About Management of public service in case of the President of the Republic of Tajikistan

In pursuance of the Presidential decree of the Republic of Tajikistan of November 30, 2006 "About enhancement of structure of the central executive bodies of the Republic of Tajikistan" and according to article 7 of the Law of the Republic of Tajikistan "About public service" I decide No. 9:

1. Approve the Provision, structure of Central office and the Scheme of management of Management of public service in case of the President of the Republic of Tajikistan (appendices 1, 2, 3).

2. Establish the extreme number of employees of Management of public service in case of the President of the Republic of Tajikistan in number of 48 units (without service personnel), including the number of Central office in number of 28 units.

3. Permit Management of public service to have one deputy chief in case of the President of the Republic of Tajikistan and to set limit of office cars in number of 4 units.

4. Financing of Central office of Management of public service in case of the President of the Republic of Tajikistan and its local structures to make at the expense of means of the republican budget.

5. Declare invalid the Presidential decree of the Republic of Tajikistan of February 7, 2001 No. 479 "About Management of public service in case of the President of the Republic of Tajikistan".

Regulations on Management of public service in case of the President of the Republic of Tajikistan

Provision I.Общие

1. Management of public service in case of the President of the Republic of Tajikistan (further - Management), being the central executive body, performs single state policy and normative legal regulation in the sphere of public service.

2. Management submits and is accountable to the President of the Republic of Tajikistan and performs the activities in interaction with other central executive bodies, local executive bodies of the government, public associations and other organizations.

3. Exercises control the activities based on the Constitution of the Republic of Tajikistan, the Law of the Republic of Tajikistan "About public service", other laws of the Republic of Tajikistan, resolutions of Majlisi milli and Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan, decrees and orders of the President of the Republic of Tajikistan, resolutions and orders of the Government of the Republic of Tajikistan, international legal acts recognized by the Republic of Tajikistan and this provision.

II. Powers

5. Exercises control in the established field of activity the following powers:

- the organization of reception of citizens, government employees and officials of state bodies, ensuring timely and complete examination of their oral and written addresses, acceptance on them relevant decisions and the direction of answers to applicants in the terms established by the legislation;

- within the competence providing protection of the data containing the state secret;

- organization of professional training and retraining, advanced training and training of employees of Management, government employees and officials of state bodies;

- control of the state order on professional training and retraining, advanced training and coordination of activities of state bodies in this direction, ensuring their execution;

- interaction with authorized state bodies of public service of foreign states and the international organizations in the established field of activity;

- implementation of completing, storage, accounting and uses of the archive documents formed in the course of activities of Management of public service and its local structures;

- conducting check of activities of state bodies for compliance with law in the sphere of public service, attraction to check of workers and specialists of other authorized state bodies;

- control of matching, arrangement and education of personnel of public service, development and ensuring implementation of annual curricula;

- protection of the rights and legitimate interests of government employees;

- creation of the database on questions of public service, government employees and reserve of personnel of public service;

- participation in development and implementation of state programs on enhancement and development of public service and drafts of international treaties on public service;

- introduction of the offer on assignment of qualification ranks by the government employee and enhancement of salary system and social security of government employees in accordance with the established procedure;

- implementation of information support of activities of state bodies concerning public service.

6. The management for the purpose of realization of powers in the established field of activity has the right:

- obtain from state bodies information necessary for decision making on questions in the established field of activity;

- make explanations to state bodies and government employees on questions in the established field of activity;

- attract to development of questions in the established field of activity the scientific organizations, scientists and specialists;

- organize and control activities of the local structures;

- within the established activities to create coordinating, advisory and expert bodies (councils, the commissions, working groups), including interdepartmental;

- make offers on improvement of working conditions, material and social security of government employees.
