Regulations on the Advisory committee of heads of legal services of the Ministries of Foreign Affairs of the State Parties of the Commonwealth of Independent States

I. General provisions

1. The advisory committee of heads of legal services of the Ministries of Foreign Affairs of the State Parties of the Commonwealth of Independent States (further - Committee) is body of legal cooperation of the CIS.

2. In the activities the Committee is guided by the conventional principles and rules of international law, applicable international treaties, decisions of Council of heads of states, Council of Heads of Government, Council of Foreign Ministers of the CIS, and also this Provision.

3. Organizational technical supply of activities of Committee is performed by Executive committee of the CIS.

4. The committee accepts the rules of procedure.

II. Main activities of Committee and its function

1. Main activities of Committee:

a) consideration of international legal aspects of activities of the CIS;

b) the analysis of practice of the State Parties of the CIS in the field of international law and implementation of the international obligations;

c) consideration of topical issues of international law;

d) the analysis of the draft documents drafted by the international bodies in the field of codification and progressive development of international law.

2. Main functions of Committee:

a) preparation at the request of Council of heads of states, Council of Heads of Government or Council of Foreign Ministers of the CIS, or on own initiative recommendations about the problems of international law, legal aspects of functioning of the CIS and other questions entering competence of Committee for the purpose of approval of general approaches of gosudarstvuchastnik of the CIS;

b) determination of the perspective directions of interaction of legal services of the Ministries of Foreign Affairs of the State Parties of the CIS;

c) interaction in questions of preparation and advanced training of personnel.

III. Rights of Committee

The committee for accomplishment of the functions has the right:

submit for consideration of Council of Foreign Ministers of the CIS of the recommendation about the questions entering its competence;

create working groups for accomplishment of specific objectives;

request information from the State Parties of the CIS on the questions entering its competence;

cooperate with legal bodies and services of other international organizations for the questions which are within its competence;

use in case of need services of experts for accomplishment of separate works;

consider other questions within its competence.

IV. Organization of work of Committee

1. Members of the committee are heads of legal services of the Ministries of Foreign Affairs of the State Parties of the CIS which signed the Decision of Council of Foreign Ministers of September 15, 2004 about creation of Committee, or person, them replacing on position.

Each member of the committee has in him one voice.

2. The representatives of the State Parties of the CIS which signed the Decision of Council of Foreign Ministers of September 15, 2004 about creation of Committee, who are not his members, and also the Chairman of Executive committee - the Executive secretary of the CIS or person authorized by it can participate in committee meetings with the right of advisory vote.

3. Presidency in Committee is performed serially within one year by each member of the committee on the basis of the principle of rotation according to the procedure of the Russian alphabet of names of the states.

4. Chairman of Committee:

coordinates work of Committee;

conducts committee meetings and at the request of Committee signs the documents accepted by it;

represents Committee in bodies of the Commonwealth and bodies of other international organizations.

5. Committee meetings are held in the State Parties of the CIS which signed the Decision of Council of Foreign Ministers of September 15, 2004 about creation of Committee, but at least two times a year.

Emergency meetings of Committee are convened by the Chairman, and also at the initiative of one or several members of the committee with the consent of at least a half of members of the committee.

6. Committee meetings are competent if at least two thirds of his members participate in them. In the absence of necessary number of members of the committee the meeting is not held.

7. The committee makes recommendations and decisions.

Recommendations are accepted on matters of substance based on consensus of the members of the committee participating in meeting.

Decisions are made on points of order by a simple majority vote of the members of the committee participating in meeting.

8. Results of committee meeting are drawn up by the protocol which is signed by the Chairman of Committee.

9. The committee informs Council of Foreign Ministers of the CIS on the done work.
