About the state social privileges, the rights and guarantees for separate categories of citizens

This Law determines legal, economic and organizational basis of provision to separate categories of citizens of the state social privileges, rights and guarantees in the Republic of Belarus.

Chapter 1. General provisions

Article 1. Concept of the state social privileges, rights and guarantees

For the purposes of this Law the state social privileges, the rights and guarantees (further - social privileges) are stipulated by the legislation benefits, full or partial relief from execution of the established obligations or simplification of conditions of their execution in connection with special social legal status of the citizen or features of its professional activity.

Article 2. The purpose and the principles of state policy in the sphere of provision of social privileges

1. State policy in the sphere of provision of social privileges is directed to enhancement of the state social support of the population, ensuring cost efficiency and social justice and is based on the principles of humanity, availability, targeting, security.

2. The means which are released in the course of streamlining of social privileges go for rendering the address public assistance to the population, implementation of state programs in the sphere of maternity welfare and the childhood, and also on holding additional actions for rehabilitation of the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP (further - the territory of radioactive pollution), according to the procedure, determined by the Government of the Republic of Belarus in coordination with the President of the Republic of Belarus.

Article 3. The main categories of the citizens having the right to social privileges

The right to social privileges according to this Law is had:

1. Heroes of Belarus, Heroes of the Soviet Union, Heroes of Socialist Work, complete gentlemen of awards of the Fatherland, Slava, Labour Glory.

2. Participants of the Great Patriotic War:

2.1. the military personnel including transferred to the reserve (resignation), passing military service or who was temporarily in the military units, headquarters and organizations which were part of field army (fleet) in the period of Civil or the Great Patriotic War and also during other combat operations on protection of the Fatherland, guerrillas and underground workers Civil or the Great Patriotic War;

2.2. the military personnel including transferred to the reserve (resignation), faces of the commanding and ordinary structure of law-enforcement bodies and state security agencies, serving during the period the Great Patriotic War in the cities, participation in which defense is set off in length of service for award of pension on favorable terms, the military units of field army established for the military personnel;

2.3. the faces of civilian structure of the Soviet Army, Navy, troops and law-enforcement bodies, state security agencies occupying in the period of the Great Patriotic War the established posts in the military units, headquarters and organizations which were part of field army or which were during this period in the cities, participation in which defense is set off in length of service for award of pension on favorable terms, the military units of field army established for the military personnel;

2.4. intelligence officers, counterintelligence and other persons performing special tasks in military units of field army, in the back of the opponent or in the territory of other states in the period of the Great Patriotic War;

2.5. the workers of special forming of the National commissariat of means of communication, the National commissariat of communication, floating structure of harvesting and transport courts and flight and lifting structure of aircraft of the National commissariat of fish industry of the USSR, sea and river fleet, flight and lifting structure of aircraft of Head department of the Northern Sea Route transferred to the period of the Great Patriotic War on provision of the military personnel and who were carrying out tasks for the benefit of field army (fleet) within rear borders of the operating fronts (operational zones of the fleet);

2.6. the military personnel including transferred to the reserve (resignation), faces of the commanding and ordinary structure of law-enforcement bodies and state security agencies, the fighters and command structure of destructive battalions, platoons and groups of protection of the people which was involved in combat operations on fight against the opponent's landings in the period of the Great Patriotic War and also in combat operations on liquidation of nationalist underground in the territory of the Ukrainian SSR, the Belarusian SSR and the Baltic republics during the period from January 1, 1944 to December 31, 1951;

2.7. persons who were involved in fighting against fascist Germany and its allies as a part of guerrilla groups, underground groups in the years of World War II in the territory of other states.

3. Disabled people of the Great Patriotic War and disabled people of fighting in the territory of other states (further – disabled veterans):

3.1. the military personnel including transferred to the reserve (resignation), passing military service or who was temporarily in the military units, headquarters and organizations which were part of field army, the guerrillas, underground workers who became disabled people owing to wound, contusions, mutilations or diseases got in days of Civil or the Great Patriotic War in areas of fighting;

3.2. the military personnel who became disabled people owing to wound, contusions, mutilations or diseases got in case of protection of the Fatherland or fulfillment of duties of military service in the states where fighting was conducted;

3.3. the workers and employees who became disabled people owing to wound, contusions, mutilations or diseases got in areas of fighting, on front sites iron, highways, in case of construction of defensive boundaries, naval bases, airfields, and the Governments of the USSR equated on provision of pensions to the military personnel of military units of field army according to special resolutions and orders;

3.4. the faces of the commanding and ordinary structure of law-enforcement bodies and state security agencies which became disabled people owing to wound, contusions, mutilations or diseases got on duty in areas of fighting;

3.5. the military personnel including transferred to the reserve (resignation), faces of the commanding and ordinary structure of law-enforcement bodies and state security agencies, the fighters and command structure of destructive battalions, platoons and groups of protection of the people which was involved in combat operations on fight against the opponent's landings in the period of the Great Patriotic War, and also in combat operations on liquidation of nationalist underground in the territory of the Ukrainian SSR, the Belarusian SSR and the Baltic republics during the period from January 1, 1944 to December 31, 1951 and become disabled people owing to wound, contusions, mutilations or diseases got when carrying out these transactions;
