled Earlier "Mother Heroine", Awarded with the Degree Awards "Maternal Glory" I and II" according to appendix 10 to these rules.

14. After submission of the relevant documents by the applicant for purpose of benefits at its presence the specialist of city, district department of the State corporation (further – department of the State corporation) receives the written consent of the applicant to collection and processing of the personal data, use of the data which are the secret protected by the law, containing in digital systems when rendering the state services if other is not provided by the laws of the Republic of Kazakhstan and creates:
